A RESOLUTION REQUESTING THE DEPARTMENT OF NATURAL RESOURCES, STATE OF FLORIDA, TO CONVEY TO THE CITY OF MIAMI, AS THE LOCAL SPONSOR, THE LEGISLATIVELY APPROPRIATED SUM OF $500,000 FOR JOSE MARTI RIVERFRONT PARK DEVELOPMENT; FURTHER AUTHORIZING THE CITY MANAGER TO EXECUTE A PROJECT AGREEMENT WITH THE DEPARTMENT OF NATURAL RESOURCES, STATE OF FLORIDA, FOR THE USE OF THE AFORESAID FUNDS. WHEREAS, the Latin Community Riverfront Park, now known as Jose Marti Riverfront Park, was first recommended for development by the Community Task Force (established in 1971) in order to alleviate a deficiency in recreation and leisure service facilities in the Little Havana Neighborhood; and WHEREAS, Resolution No. 79-576, adopted September 13, 1979, authorized the City Manager to conduct a design competi- tion and appoint an impartial jury for the selection of the competition winners, and also authorized the City Manager to negotiate a professional services agreement with the competi- tion design winners: Wallace, Roberts and Todd, Architects, in compliance with Ordinance No. 8965, adopted July 22, 1979; and WHEREAS, Resolution No. 81-115, adopted February 26, 1981, approved the revised development Program and Master Plan for Jose Marti Riverfront Park; and WHEREAS, a construction contract in the amount of $1,910,934 was approved by Resolution No. 82-349, adopted April 22, 1982, and construction on this first phase of development is scheduled to commence in July, 1982; and WHEREAS, the City desires to proceed with the design and construction of the remaining project elements; and WHEREAS, the Florida State Legislature has appropriated the sum of $500,000 from the Department of Natural Resources' Land Acquisition Trust Fund to be used for Jose Marti Riverfront Park Development located in the City of Miami. NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: CITY COMMISSION MEETING OF J U L 2 g 1982�3 •..N.H...M NM+�1'l�1� Section 1. The Department of Natural Resources, State of Florida, is hereby requested to convey to the City of Miami, as the local sponsor, the legislatively appropriated sum of $500,000 for Jose Marti Riverfront Park Development. Section 2. The City Manager is hereby authorized to execute a Project Agreement with the Department of Natural Resources, State of Florida, to implement the use of the aforesaid funds. Fo_r City Commission meeting of July 22/82. _ ----- "It is recommended that the Department of Natural Resources, State of Florida, be requested to convey the $500,000 legislative appropriation for Jose Marti Riverfront Park to the Citv of Miami as the local sponsor, and that the City Manager be authorized to execute the forthcoming project agreement as per the attached resolution." By the 1982 State of Florida legislative appropriation, $500,000 from the Department of Natural Resources' Land Acquisition Trust Fund, has been allocated to be used for the Jose Marti River - front Park Development. In order to utilize these funds, the City must make an official request as the local sponsor to have these funds conveyed to us. This request is required to be in the form of a resolution as attached. Subsequent to receipt of our request, the Department of Natural Resources will prepare a Project Agreement for which this resolution also seeks authorization to execute. TURLINGTON Commissioner of Education As you know, the 1982 legislative appropriation included $500,000 from the Department of Natural Resources' Land Acquisition Trust Fund, to be used for Jose Marti Park in the City of Miami. We are pleased to be able to participate with the City in this recreation project. Although this appropriation will not be processed under the rules of our local assistance grant programs, it is necessary that this agency exercise control over the manner in which the funds are disbursed, in order to comply with departmental audit and accountability standards. The initial action which the City should take to utilize these funds is to submit an official request to the Department. The request should be in the form of a resolution, which should also identify the proposed project, and commit the City to act as local sponsor in implementing the project. Following the request, we will prepare a project agreement between this agency and the City, which will set forth certain necessary conditions and requirements pertaining to the expenditure of state funds. It should be noted that while the Legislative Letter of Intent indicates that the funds may be released in advance, this option will be available at the Department's discretion.
