A RESOLUTION WAIVING BY AT LEAST A FOUR -
FIFTHS VOTE, THE REQUIREMENTS OF CHAPTER
2, ARTICLE V, SECTION 2-302 (CONFLICT OF
INTEREST) OF THE CODE OF THE CITY OF
MIAMI, FLORIDA, AS AMENDED, BY FINDING
THAT IT IS IN THE BEST INTEREST OF THE
CITY TO PERMIT CALVIN SMITH, AN EMPLOYEE
OF THE SOLID WASTE DEPARTMENT, TO PARTI-
CIPATE IN THE CITY'S HOUSING REHABILITA-
TION PROGRAM ADMINISTERED BY THE COMMU-
NITY DEVELOPMENT DEPARTMENT.
WHEREAS, the City of Miami, through the Community
Development Block Grant Program of the United States Depart-
ment of Housing and Urban Development, has embarked upon a
home renovation and rehabilitation program for its resi-
dents; and
WHEREAS, the Community Development Department's Housing
Division administers this program; and -
WHEREAS, CALVIN SMITH a City of Miami Parks and Recrea-
tion Department employee, who resides within the City, has
applied for rehabilitation assistance under this program;
and
WHEREAS, said employee qualifies in all respects for
participation in said program, except that he is employed by
the City of Miami and would be in technical violation of
Chapter 2, Article V, Section 2-302 of the City's Conflict
of Interest Law; and
WHEREAS, a waiver must be obtained for CALVIN SMITH's
participation in said program; and
WHEREAS, the City can only avail itself of the oppor-
tunity to participate in a valid housing redevelopment pro-
gram through offering the program to all residents of the
City, notwithstanding their employment by the City of Miami;
and
WHEREAS, other City employees who have applied for and
qualified for participation in this program have been given
a waiver of the Conflict of Interest provisions;

NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF MIAMI,
FLORIDA:
Section 1. By a vote of no less than four -fifths
(4/5) of
this Commission,
the
requirements
of Chapter 2,
Article V,
Section 2-302 of
the
Code of the
City of Miami,
Florida, as amended, with respect to the transaction of
CALVIN SMITH (an employee of the Solid Waste Department)
with the City's rehabilitation program, administered by the
Community Development Department, is hereby waived, with
respect to any possible conflict of interest.
Section 2. The participation by CALVIN SMITH in the
City's Housing Rehabilitation Program is in the best in-
terest of the City.
