WHEREAS, a special municipal election was duly held in the City of Miami, Florida, on November 2, 1982; and WHEREAS, said election was duly conducted in accordance with the provisions of the "Electronic Voting Systems Act" M01.5601 through §101.5615, F.S.); and IMEREAS, the official returns of each of 86 election precincts in the herein election of November 2, 1982 have been duly certified by RALPH G. ONGIE, City Clerk, Supervisor of Elections for the Citv of Miami, Florida, upon due certi- fication by the Supervisor of Elections for Metropolitan Dade County, Florida, and those official returns have been delivered to and duly canvassed by the City Commission; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAM1, FLORIDA: Section 1.. The results of the special municipal election held on November 2, 1.982 in the City of Miami, Florida, on the following duly submitted question: "Shall the City of Miami institute residential combined curbside garbage and trash collection, twice per week, in regular containers, with no increase in the waste fee, as opposed to an increase under the. present backyard collection system of S30 per year during fiscal years 1983-84 and 1984-85?" CITY CO► MISS OI M MEETING OF N0U'I 1�-2 ate as follows: There were 264976 votes cast for ap- pboval. of the City's institution of residential combined curbside garbage and trash collection and 17,595 votes cast against such institution, and the City Commission hereby finds, declares and certifies that the City's insti- tution of residential combined curbside garbage and trash collection was approved by the electorate; further, the City Commission hereby declares the total number of votes cast upon the question of said institution, including absentee ballots, at said election in the 86 voting precincts was 44,571. Section 2. The City Commission also hereby finds, de- clares and certifies: (a) said special municipal election was duly held and notice thereof was given in accordance with lava; (b) all steps in connection with and leading up to said special election were duly, regularly and lawfully taken and had; and (c) all applicable provisions of the Constitution and statutes of the State of Florida, the Dade County Election Code and the City Code have been duly com- plied with. Section 3. The City Clerk is hereby authorized and di- rected to perform any and all incidental duties in connection herewith as required by law. PASSED AND ADOPTED this 4 day of November 1982. ONGIE, City Clerk of the City of Miami, Florida, do hereby certify that all necessary legal steps in connection with the conducting of a Special City of Miami Election held on November 2, 1982 were followed, i.e., logic and accuracy tests were held on October 29 and November 2, 1982, using dummy ballots to determine that the computer was functioning correctly, and that all documents concerning these logic and accuracy tests showed the computer to be functioning correctly and are in the possession of the Supervisor of Elections of Metropolitan Dade Countv, under sealed vault. I further certify that the aforesaid election was conducted in accordance with the provisions of the "Electronic Voting Systems Act, (§101.5601 through §101.5615, F.S.). RAY.PH G.
