CONDITIONAL USE APPROVAL, CONTAINING A REPEALER PRO-
VISION AND A 5EVERABILITY.CLAUSE.
WHEREAS, the Miami Planning Advisory Board, at its meet
ing of April 7, 1982s following.an advertised hearing, adopted
Resolution No. PAB 23=82.by,a 6-0 vote RECOMMENDING APPROVAL

of amending Comprehensive Zoning Ordinance No. 6871, as herein-
after set forth; and
"
WHEREAS, the City Commission, after. careful consideration
of this matter, deems it advisable and in the best .interest of
the general welfare of the City of.Miami and its inhabitants to
grant this amendment as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED'BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. Ordinance No. 6871, as amended, the Comprehen-
sive Zoning, ordinance for the City'of'Miami,is hereby amended,."
by adding a new paragraph (g) to subsection (7) of Section l,'
"USE REGULATIONS",of ARTICLE XI-2, "RESIDENTIAL-OFFICE-,-R-CB

"ARTICLE XI-2-RESIDENTIAL-OFFICE, R-CB DISTRICT '
PURPOSE

The following regulations shall apply in all R-CB„Districts:
Section'l.- USE REGULATIONS
No building or structure, or part thereof,`shall,be erected',
altered, or used, or land or water used, in, whole, or. in part,

The following regulations shall apply in all "C-1 Districts:
Section I,- USE REGULATIONS
No building or structure, or part thereof, shall,be erected;
altered or used, or land or water used, in whole or in part,
- for other than one or more of the following specified uses
in accordance with the limitations hereinafter specified.
(33) The following uses if approved as CONDITIONAL USE:
Docks and piers extending into Biscayne Bay a
distance greater "than twenty-five (25) feet

beyond the existing seawall or mean high
waterline subject to limitations and con-
ditions prescribed by Section 23 of ARTICLE
IV of this ordinance."
Section 2. All ordinances or parts of ordinancesinsofar
as they are inconsistent or in conflict with.the provisions of,
this ordinance are hereby repealed.
Section 4. If any section, part of section, paragraph,
clause; phrase, or word of this ordinance is declared invalid,
the remaining provisions of this ordinance shall'not be"affec-
ted.
