A RESOLUTION GRANTING REQUEST OF
MIAMI HERALD PUBLISHING COMPANY FOR
MODIFICATION AND CLARIFICATION OF
CERTAIN CONDITIONS PRESCRIBED IN
RESOLUTION NO. 82-460 AND RESOLUTION
NO. 82-461 GOVERNING CONSTRUCTION OF
A SIXTH FLOOR ADDITION TO EXISTING
BUILDING AT ONE HERALD PLAZA.
WHEREAS, the City Commission on May 27, 1982, adopted
. Resolution No. 82-460 granting variances to permit the
construction of a sixth floor addition to the existing Miami
Herald building, subject to the conditions prescribed therein;
and
WHEREAS, the City Commission on May 27, 1982, adopted
Resolution No. 82-461 granting modification of the requirements
of Section 3(4)(b) of the City Charter to permit construction
of a sixth floor addition to the existing Miami Herald building,
subject to the same conditions prescribed in Resolution
No. 82-460; and
WHEREAS, the Miami Herald requests modification and
clarification of certain of the conditionsl prescribedin
Resolution No. 82-460 and Resolution No. 82-461, and the City
Commission has considered such request at a public hearing.
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The following condition contained in
Resolution No. 82-460 and Resolution No. 82-461:
Subject to the Miami Herald providing:
. . a minimum expenditure of $300,000
for landscaping and beautification.
is hereby amended, modified and clarified to read as follows:
The landscaping and beautification of
the subject property at One Herald Plaza CITY COMMISSION
shall be accomplished in accordance with
the detailed plan submitted by the Miami MEETING OF
Herald and made a part hereof by reference,
in an amount not less than $300,000.00. SEP9 1982

Section 2. The following condition contained in
Resolution No. 82-460 and Resolution No. 82-461:
Subject to the Miami herald . . .
paying 50% of costs for constructing a
public connecting walkway between the
Herald Building baywalk and Bicentennial
Park, said connector to be designed within
six months of May 27, 1.982, and constructed
within one year of Play 27, 1982; lighting,
maintenance and security, including tele-
vision monitors for the public connector
(should T.V. be utilized on the Herald
Building Baywalk Section) for the -public
connector.

construction of a sixth floor addition

shall pay to the City the sum of $100,O00
to be applied toward the cost of construc-
ting a public connecting walkway between the
Miami herald haywalk and Bicentennial Turk;
television monitors for
the public connecting walkway (should T.V.
be utilized on the Herald Building Bavwalk
Section) shall be the responsibility of the
Herald. If construction of the connector is
not commenced by the City within three years
from the date hereof, such cash contribution
and any accrued interest shall be utilized by
the City for creating or improving pedestrian
access, park or recreational facilities in
the general area.
Section 3. Resolution No. 82-460 and Resolution No. 82-461,
as amended, modified and clarified by this resolution, are
ratified and confirmed, and shall constitute the conditions
under which construction of the sixth floor addition to the
existing ..iami I:erald Building is permitted.

Miami herald Deviation from
Waterfront Charter Amendment
It is recommended that the Commission
accept the modifications to Resolutions
82-460 and 82-461; May 27, 1982, as
proffered by the Miami Herald and as
further modified by recommendation of
the Planning Department, per the
attached resolution.
On Play 27, 1982, the City Commission adopted Resolutions
82-460 and 82-461 by which the Miami Herald was granted
variances from the Comprehensive 7oninq Ordinance and
deviations from the [waterfront Charter Amendment for the
purpose of allowing an addition to the existing herald
building. Both resolutions contained identical sets of
conditions for the applicant to fulfill.
At the July 27th, 1982, Commission meetinq, on planning
and zoning items, Mr. Darrey A. Davis, attorney for the
applicant requested two modifications to the conditions
in the resolution. The Commission deferred consideration
of the item until September 9, 1982.
The Planning Department has reviewed the modifications re-
quested in Mr. Davis' letter of August 21, 1982, and
consulted the Department of Public Works. Both Departments
agree generally with the request provided however that the
following additional modifications are included in Section 2
of the resolution:

When a building permit is issued for

The language above, as modified, has been included in the
resolution.
It should be noted that the design of the pedestrian walkway
may be later modified by handicapped ramps.
The Planning Department recommends the attached resolution;
it is requested that this item be scheduled for September 9,
1982.

Dear Mr. Gary:
The City Commission, at the July 29th zoning meeting,
deferred action on the Miami Herald matter listed on the
agenda as item number 18, and directed that this matter be
placed on the agenda for the regular Commission meeting on
September 9, 1982.
Accordingly, it is respectfully requested that you cause
this deferred matter to be included on the agenda for the
regular City Commission meeting on Thursday, September 9, 1982.
Since this involves a zoning matter, the following infor-
mation is submitted.
The Miami Herald requested zoning variances and charter
_ modification to permit construction of a sixth floor addition
to the existing five -story building. On May 27, 1982, the
City Commission adopted Resolution No. 82-460 granting the
requested variances, and adopted Resolution No. 82-461
granting the requested modification of Section 3(4)(b) of the
City Charter, to permit the sixth floor construction, subject
to the identical conditions prescribed in the two resolutions.
For your convenience, copies of these resolutions are enclosed.
The Miami Herald requested the City Commission to modify
and clarify two of the conditions prescribed in the resolutions,
as follows:

First Requested Modification
Present Condition
Subject to the Miami Herald providing:

in areas of greatest need within the City.

Such proposed resolution was submitted on July 29th to
the City Attorney's office for review and approval as to form
and correctness. A copy of this letter and enclosures is
submitted to the City Attorney's office.
It is respectfully suggested that this matter may be
appropriately reflected on the agenda for the September 9,
1982 City Commission meeting as follows:
Miami Herald request for modification
and clarification of certain conditions
prescribed in Resolutions D.os. 82-460
and 32-461.
