AT A COST OF $108,838.00; FOR THE CITY OF MIAMI/UNIVERSITY OF MIAMI JAMES L. KNIGHT INTERNATIONAL CENTER; AT A TOTAL COST OF $340,054.88; ALLO- CATING FUNDS THEREFOR FROM THE CONVENTION CENTER BOND FUND; AUTHORIZING THE CITY MANAGER AND THE PURCHASING AGENT TO ISSUE THE PURCHASE ORDER FOR THIS EQUIPMENT. W[UNZEAS, The City of Miami/University of Miami James L. Knight Inter- national Center is Scheduled to open in September, 1982; and WHEREAS, specifications for the operating equipment were not available until July 28, 1982; and WHEREAS, manufacturer's delivery times would not permit compliance with the formal sealed bid procedure; and WHEREAS, bids were received from 15 bidders; and WHEREAS, the recommended purchases are from the lowest bids meeting the specifications; and W[TRF.AS, funds for this purchase are available in the Convention Bond Fund; and WHEREAS, this emergency purchase is necessary in order to timely provide operating equipment for various conventions, seminars, and meetings; and WHEREAS, the City Manager recommends this emergency purchase; NOW, THEREFORE, BE IT RESOLVED BY THE OYIHISSION OF THE CITY OF M.IAMI, FLORIDA: Section 1. The requirement for formal sealed bids for furnishing Operating equipment to the City of Miami/University of Miami James L. Knight International Center is hereby waived and the emergency purchase of 1,100 Folding Chairs, 717 Tables, 43 Dollie Trucks , and 22 Truck Pallets from Krueger Manufacturing Co. at a cost of $106,260.80; 1,600 Stacking Chairs and 6 Dollies from Southeast Office Interiors at a cost of $108,946.00; 108 Tables from Thomas Ruff & Co. at a cost of $8,360.00; 6 Turnstiles from Perey Manufacturing Co. at a cost of $7,650.00; 500 items of Portable Staging from Sico, Inc. at a cost of $108,838.08, at a total cost of $340,054.88 is hereby approved with funds therefor hereby allocated from the Convention Center Bond Fund. Section 2. The City Manager is hereby authorized to instruct the Purchasing Agent to issue the Purchase Order for this equipment. Mullins ENCLOSURES Resolution, Tabulation t rchasing Agent It is recommended that a resolution be passed waiving the requirement for formal sealed bids and authorizing the emergency purchase of -operating -equipment for the Convention Center at a total cost of $340,054,88_ The Executive Director, City of Miami/University of Miami/James L. Knight International Center has requested the purchase of priority items of operating equipment for the Center. Specifications for the equipment were prepared by Event and Facility Consultants for FMG, Inc; managers of the Center. The specifications were received by FMG, Inc. on July 26th. Manufacturer's delivery times would not permit compliance with the formal bid process. On July 29th the City Commission, by Resolution No. 82-743, authorized the City Manager to expend funds from the Center Revenue Bond Proceeds for the purchase of operating equipment. The City Commission stipulated that at least 3 bids must be obtained for each item, and that the Commission must approve the recommended purchases. The Purchasing Division solicited written quotes for the equipment from 22 potential suppliers and 15 bids were received as per the attached tabulations. Funds for this purchase are available in the Convention Center Bond Fund. The Executive Director of the Center concurs with this recommendation. FLORIDA INTER-CFFICE MEMORANDUM -� August 25, 1982 ; Convention Center Art P Frr.r,'.VE_ ENZLCS U F?E:= FILE On May 11, 1982 the City Commission passed Motion 82-359 which states the City's intention to proceed with the Miro sculpture for the Convention Center. Paragraph 4 of that motion states that the City Manager was to come back before the Commission at the next scheduled meeting with his recommendations as to potential sources of funding. On May 17, 1982 the City Manager addressed this problem to the City Commission and stated that funding was not available, and in that memorandum recommended that our priorities be to provide adequate funding to complete the job and the question of art be saved for a later date. It was assumed by the City Manager that the May 17, 1982 memorandum postponed any further action at this time. We have prepared for September 9, 1982 a package for the necessary funding to complete the Convention Center. Included in this package is a list of items which are presently not funded. Should the City Commission desire, our recommendations can be amended to include art for the Convention Center. You may remember the Commission instructed you to conclude an inmediate contract with Miro for a major sculpture at the Convention/Conference Center. ' It is good public business to emphasize major art in growing cities in America. New fork and Chicago have done it. Mayor Maynard Jackson did it in Atlanta. Mayor Kevin hbite has done it in Boston and Mayor Tom Bradley in Los Angeles. It is now Miami's turn. The City of Ntiami's Art in Public Places Committee has selected what will be the most important piece of sculpture by Miro in the U.S. It is a bargain price for what we are getting, but three months have now gone by and, to my knowledge, no one has contacted Miro. fie is, at the present time, 91 years old and it would be a major loss to Miami if the artist were to pass away without our having concluded our transaction. Gary /7 City Manager r Ma 17, 1922 Convention Center Art In 1973, Dade County adopted an Art in Public Places ordinance which required Dade County and the municipalities in Davie County to include an amount of not less than 1 1/2% of the total appropriation set aside for the construction to be used for the acquisition of works of art. In January of 1974, the City Commission passed on second readinc a similar ordinance. Section 1. of this ordinance set forth the same appropriation requirement; Section 2. gave the City Commis- sion the authority to waive this require-ment should the City Com- mission decide that the particular project was not appropriate or required art work; Section 4. placed the responsibility for the commissioning of, artist, the reviewing of design and the acceptance of works of art on the City Manager; Section 5. set forth the requirements of an advisory co-mmittee to act as an advisor to the Manager. Although the Ordinance itself established guidelines for the bud- get, it does not establish a time frame in which the art work must be acquired. Whether by design or accident the allocation of funds as set forth in the Official Statement did not specifically provide an allowance for art work. Unfortunately, this project has gone beyond the original estimate by many millions of dollars. Counting the last authorized increase, this totals no%•., close to $14 million dollars. It has been the Commission's stated goal that the top priority is to get the project completed and open for business. Considering the Garage and VVIorld Trade Center as a separate project, the public portion of the Convention Center Project is around $65 million dollars. 1 1/2'� of this amount is close to a million dollars. At the present time these funds are not provided. It was stated at the Commission Meeting that tho Committee's rec- o7unendation was to_acquire a sculpture by Joan Miro and that the estimated cost for the sculpture was approximately $500,000 and that part of the urgency was the age of the sculptcr. SZ-847 Mayor and Members of The City Com-nission -2- May 17, 1982 I am certainly not suggesting at this time that we increase the budget to the requirements of the Ordinance. I am also not sug- gesting that the project be without a major worn of art. I am suggesting that our priorities now be directed toward making sure that we have adequate funding to complete the job and that we take up the problem of the art work later. ►82-947 a Mr. Carollo: There is a motion, is s ere a sec:-r.d? Mr. Plum-ier: I can agree with points (1) and (4), I cannot agree with (2), (3) and (5), I think it is putting the cart before the horse, I think that the most irm_ortant is (4) and that is that we establish the facts. The facts are what is the budget and (2) where is the money coning from. Once that is established and determined then we can go from there but until that time I am not prepared to vote favorably. While in the past on many occasions I have sided with parts of the feelings that a two of my colleagues have presented here today, at the same time I feel that we have to be just in the way we deal not only with art but in every other decision that this Commission makes. I am going to go along with the motion at this point in time, however, I would certainly reserve my vote at any time in the immediate future if I see that things are not done in a proper fashion and I would certainly hope that we could begin to function in this manner in a way that would be pleasing to all my colleagues on the Co=d ssion and that would be sort of pride for this connunity to choose art that is going to make us feel proud of having it. I vote yes.
