A RESOLUTION CALLING AND PROVIDING FOR A
SPECIAL MUNICIPAL ELECTION TO BE HELD ON
THE 2ND DAY OF NOVEMBER, 1982, FOR THE
PURPOSE OF SUBMITTING TO THE QUALIFIED
ELECTORS OF THE CITY OF MIAMI FOR THEIR
APPROVAL OR DISAPPROVAL MEASURES KNOWN
AS FOLLOWS: ORDINANCE NO. 9490
PROPOSING A CHARTER AMENDMENT INCORPORAT-
ING THE METHOD OF DISTRICT ELECTIONS FOR
MEMBERS OF THE CITY COMMISSION OF THE CITY
OF MIAMI AND ESTABLISHING A BOUNDARIES COM-
MITTEE WHICH SHALL BE IMPANELLED IMMEDIATELY
FOR THE PURPOSE OF DEFINING THE ORIGINAL
DISTRICTS AND, AGAIN IN 1990, AND EVERY
TEN (10) YEARS THEREAFTER IMMEDIATELY AFTER
THE FINAL RESULTS OF THE FEDERAL DECENNIAL
CENSUS HAVE BECOME OFFICIAL FOR THE PURPOSE
OF REDEFINING THE BOUNDARIES OF SUCH DISTRICTS;
BY INCREASING THE NUMBER OF COMMISSIONERS FROM
FIVE (5) TO SEVEN (7), AND ESTABLISHING THE
TERMS OF EACH COMMISSIONER, AND THE MANNER
OF THEIR ELECTION; ORDINANCE NO.9491
PROPOSING A CHARTER AMENDMENT ADDING A NEW
SECTION 4-A THERETO ENTITLED "TIME OF ELECTION"
PROVIDING FOR MUNICIPAL GENERAL ELECTIONS TO
TAKE PLACE ON EVEN -NUMBERED YEARS TO COINCIDE
WITH FEDERAL AND STATE GENERAL ELECTIONS,
THEREBY EXTENDING BY ONE YEAR THE CURRENT
TERMS OF OFFICE OF THE MAYORS AND THE COMIS-
SIONERS; ORDINANCE NO. 9488 PROPOSING A
CHARTER AMENDMENT MAKING THE WRITTEN LEGAL
OPINIONS OF THE CITY ATTORNEY, DESIGNATED AS
SUCH BY THE CITY ATTORNEY, BINDING ON ALL
MEMBERS AND PERSONNEL OF THE COMMISSION, OF THE
OFFICE OF THE CITY MANAGER, OF THE OFFICE OF
THE CITY CLERK, AND OF THE CITY DEPARTMENTS,
OFFICES, BOARDS, AND COIN1MITTEES NOT INCLUDED
WITHIN ANY DEPARTMENT.
Section 1. Notice of the election heretofore called by;
Ordinances Nos. 9490, 9491 & 9488 to be held on
Tuesday, November 2, 1982, shall be published in THE MIAMI
NEWS, DIARIO LAS AMERICAS, and THE MIAMI TIMES, newspapers of
general circulation published in the City of Miami, Florida,
at least twice, once in the fifth week and once in the third
week prior to the week in which said election is to be held,
the date of the first publication in each of said newspapers
to be at least 30 days before said election, which notice

Nbvetber 2, 1982 for the purpose of submitting to the quali-
fied electors of the City of Miami, Florida the folloWing
question:
CHARTER AMENDMENT NO. 2
"SHALL THE MEASURE KNOWN AS ORDINANCE No. 9490 �
PROPOSING AMENDMENTS TO SECTIONS 4, 8, 13-A AND
13-B OF THE CITY CHARTER TO INCORPORATE .DISTRICT ELEC-
TIONS FOR THE CITY COMMISSION; TO ESTABLISH A
BOUNDARIES COMMITTEE TO DEFINE THE BOUNDARIES OF
THE DISTRICTS; TO INCREASE THE NUMBER OF COMMISSIONERS
FROM FIVE TO SEVEN: AND TO ESTABLISH THE TERMS OF
EACH COMMISSIONER AND THE DATE AND MANNER OF THEIR
ELECTION, be approved?"
This ordinance shall become effective if approved by a
majority of the votes cast by the qualified electors of the
City of Miami voting on said question.
CHARTER AMENDMENT NO. 3
"SHALL THE MEASURE KNOWN AS ORDINANCE NO.9491 �.
PROPOSING AMENDMENTS TO THE CITY CHARTER BY AD-
DING A NEW SECTION PROVIDING FOR MUNICIPAL GENERAL
ELECTIONS TO TAKE PLACE ON EVEN -NUMBERED YEARS TO
COINCIDE WITH FEDERAL AND STATE GENERAL ELECTIONS,
THEREBY EXTENDING BY ONE YEAR THE CURRENT TERMS
OF OFFICE OF TIIE MAYOR AND COMMISSIONERS, be approved?"
This ordinance shall become effective if approved by a

registration in order to vote in the herein described elec-
tion during such times and on such dates as may be desig-
nated by the Supervisor of Elections for Metropolitan Dade
County.
SectionA. The City Clerk of the City of Miami is
hereby designated and appointed as the official represen-
tative of the Commission of the City of ffiami in all trans-
actions with the Supervisor of Elections of Dade County in`

relation to matters pertaining to the use of the registra-
tion books and the holding of said election.
Section 5, The election Clerks and Inspectors to

Section 7. The official ballot to be used at said
special municipal election shall be in full compliance with
the laws of the State of Florida, including all provisions
of the "Electronic Voting Systems Act." The ballot used in
said election of voting on the questions submitted shall be
that portion of the cardboard or paper or other material within
the ballot frames of the voting machines which will contain
a statement of the questions submitted, and said voting machines
shall provide facilities with such instructions on their use
as will enable all qualified electors to vote for or against
such questions as they may choose. Said ballot as it appears
within the first row of horizontal ballot frames of the voting
machines shall be substantially in the following form:

In the event a mechanical voting machine shall not be used
in Voting on the question and an electronic or electro-mechanical
voting system is used in voting on the question, the question
submitted shall be the same as provided above.
Section 8. If a mechanical voting machine is used, each
elector desiring to vote for the approval of said charter amend-
ment shall be instructed to turn down the pointer or lever over
the word "FOR" within the ballot frame containing the statement
of the question relating to such charter amendment, and each
elector desiring to vote against approval of said charter amend-
ment shall be instructed to turn down the pointer or lever over
the word "AGAINST" within the ballot frame containing the state-
ment of the question relating to such charter amendment.
If an electronic or electromagnetic voting system is used,
electors desiring to vote for said charter amendment shall be
instructed to punch straight down with the stylus through the
hole next to the word "FOR" within the ballot frame containing
the statement of the question relating to such charter amendment
