' .1 AN EMERGENCY ORDINANCE AMENDING SECTIONS 1 AND 5 OF ORDINANCE NO, 9321 ADOPTED SEPTEMBER 24, 1.981, THE ANNUAL APPROPRI- ATIONS ORDINANCE FOR THE FISCAL YEAR ENDING SEPTEMBER 30, 1982, AS AMENDED, BY INCREASING THE APPROPRIATION FOR THE ENTERPRISE FUND, IN THE AMOUNT OF $330,000 FOR ORANGE BOWL STADIUM, AND I3Y INCREASING ENTERPRISE FUND REVENUE IN THE SAME AMOUNT FROM ADDITIONAL REVENUES EARNED IN FISCAL YEAR 1981-82 FOR THE PURPOSE OF MAKING CERTAIN ORANGE BOWL STADIUM IMPROVEMENTS, PAYING FOR INCREASES IN ELECTRICITY USAGE AND RATES, AND INCREASING FUNDING FOR EVENT STAFFING; CONTAINING A REPEALER PROVISION; AND A SEVERAI3ILITY CLAUSE. WHEREAS, the City Commission adopted Ordinance No. 9321 on September 24, 1981, establishing revenues and appropriations for the City of Miami, Florida, for the fiscal year ending September 29, 1982; and WHEREAS, additional maintenance and improvements to the Orange Bowl Stadium are necessary costing $1.50,000 in the Intergovernmental Services -Property Maintenance account and costing $40,000 in capital outlay accounts; and WHEREAS, the cost of electricity at the Orange Bowl Stadium is projected to be $64,000 over the amount budgeted for Fiscal Year 1981.-82 due to increased events and = to increases in rates; and WHEREAS, an additional. $76,000 will be required to pay for personnel, primarily police, to staff Orange Bowl Stadium events in the remainder of Fiscal Year 1981-82; and WHEREAS, Orange Bowl Stadium revenues through the end of Fiscal Year 1981-82 are projected to exceed Orange Bowl Stadium adopted revenues by over $367,000 due to a large increase in concession revenue, to increased rental revenues from University of Miami football games, to additional rental revenue from concerts, and to the NFL playoff game; and WHEREAS, funds in the amount of $330,000 from these additional revenues generated by the Orange Bowl. Stadium during Fiscal Year 1981-82 are available and ran be allocated for the aforementioned purpose; `I� NOW THEREFORE, BE IT ORDAINED BY TIME COMMISSION OF THE CITY OF MIAMI, FLORIDA- Section 1. Sections 1 and 5 of Ordinance No. 9321, adopted September 24, 1981, the annual appropriations ordinance for the fiscal year: ending September 30, 1982,.as amended, is hereby further amended in the following particulars- 1/ "Section 1.. The herein appropriation of $330,000 for the Orange Bowl Stadium is for the purpose of making certain Orange Bowl Stadium improvements, of paying for increases in electrical usage and rates, and of increasing funding for event staffing.'' The revenue needed to accomplish the aforementioned is derived from additional revenues earned by the Orange Bowl Stadium in Fiscal Year 1981-82 in excess of adopted revenues. Section 3. All ordinances or parts of ordinances insofar as they are inconsistent or in conflict with the provisions of this ordinance are hereby repealed. 1/ Words and/or figures stricken through shall be deleted. If any section, part of section, paragraph, clause, phrase, or _ word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. Section 5. This ordinance is hereby declared to be an emergency measure on t the grounds of urgent public need for the preservation of peace, health, safety, and property of the City of Miami, and upon the further grounds of the necessity to make the required and necessary payments to its employees and officers, payment of its contracts, payment of interest and principal on its debts, necessary and required purchases of goods and supplies, and to generally carry on the functions = and duties of its municipal affairs. Section G. The requirement of reading this ordinance on two separate days is hereby dispensed with by a vote of not less than four -fifths of the members of the commission. Gary July 7, 1982 City Manager Cesar Odio Assistant City Manager',!,' Ordinance to Amend Annual Appropriations Ordinance for Orange Bowl Stadium Copy of Draft Legislation The Office of Stadiums recommends the adoption of an ordinance to amend the Annual Appropriations Ordinance for the purpose of appropriating $330,000 in Orange Bowl Stadium revenues earned in excess of the current fiscal year's adopted revenue. This appropriation is for the purpose of making certain Orange Bowl Stadium improvements ($190,000); paying for increased electricity usage and rates ($64,000); and for increasing funding for event staffing ($7G,000) . In the Annual Appropriations Ordinance for Fiscal. Year 1981-82 the Orange Bowl Stadium had a balanced budget of $1,460,300. Revenues for this fiscal year are = projected to exceed this balanced budget figure by $367,000 due in part to a projected increase of $233,000 in concession revenue, to an increase of $41,000 in rental revenue from University of Miami football. games, $56,000 in stadium rental and parking for the NFL Playoff Game, and $44,000 from concerts. The Office of Stadiums recommends appropriation of: $330,000 of the above mentioned increased revenues to be used for the following purposes. Increases in electricity usage as well as in rates are estimated to result in a $64,000 increase over the amount budgeted. Much of the increased usage is attributable to increased events and the related electricity used in the concessions operation necessary to service those events. An additional $76,000 will be needed in the event .payroll account primarily for increased police costs for the upcoming football season. Property Maintenance Division will require an additional $150,000 over the amount in � the adopted Orange Bowl budget. Extensive stadium painting has been done and - improvements -to the Press Box and the concession areas are in process.
