A RESOLUTION GRANTING A ONE YEAR EXTENSION OF
A VARIANCE AS LISTED IN ORDINANCE NO. 6871,
ARTICLE X, SECTIONS 3(1) (a), 3(2) (c), 3 (2)
(d), 3 (3) (a), 5 AND 6, AND ARTICLE IV, SECT-
IONS 19 (7) (a), 19 (7) (c), TO PERMIT CON-
STRUCTION OF A MULTI -STORY 553-ROOM HOTEL/
PARKING GARAGE STRUCTURE ON LOTS 5, 8, 9 AND
12; BLOCK 8, MIRAMAR (5-4), BEING APPROXIMATELY
1744-1756 NORTH BAYSHORE DRIVE, AS PER SITE
PLANS STAMPED 8-24-81, ON FILE WITH THE PLAN-
NING AND ZONING BOARDS ADMINISTRATION DEPART-
MENT, WITH THE FOLLOWING VARIANCES:

WHEREAS, Article XXXI of the Comprehensive Zoning
Ordinance No. 6871 permits an extension of a variance by the
City Manager with approval of the City Commission, for a one
year period; and
WHEREAS, the City Manager recommends the extension
of the variance granted by Motion No. 82-68;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF
THE CITY OF MIAMI, FLORIDA:
Section 1. The request for a one year extension of
a variance granted from Ordinance No. 6871, Article X, Sections
3 (1) (a) , 3 (2) (c). 3 (2) (d) , 3 (3) (a) , 5 and 6, and Article
IV, Sections 19 (7) (a), 19 (7) (c), to permit construction
of a multi -story 553-room hotel/parking garage structure on

ARTICLE XXXI of the Comprehensive Zoning Ordinance No. 6871 provides
that any Variance shall expire six months after the effective date of the
Variance unless a Building Permit or a Certificate of Use has been issued
based upon the Variance. The Ordinance further provides that the City
Manager may after review and determination that substantial progress -has
been achieved by the applicant in terms of project planning, extend the
expiration date of the Variance for an additional period of time not to
exceed one year, subject to approvalof the City Commission.
The Planning Department finds no objection to the granting of the extension
of time for this Variance.
We are requesting the City Attorney's Office, by copy of this memo, to prepare
the proper Resolution for this extension.

The department recommended denial of the ten or
more variances requested for the subject property
both at the Zoning Board and the appeal before
the City Commission. Our recommendation noted
that the request was tantamount to a change of
zoning and as such was not in accord with the
City's comprehensive plan; and that the project was
so over zealous in scope that the intended
intensity exceeded the intensity of the existing
Omni complex.
Other than the originally stated concerns the
department has no objection to the granting of
the extension for a six month period.

Dear Mr. Gary:
On January 28, 1982 the Miand City Com.nission upheld the decision r„ade
by the Zoning Board which granted variances by a vote of six to zero to
permit construction of a 553 room hotel/parking garage structure at
approximately 1744-56 North Bayshore Drive. This specific motion was
24-82-63, moved by Mr. Dawkins, seconded by Mayor Ferre, and approved by
a majority vote.
Under Ordinance 8198, article 31, section 3, paragraph 2, a request for
extension of variances must be made to the City Manager. I am, by this
transmittal, requesting that an extension be granted. Due to the
como?exities of the structure and the capital outlay necessary for
building, the preliminary work has been extensive. More time will be
necessary for the preparation of sufficient drawings for permitting by
the C'_t: of .`•,iami. It is understood that your granting our application
for an extension, not to exceed one year, is subject to the approval of
the City Corr"iission. P;e hereby respectfully request this approval.
Please ad -vise as to any further information you may require to assist uo
