PLANNING DEPARTMENT RECOMMENDATIONS
PROPOSED NEW COMPREHENSIVE ZONING ORDINANCE
PUBLIC HEARINGS OF DECEMBER 1 and 15, 1981
RECOMMENDATIONS:
1. DURING THE TIME BETWEEN PASSAGE OF THE NEW ORDINANCE
AND THE EFFECTIVE DATE, THE PLANNING DEPARTMENT WILL
STUDY THE AREA AND MAKE A RECOMMENDATION TO EFFECTUATE
A CONSISTENT CR ZONING ALONG NW 7TH STREET AND LEJEUNE
ROAD.
2. CHANGE RC AREA ON SW 13TH STREET, BETWEEN THE RAPID
TRANSIT RIGHT-OF-WAY AND SW 3RD AVENUE FROM R-C TO
RO-3/7.
3. CHANGE 4 PARCELS ZONED R-3 AT SW 24TH TBRRACE/31ST
AVENUE TO RG-2.1/3.3.
4. CHANGE THE CR-1 DISTRICT TO ALLOW HOTELS AND MOTELS AS
A PERMITTED USE.
5. ADOPT A NEW SPI-10 OVERLAY DISTRICT TO PROVIDE SITE
PLAN REVIEW, AND SPECIAL YARD AND HEIGHT ENVELOPE
REQUIREMENTS AND APPLY IT TO THE MERCY HOSPITAL AREA
0-1 ZONING DISTRICT.
6. DURING THE TIME BETWEEN PASSAGE OF THE NEW ORDINANCE
AND THE EFFECTIVE DATE, THE PLANNING DEPARTMENT WILL
STUDY THE AREA ON THE NORTH SIDE OF S. DIXIE HIGHWAY
BETWEEN BIRD ROAD AND SW 32ND AVENUE.
7. CHANGE THE PROPOSED RS-2 TO RG-1 IN THE SW 19TH ROAD
AREA TO COINCIDE WITH THE PRESENT ZONING PATTERN.
8. DURING THE TIME BETWEEN PASSAGE OF THE NEW ZONING
ORDINANCE AND ITS EFFECTIVE DATE, A SPECIAL PUBLIC
INTEREST DISTRICT SHOULD BE DEVELOPED FOR THE LATIN
QUARTER AREA.
9. CHANGE THE PROPOSED ZONING ON THE NORTH SIDE OF NW
7TH STREET BETWEEN 43RD AND 45TH AVENUE FROM CR-2
TO CR-3/7.
10. CHANGE THE PROPOSED ZONING ON THE SOUTH SIDE OF NW STH
STREET BETWEEN 4TH AI4D STH AVENUES FROM RG-/6 TO CR-2/7.

Re: Proposed New Zoning Ordinance
Zoning Reclassification of 4200 Block of N.W. 7th Street
Dear Mr. Commissioner:
This firm has been retained by Raul DeCardenas and Benigno Villar,
who are the owners of property at 4238 and 4250 N.W. 7th Street, legally
described as:
Lots 4 and 5, Block 1, GOLF COURSE PARK,
Plat Book 43, Page 3, Dade County, Florida.
The owners of Lots 1, 2, 3, and 6, in this Block who are similarly
sit.,,ated with respect to zoning favor our clients' proposal as set forth in
this letter.
Lot 6 presently enjoys a commercial conditional use and Loots 7, 8,
and 9 are now zoned C-4 and proposed as CG 1/7. According to the proposed
City Zoning Ordinance maps, the zoning boundary runs directly dawn the center
of N.W. 7th Street.
The north side of 7th Street directly across from our client's
property is zoned commercial (C-2 and C-4) and under the new ordinance the
property is proposed to continue to be zoned for commercial use (CR and CCU
classifications). The lands immediately to the east (fronting on N.W. 7th
Street and LeJeune Road) are zoned commercial (C-4) and proposed CG-CR class-
ification.
The existing uses of the adjacent lands directly north (across the
street frcm the subject property) and east (adjacent to the subject property)
vary among gasoline service stations, used car businesses, retail shops,
lending institutions, and commercial office buildings.

The lots owned by our clients and others similarly situated on the
south side of N.W. 7th Street are proposed on the maps to be classified for RG
purposes and only perpetuate the existing zoning classification which, in our
opinion, has been rendered obsolete in view of the changes which have occurred
in the surrounding zoning and the neighborhood in general. Please see attached
map.
We suggest and City Planning and Zoning Department concurs that it
is inappropriate in this situation to have conflicting zoning classifications
facing on the same public thoroughfare. It is our opinion that a mere physi-
cal view of the particular area would clearly demonstrate the inappropriate-
ness of the proposed RG zoning for our client's property.
We request that the City Cormu.ssion reclassify the zoning of Lots 1
through 6, inclusive, in Block 1 facing N.W. 7th Street to CC, or CR classifi-
cation under the proposed new ordinance, which is a compatible zoning classifi-
cation consistent with the existing neighborhood.
