CORPORATION AT A TOTAL COST OF $176,156; ASSESSING $1,200 AS LIQUI- DATED DAMAGES FOR 15 DAYS OVERRUN OF CONTRACT TIME; FURTHER AUTHORIZING A FINAL PAYMENT OF $13,523.92 FOR CENTRAL DRAINAGE PROJECT E-49; AND RESCINDING RESOLUTION NO. 82-406 ADOPTED MAY 11, 1982 WHICH HAD INCLUDED AUTHORIZATION TO ACCEPT THE COMPLETED WORK PERFORMED BY P.N.M. CORPORATION ON CENTRAL DRAINAGE PROJECT E-49 BUT FAILED TO ACCURATELY DESIGNATE THE DEDUCTION FOR LIQUIDATED DAMAGES. WHEREAS, there exists a contract dated December 10, 1980 between the City of Miami and P.N.N. Corporation; and WHEREAS, the work has been satisfactorily completed, and P.N.M. Corporation has furnished the required documents certifying that all bills for labor and materials have been paid in full in connection with the aforesaid contract; and WHEREAS, liquidated damages for 15 days overrun of con- tract time should be deducted from the final payment due the contractor; and WHEREAS, the City Manager and the Department of Public Works recommend that the completed work be accepted and final payment made to the contractor; and WHEREAS, on May 11, 1982 the City Commission adopted Resolution No. 82-406, which accepted the completed work by the P.N.M. Corporation at a total cost of $176,1.56, assessed $1,200 as liquidated damages for 15 days overrun of contract date, and authorized a final payment to P.N.M. Corporation in the amount of $14,723.92 for CENTRAL DRAINAGE PROJECT E-49; and WHEREAS, because of an error, the amount of final payment authorized to the contractor did not reflect the assessment of liquidated damages; and WHEREAS, the herein resolution will authorize correct pay- ment to P.N.M. corporation NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: CITY COMMISSION MEETING OE S E P 9 1982 RESOLUTION NM. 8 2.....ry.w�;�„ REWRK8:..."ROD"" Eel t t Section 1. The completed work performed by P.N.M. Corporation for CENTRAL DRAINAGE PROJECT E-49 is hereby approved. Section 2. Liquidated damages in the amount of $1,200 for 15 days overrun of contract time shall be deducted from the balance due the contractor. Section 3. The proper officials of the City of Miami are hereby authorized to pay P.N.M. Corporation, after all adjustments are made, a balance of $13,523.92 as full and final payment for all work performed and all materials furn- ished in connection with CENTRAL DRAINAGE PROJECT E-49. Section 4. Resolution No. 82-406, adopted May 11, 1982, which authorized acceptance of the completed work performed by the P.N.M. Corporation on CENTRAL DRAINAGE PROJECT E-49, but failed to accurately designate the deduction for liqui- dated damages, is hereby rescinded. PASSED AND ADOPTED this 9 ATTEST: 'e' r4� Q � RALP G . Cather, Director Department of Public Works August 18, 1982 B-5472 CENTRAL DRAINAGE PROJECT E-49 Resolution assessing liquidated damages and authorizing final payment (For Commission Meeting of Sept. 9, 1982) _ The Department of Public Works recommends the adoption of a resolution accepting the completed work performed by P.N.M. Corporation, at a total cost of $176,156.00; assessing $1,200.00 as liquidated damages for overrun of contract time; and author- izing a final payment of $13,523.92 for CENTRAL DRAINAGE PROJECT E-49. P.N.M. Corporation has completed the project consisting of constructing 16 drainage structures at locations of greatest need in an area bounded by N. 36 Street to S. 8 Street between Biscayne Bay and W. 27 Avenue, with three locations outside this area. This project was a typical drainage project. Even though the contractor has been granted delays for rain, utility conflicts, and an extra drainage location, he was unable to complete the project within the adjusted contract time. This was a unit price contract in the amount of $185,501.00, but the completed contract amount is $176,156.00, less $1,200.00 as liquidated damages for 15 days overrun of contract. It is now in order for the Commission to accept the completed work and authorize final payment, after all conditions are met.
