ORDINANCE NO.
AN ORDINANCE AMENDING SUBSECTION (d) OF
SECTION 54-3 OF THE CODE OF THE CITY OF
MIAMI, BY INCREASING THE FEE FROM $15 TO
$30 WHEN APPLYING FOR A PERMIT TO OBSTRUCT
A STREET OR SIDEWALK OR IMPEDE TRAFFIC;
CONTAINING A REPEALER PROVISION AND A
SEVERABILITY CLAUSE.
WHEREAS, Section 54-3 of the City Code prohibits the
obstruction of any street or sidewalk without first having
a
obtained a permit from both the Police Department tand the
Fire, Rescue and Inspection Services Department; and
WHEREAS, such permit shall set forth minimal and reason-
able conditions for the protection of propertty and personal
safety; and
WHEREAS, it is a condition precedent to the issuance of
any such permit that the applicant shall assume all civil
liability for its acts and shall hold the City harmless for

any acts arising or result from the issuance of said permit;
and
WHEREAS, costs to the City for administrative processing
and follow up on these permits have increased substantially;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. Subsection (d) of Section 54-3 of the Code
of the City of Miami, Florida, as amended, is hereby further

amended in the following particulars:

"Sec. 5'4-3. permit required to obstruct street
or sidewalk or impede traffic.
(d) A fee of €ftreeH thirty dollars 44l_3rAA�
($30.00) shall accompany each permit application
to the police department, to be retained by the
' city regardless of action taken in the grant or
denial of the permit."
