WHEREAS, there exists a critical shortage of rental housing in the City affordable to low income Cuban and Haitian refugees; and WHEREAS, in recognition of the need to provide safe and sanitary housing units for the refugee population in Miami, the U.S. Department of Housing and Urban Development has awarded the City of Miami $880,000 under the HUD Secretary's Discretionary Fund to administer a multi -family housing rehabilitation program; and WHEREAS, certain revisions to the program's implementa- tion guidelines are necessary to secure the participation of property owners and private lenders in the program. NOW, THEREFORE BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The Revised City of Miami Cuban/Haitian Refugee Assistance Multi -Family Rehabilitation Program, attached hereto and incorporated by reference, is hereby approved. Section 2. "; �, % it 03�&- July 8, 1982 - Cuban/Haitian Refugee Assistance Multifamily Rehabilitation Program Guidelines City Commission Agenda Item July 22, 1982 It is recommended that the City Commission i approve revised guidelines for implementation and administration of the Cuban/Haitian Refugee Assistance Multi -Family Rehabilitation Program. By Resolution No. 81-170, on March 17, 1981 the City Commission accepted an award of $1,010,000 from the U.S. Department of Housing and Urban Development under the HUD Secretary's Discretionary Fund to finance activities to assist in the resettlement of Cuban and Haitian Refugees. One of the HUD approved Grant activities was a multi -family rehabilitation loan program, intended to increase the number of standard rental housing units affordable to low and moderate income Cuban and Haitian families. $880,000 in Grant funds were allocated to this purpose. As originally designed, the loan program sought to involve local financial institutions in the rehabilitation financing. Interested owners of multifamily properties were required to secure rehabilitation financing commitments from local lenders of their choice. The Grant funds were to be used to reduce conventional interest rates. Unfortunately, private lenders were reluctant to participate in the program due to the complexities of the private and public financing of the rehabilitation from the administrative standpoint. Program guidelines have been revised to allow for separate tandem public and private financing of projects. Interested property owners will negotiate to obtain private financing at the best available terms and the City will calculate the public subsidy to effectively lower the interest rate of the rehabilitation loan to three (3") percent. The maximum public subsidy will be the amount necessary to effectively reduce the interest rate to three percent or seventy (70r.) percent of the rehabilitation cost, whichever is less. Once the private/ public ratio of the rehabilitation cost is determined, the owner will negotiate separately for a private 'financial commitment for the private portion of the rehabilitation cost. The public subsidy will then be provided by the City as a deferred loan. The deferred loans will be forgivable at the end of 10 years f•-N.4 �+�Vu Howard V. Staff recommends these program guideline revisions to rove the program forward s (see attached guidelines). /so 1 CITY OF MIAMI CUAAN/HAITIAN REFUGEE ASSISTANCE PROGRAM MULTIFAMILY REHABILITATION PROGRAM GUIDELINES 0 PROGRAM GOALS AN.D OBJECTIVES During 1980, Dade County experienccd nn unexpected and sudden influx of Cuban and Haitian refugees which resulted in a population increase of approxim.=tely 122,500, on of the largest and most concentrated mass immigrations in r`cent decades. Despite the federal government's resettlement activities aimed at relocating refugees out of the Miami mecrupolitan -ire:a . it is estimated that close to 45,500 Cuban and Hait.an refugees have settled or resettled in the City of Miami alone. This massive local population increase poses c:i,`:ficult challenges to already heavily taxed community resources. in particular., the refugee influx has exacerbates? an e;r isring critical housing shortage. This situation has prompt ad action by the federal government to provide the City with funds in the amount of. $1,010,000 for a Cuban/Haitian Refugee Assistance Program. The City will u�n!lize $880,000 of this allocation to rehabilitate private multi -family rental_ units to hc:use the refugee population. In some instances this may lead to rents being set lower than the prevailing market"vents, in order to serve program objectives to fix rents at an affordable rate for the working refugee for a three-year period. Th,� subsidy is then provided by the City in the form of a del-.rrod payment loan and will require no regul-ar monthly payments. The loan principal will require no regular monthly payments. The roan principal will accrue interest at the rate of. 6 percent per annum o•,.rer a ten year period. The deferred loan will he forgiven at the grid cli the ten year period as long as the borrower complies during that time with the Rent Regulatory Agreement and keeps the property up to Dade County Minimum Housing Code Standards. Failure to comply with the above requirements shall- be considered a default and the loan together with accrued interest shall become due and payable at that time. Deferred loans shall be secured by a security instrument in a Form prescribed by the City and which shall be recorded. Such appropriate action shall includt-, mediation to assure the protection of both the applicarl" ilnd the contractor. Mediation will be provided by the City who will inspect the work and determine if it has beenperformed in accordance with the contract and in a l.lorkmanlike manner. If. the work has not been completed properly, the contractor will the ordered to make the necessary corrections before receiving final payment. If the contractor does make corrections as req,iested and the work is deemed satisfactory by the City, final payment shall be authorized to be disbursed to the contractor. If, on the other hand, the contractor fails to make the necessary corrections prior to the expiration of his ccntrlcL, the City shall assist the applicant in obtaining another contractor to crake the corrections.
