M82-389 4k, 5/11./82 G' ORDINANCE NOi 9 4 7 1 AN ORDINANCE AMENDING SECTIONS 5-47, 5-49, 5-50, 5-54, 5-56, 5-574 5-58, 5-59 AND 5-61 OF THE CODE OF T14E CITY OF MIAMI, FLORIDA, AS AMENDED, TO PROVIDE FOR A 5-MEMBER "CITY OF MIAMI PROFESSIONAI, BOXING AND WRESTLING BOARD", I41TH THE. CHAIRMAN THEREOF TO BE APPOINTED BY THE CITY COMMISSION, SAID BOARD TO BE ESTABLISHED UPON THE EFFECTIVE DATE OF THE ADOPTION OF THE HEREIN ORDI- NANCE; PROVIDING THAT THERE BE A SECRETARY -TREASURER' OF SAID BOARD WHO SHALL BE APPOINTED BY A VOTE OF NOT LESS THAN 3 MEMBERS OF SAID BOARD AND WHO SHALL NOT HAVE THE RIGHT TO CAST A VOTE ON QUESTIONS COMING BEFORE THE BOARD FOR ACTION OR DECISION; CONTAINING A REPEALER PROVISION AND A SEVERABILITY CLAUSE. BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: — Section 1. Sections 5-47, 5-49, 5-50, 5-54, 5-56, 5-57, _ 5-58, 5-59 and 5-61 of the Code of the City of Miami, Florida, as amended, are hereby further amended in the following particu- lars: "Sec. 5-47. Boxing and wrestling board. There is hereby established a boxing and wrestling board, to be known as the City of Miami professional boxing and wrestling board," which board shall consist of five"(5) members, eed-exe-}}-seeele�-eest�e; who shall be appointed by the city commission with each city commissioner nominating one (1) member to said board. There shall also be a secretary -treasurer of said board who shall be appointed by a vote of not less than three - (3) members of said board but who shall not have the right to cast a vote on questions coming before the board for action or decision. The city commission shall appoint one (1) of the members to serve as chairman for a one-year term and he shall call and preside over the meetings. -_ and The city commission shall appoint a successor should any member become deceased or resign. The majority of the members of the board shall constitute a quorum to do business. The members of the board shall serve without compensation with the exception of the secretary -treasurer, who shall be compensated =_ in terms of a percentage of the fees collected as recom— mended by the board end-appraved-by subject to the AM approval of the city commission." - "Sec. 5-49. Same --Authority of board to issue; application generally. The City of Miami professional boxing and wrestling _ board may, in-it-s-dleefetlert- issue a license to promote, conduct* "Sec. 5-50, Same --Examination of appli- cation; issuance. Upon the filing of an application for a license required by section 5-48, the City of Miami profes- sio.nal boxing and wrestling; board shall examine or cause* * *in the application. If it shall appear upon examination that the applicant, in the opinion of the City of Miami professional box- ing and wrestling board, is of�, * * *" "Sec. 5-52. Same --Revocation. A promoter's license issued under this article may be revoked at any time by the City of Miami professional boxing and wrestling board for good cause shown." "Sec. 5-54. Licenses and examination fees for fighters, managers, etc. Each fighter, manager, referee, second or announcer shall obtain an annual license issued or caused to be issued by the City Of Miami professional boxing and wrestling board, and pay the fees therefor prescribed in chapter 31.:ti "Sec. 5-56. Plummer, Jr., City Commissioner Dear Mayor and Commissioners: This morning, the Department was informed that the cost of the Downtown Component of Metro Rail Tax District for the three garages we operate, various Lots and Gusman Hall would be $1.40,000 -_ during the first year. While we support the project, we are concerned with legal questions pertaining to our ability to divert revenues from debt service to local taxes. Our bond counsel is currently reviewing the problem. We are further concerned with the ability of Gusman Hall to pay property taxes. It is a great challenge to balance the Olympia Building and Gusman Hall budgets. The Department has been advised by County staff that the possibility of a hardship variance exists. This concern is being read into the record to protect our position should it become necessary to appeal the Dade County Tax Assessor's position regarding the taxability of Gusman Hall.
