AN ORDINANCE AMENDING SECTION 3I-48 OF THE CODE
OF THE CITY OF MIAMI, FLORIDA, AS AMENDED, BY
CI4ANGING CERTAIN 'TAXES CHARGED FOR OCCUPATIONAL
LICENSES WHICH ARE LEVIED AT A GRADUATI.D OR PER
UNIT RATE; FURTHER PROVIDING FOR THE TAXING OF
BOXING AND WRESTLING MATCH PROMOTERS WHETHER
OR NOT REGULATED BY THE CITY CODE; CONTAINING A
REPEALER PROVISION, A SEVERABILITY CLAUSE AND
AN EFFECTIVE DATE.
WHI, REAS, the City of. Miami regulates the issuance of occupa-
tional licenses; and
WHEREAS, the State of Florida authorized, as part of. the
Truth in Millage Act, the increase of occupational license taxes,
beginning October 1, 1.980, in Sections 205.033(1)(b) and 205.043
(I)(b), Florida Statutes; and
WHEREAS, the State of Florida, during the 1982 legislative
session, amended Sections 205.033(1)(b) and 205.043(l)(b), Florida
Statutes, by providing limitations on certain occupational li-
cense taxes levied by counties and municipalities at a graduated
or per unit rate to a 25% increase instead of the 100% increase
previously authorized; and
WHEREAS, the State of Florida provided for an effective date
for counties and municipalities of October 1, 1982;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. Section 31-48 of the Code of the City of Miami,
Florida, as amended, is hereby amended in the following particu-

ENCLOSURES:
It is recommended that an Ordinance
be passed to amend certain Occupational
License Fees to comply with the new
limitations set forth in the State of
Florida Statutes.
The State Legislature approved increasing occupational licenses in
1980 as part of the TRIM bill.
The increase was to be limited to 100% on licenses under $100; 50%
to licenses from $100 to $300; and 25% on licenses over $300.
Confusion has existed since that time as to whether to consider the
total cost of the license when computing the increase on graduating
or per unit rates. The City of Miami, as well as many other cities
in the State, interpreted the increase in per unit licenses to be
computed on the per unit rate rather than on the total cost of -the
license. For instance, motion picture theatres that used to pay
$.20 for each seat had their rates increased in 1981 to $.40 regard-
less of their total number of seats. This ordinance reduces the
increase to 25% above the original rate for a new rate of $.25.*
Because of the numerous litigations municipalities have beeni,in-
volved regarding the interpretation of the license rate increase,
in 1982 the State Legislature passed new legislation to clarify the
application of the law. As a result, the City must now adjust its
license rate to comply with Section 205.033 (1)(b), of the Florida
Statutes, for which purpose this ordinance must be adopted.
This change in rates will result in a decrease in revenues for
FY-83 of approximately $700,000, in addition to a reduction in re-
venues in FY-81 of $300,000 due to litigation on the same subject
initiated by.a group of local merchants.
