A RESOLUTION DECLARING AND CERTIFYING THE
RESULTS OF THE SPECIAL MUNTCTPAI. (ELECTION
HELD ON NOVEMBER 2, 1982 F01: THE PURPOSE OF
VOTING FOR TILE APPROVAL OR DISAPPROVAL. OF
CHARTER AMENDMENT NO. a IdHICH PROPOSED
AMENDMENTS TO SECTLON 21 OF THE CITY CHARTER,
MAKING; TIDE WRITTEN LEGAL OPINIONS OF THE CITY
ATTORNEY, DESIGNATED AS SUCH BY THE CITY
ATTORNEY, BINDING ON AI.I, MEMBERS AND PERSONNEL

MANAGER, OF THE, OFFICE, 01: THE CITY CLERK, AND
OF THE CITY DIA'ARTMENTS, OFFICES, BOARDS, AND

SAID ELECTION RESULTTN(, IN TIIE DISAPPROVAL OF
THE SAID PROPOSED CHARTER AME-NDMENT.
WHEREAS, a special municipal, election was duly held in
the City of Miami, Florida, on November 2, 1982; and
WHEREAS, said election was duly conducted in accordance
with the provisions of the. "Electronic Voting Systems Act"
(§101.5601 through §101.561.5, F.S.); and
I,HEREAS, the official. returns of each of 86 election
precincts in the herein election of November 2, 1982 have
been duly cert1,fled by RALPH G. ONGIE, City Clerk, Supervisor
of Elections for the City of Miami, Florida, upon due certi-
fication by the Supervisor of Elections for Metropolitan Dade
County, Florida, and those official returns have been delivered
to and duly canvassed by the City Commission;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The results of the special municipal election
held on November 2, 1982 in the City of Miami, Florida, on the
proposed Charter Amendment No. 4 which was duly submitted in
the following form:
"Shall the measure known as Ordinance No.
9488, proposing; amendments to Section 21 of
the City Charter, making; the written legal
opinions of the City Attorney, designated as
such by the City Attorney, binding on all
members and personnel of the commission, of
the office of the City Manager, Of the office
of the City Clerk, and of the City Departments,
Offices, Boards, and Committees not included
within any department, he approved?"

are as follows: There were 16,877 votes cast for ap=
proval of the said proposed amendment and 20,681 votes
cast against the approval of the said proposed amendment,
and the City Commission hereby finds, declares, and certi-
fies that the said proposed amendment was disapproved by the
electorate; further, the City Commission hereby declares the
total number of votes cast upon the said proposed amendment,
including absentee ballots, at said election in the 86
voting precincts was 37,5j8.
Section 2. The City Commission also hereby finds, de-
clares and certifies: (a) said special municipal election
was duly held and notice thereof was given in accordance
with law; (b) all steps in connection with and leading up to
said special election were duly, regularly and lawfully
taken and had; and (e) all applicable provisions of the
Constitution and Statutes of the State of Florida, the Dade
County Election Code and the City Code have been duly com-
plied with.
Section 3. The City Clerk is hereby authorized and di-
rected to perform any and all incidental duties in connection
herewith as required by law.
