HomeMy WebLinkAboutO-09491ORDINANCE NO-..., 9491 AN ORDINANCE SETTING FORTH A PROPOSED CHARTER. AMENDMENT, XNOWN AS "CHARTER AMENDMENT NO, 3", AMENDING THE CITY CHARTER: ADDING THERETO A. NEW SECTION, NUMBERED 4-A ENTITLED "TIME OF s= ELECTION" PROVIDING FOR MUNICIPAL GENERAL ELECTIONS TO TAXI PLACE ON EVEN -NUMBERED YEARS TO COINCIDE WITH FEDERAL AND STATE GENERAL ELECTIONS► EXTENDING BY ONE YEAR THE CURRENT TERMS OF OFFICE OF THE MAYOR AND COMMISSIONERS; REPEALING ALL CHARTER, SECTIONS OR PARTS THEREOF IN CONFLICT; AND CONTAINING A SEVERABILITY CLAUSE. BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Commission hereby submits the follow- ing proposed Charter Amendment for submission to the qualified electors of the City of Miami at the special municipal election of November 2, 1982, for the purpose of adding to the City Charter a new section numbered 4-A entitled "Time of Election", providing for municipal general elections to take place on even - numbered years to coincide with federal and state elections, - thereby extending by one year the.current terms of office of the mayor and commissioners. The following proposed charter amend- ment shall repeal all charter sections or parts thereof insofar as they are inconsistent or in conflict with the provisions of the proposed charter amendment and shall become effective upon its approval by the electors: CHARTER AMENDMENT NO. 3 A new Section, numbered 4-A, entitled "Time.of Election is hereby added to the Charter of the City of Miami, Chapter 10847, Special Acts, Laws of Florida, 1925, as amended, read- ing as follows: Monday in the month of November, 1984, and the non- partisan pritnary election for the nofnination of candidates tot mayor and cotmissioners shall be held on the first Tuesday after the first Monday in October, 1984, All subsequent regular Municipal election's for the offices of mayor or commissioners shall be held on even -numbered gears to coincide with the federal and state genetal,elections." Section 2. All ordinances or parts of ordinances insofar as they ate inconsistent or in conflict with the provisions of this ordinance are hereby repealed. Section 3. If any section, part of section, paragraph, sentence, clause, phrase, or word of this ordinance is declared invalid, the remaining provisions of this ordinance shall not be affected. Section 4. The proper City Officials are hereby instructed and directed to take all actions necessary,for the submission of this proposed "Charter Amendment No. 3" to the electors of the City of Miami by placing it on the ballot as "CHARTER AMEND- MENT NO. 3" in substantially the following form: "SHALL THE MEASURE KNOWN AS ORDINANCE NO. 9491 , PROPOSING AMENDMENTS TO THE CITY CHARTER BY ADDING A NEW SECTION PRO VIDING FOR MUNICIPAL GENERAL ELECTIONS TO TAKE PLACE ON EVEN -NUMBERED YEARS TO COIN- CIDE WITH FEDERAL AND STATE GENERAL ELECTIONS, THEREBY EXTENDING BY ONE YEAR THE CURRENT TERMS OF OFFICE OF THE MAYOR AND COMMISSIONERS, BE APPROVED?"
