(9 4 6 2 AN EMERGENCY ORDINANCE AMENDING SECTION 1, OF ORDINANCE NO. 9353, ADOPTED NOVEMBER 19, 1981 THE CAPITAL IMPROVEMENT APPROPRIATIONS ORDINANCE FOR FISCAL YEAR ENDING SEPTEMBER 30, 1982, AS AMENDED, BY INCREASING THE APPROPRIATIONS IN THE ENTERPRISE FUNDS, ORANGE BOWL STADIUM TWO PERCENT (2%) RESORT TAX BY AN AMOUNT OF $173,250 TO MAKE IMPROVEMENTS TO THE FIELD LIGHTING SYSTEM AT THE ORANGE BOWL STADIUM PRIOR TO THE 1982 FOOTBALL SEASON; AND FOR THE PURPOSE OF MAKING APPRAISALS OF STADIUM PROPERTIES AND TO UPDATE A REPORT ON ORANGE BOWL MODERNIZATION: CONTAINING A REPEALER PROVISION AND A SEVERA- BILITY CLAUSE; AND DISPENSING WITH THE REQUIRE- MENT OF READING THE SAME ON TWO SEPARATE DAYS BY A VOTE OF NOT LESS THAN FOUR -FIFTHS OF THE COMMISSION. WHEREAS, the City Commission adopted Ordinance No. 9353 on November 19, 1981, establishing resources and appropriations for the ir,iplementa- ti on of Capital Improvements in the City of Miami, Florida for the fiscal year ending September 30, 1982; and WHEREAS, the City's Department of Public Works has recommended the renovation and improvement of the field lighting system at the Orange Bowl Stadium; and WHEREAS, the Department of Public Works has determined that the existing thirty-six pole light fixtures cannot be replaced and that new lighting fixtures may be installed on existing light towers for $154,000; and WHEREAS, $19,250 is needed for an appraisal of stadium related proper- ties and to update a report on Orange Bowl modernization; and WHEREAS, Resolution 82-628 , authorized the advancement of $173,250 from the Florida Power and Light Franchise Revenues to the Orange Bowl Enter- prise Fund; and WHEREAS, $173,250 is available for, the aforementioned purposes as a loan from the Capital Improvement Fund, fiscal year 1982 Florida Power and Light Franchise Earnings; and WHEREAS, funds in the amount of $173,250 will be available from Anticipated Resort Tax Revenues upon receipt of said revenues from the Dade County Tourist Development Council for the repayment of funds to the Capital Improvement Fund, fiscal year 1982 Florida Power and Light Franchise Earnings; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: s Section 1. tion 1 of Ordinance No 9353 a' ted November 19, 1981, is hereby further amended in the following particulars: 1/ "Section 1, The following appropriations hereby made by fund and project title include previously — authorized projects and fund appropriations for implementation of all municipal capital improve- ments of the City of Mi am 3 Florida. The herein loan of $173, 250 from the Capital Improvement Fund, fiscal year 1982 Florida Power and Light Franchise Earnings to the Orange Bowl Stadium Enterorise Fund, is made for the purpose of providing funding for improvements to the field lighting system at the Orange Bowl, the appraisal of stadium related properties and to update a report on Orange Bowl moderniz- ation. Section 3. Repayment of the aforementioned loan from fiscal year 1982 — Florida Power and Light Franchise Earnings to the Orange Bowl Enterprise Fund, including interest computed at the average prevailing rate for the loan period, will be made to the fiscal year 1982 Florida Power and Light Franchise Earnings in the Capital Improvement Fund upon receipt of Anticipated Resort Tax Revenues from the Dade County Tourist Development Council. 1/ Words and/or figures stricken through shall be deleted. If any section, part of section, paragraph, clause, phrase or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. Section 6. This ordinance is hereby declared to be an emergency measure on the grounds of u rgent pub] is need for preservation of peace, health, safety and property of the City of Miami, and upon the further ground of the necessity to make the required and necessary payments to its employees and officers, payment of its contracts, payment of interest and principal on tis debts, necessary and required purchases of goods and supplies, and to generally carry on the functions and duties of its municipal affairs. Section 7. The requirement of reading this ordinance on two separate days is hreby dispensed with by a vote of not less than four -fifths of the members of this Commission. S*Ia�cr-ement irector Department oand Budget s recommended that the City Commission amend — the Capital Improvement Fund Ordinance 9353 by increasing same by $173,250. $154,000 will be used to improve the field lighting system at the Orange Bowl prior to the 1982 football = - season; $14,750 will be used for an appraisal of stadium related properties and $4,500 to update a report on Orange Bowl modernization. A loan in a like amount is available from the 1982 Florida Power and Light Franchise Earnings in the Capital Improvement Fund to be repaid by the 2% Resort Tax. The Department of Public Works notified the Office of Stadiums that the 36 pole light fixtures on the upper deck of the Orange Bowl are deterio- rated. There are no comparable replacement fixtures available at this time and all of the lighting manufacturers in the area recommend that the existing lights be replaced with quick -start metal halide lights on the main light towers. The benefits of this new lighting program are as follows: 1) the elimination of the problem of trying to replace antiquated light fixtures; 2) the inaccurate trial and error process of aiming the pole lights would be eliminated; 3) stadium hurricane preparation time would be reduced; and 4) electricity costs would be reduced by some $15, 000 due to the higher efficiency of these new lighting fixtures. In addition, a resolution, No. 82-346 was passed by the City Commission authorizing the City Manager to have an appraisal made of stadium re- lated properties (at a cost of $14,750 ) • The Dade County Tourist Develop- ment Council also requested that an update be made to the City of Miami Orange Bowl Modernization Report at a cost of $4,500. Total cost for both projects is $19,250. The attached proposed ordinance provides the funding to accomplish the aforementioned projects and is prepared for the July22, 1982 Commission meeting . 9462
