AN ORDINANCE PROHIBITING THE USE OF CABLE TELEVISION FOR DISTRIBUTION OF OBSCENE OR INDECENT MATERIAL, DEFINING TERMS, PRO- VIDING FOR SANCTIONS FOR VIOLATIONS OF SAID PROHIBITION, PROVIDING FOR A PROCE- DURE FOR IMPOSING SUCH SANCTIONS, AND CONTAINING A SEVERABILITY CLAUSE AND AN EFFECTIVE DATE CONTINGENT UPON APPROVAL BY THE ELECTORS OF THE CITY OF MIAMI. WHEREAS, on January 2, 1981, the City of Miami issued a request for proposals, revised on March 20, 1981, to provide cable television services to the citizens of Miami; and WHEREAS, said request for proposals attached a copy of Ordinance -No. 9223, adopted by the City Commission=on Decem- ber 17, 1980; and WHEREAS, said Ordinance No. 9223 provided in part that any licensee accepting a license to be granted pursuant to said Ordinance would thereby acknowledge that its rights thereunder were subject to the police power of the City to i adopt and enforce general resolutions and ordinances neces- sary for the safety and welfare of the public, and would thereby also agree to comply With all applicable general laws and ordinances then in force or subsequently enacted by the City pursuant to such power; and WHEREAS, on October 19, 1981, the Commission of the City of Miami passed and adopted Ordinance No. 9332, effec- tive on Novpmber.19, 1981; and WHEREAS, said Ordinance No. 9332 granted to Miami Tele-Communications, Inc. and to Americable of Greater Miami, Ltd., jointly and severally, a non-exclusive, revoc- able license for the privilege, among others, to operate and maintain a cable television system in the City of Miami; and WHEREAS, the granting of said license for said privi- lege was expressly and specifical ful exercise of the City's policE CITY COMMISSION MEETING OF OCT281982 ORDINANCE NO... ..
