HomeMy WebLinkAboutR-82-0803RESOLUTION NO. 8 `2e - tk7 3 A RESOLUTION DECLARING AND CERTIFYING THE RESULTS OF THE SPECIAL MUNICIPAL ELECTION HELD ON SEPTEMBER 7, 1982 FOR THE PURPOSE OF VOTING FOR THE APPROVAL OR DISAPPROVAL OF IMPLEMENTATON BY THE CITY COMMISSION OF RESOLUTION NO. 82-593, ADOPTED JUNE 24, 1982, BY ADOPTION OF ORDINANCES THAT WOULD MAKE IT UNLAWFUL FOR ANY PERSON OR CORPORATION USING OR MAKING USE OF THE CABLE COMMUNICATIONS SYSTEM TO BROADCAST, EXHIBIT, DISPLAY, OR SHOW WITHIN THE CITY OF MIAMI ANY MATERIAL THAT IS OBSCENE OR INDECENT AND WHICH ORDINANCES WOULD DEFINE THE TERMS "OBSCENE MATERIAL" AND "INDECENT MATERIAL"; SAID ELECTION RESUL- TING IN THE APPROVAL OF THE AFORESAID IMPLEMENTATION. WHEREAS, a special municipal election was duly held in the City of Miami, Florida, on September 7, 1982; and WHEREAS, said election was duly conducted in accordance with the provisions of the "Electronic Voting Systems Act" (§1101.5601 through §1101.5615, F.S.); and WHEREAS, the official returns of each of 86 election precincts in the herein election of September 7, 1982 have been duly certified by RALPH G. ONGIE, City Clerk, Supervi- sor of Elections for the City of Miami, Florida, upon due certification by the Supervisor of Elections for Metropoli- tan Dade County, Florida, and those official returns have been delivered to and duly canvassed by the City Commission; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The results of the special municipal. elec- tion held on September 7, 1982 in the City of Miami, Florida, on the question of whether ordinances are to be adopted making it unlawful for any person on corporation to use the cable communications system to broadcast, exhibit, display, or show within the City of Miami any material that is obscene or indecent, which was duly submitted to the electorate in the following form: CITY COMMISSION MEETING OF SEP 9 i982 HIMUM NO...�.::t " 8 0 il "Shall Resolution No. 82-593, adopted June 24, 1982, entitled 'A Resolution setting forth the intent of the City Commission to adopt ordinances that would make it unlawful for any person or corpo— ration using or making use of thtz cable communications system to broad!.3ot, exhibit, display, or show within the City of Miami any material that is ohQcene or indecent and further defining the terms "Obscene Material" and "Indecent Mate— rial".' be implemented?" are as follows: There were 14,638 votes cast for implementation of said Resolution and 13.637 votes cast against implementation of said Resolution, and the City Commission hereby declares and certific- that the implemen— tation of said Resolution was approved h,,- the electorate; further, the City Commission hereby declares the total number of votes cast upon the question of implementation of said Resolution, including absentee ballots, it said election in the 86 voting precincts was 28,275. Section 2. The City Commission alp,, hereby finds, declares and certifies: (a) said special municipal election was duly held and notice thereof was given in ak-ordance with law; (b) all steps in connection with and leadink; up to said special. election were duly, regularly and lawfully taken and had; and (c) all applicable provisions of the Constitution and statutes of the State of Florida, the Dade County Election Code and the City Code have been duly complied with.
