WHEREAS, a special municipal. election was duly held in the City of Miami, Florida, on November 2, 1982, and WHEREAS, said election was dul.v conducted in accordance with the provisions of the "Electronic Voting Systems Act" (§101..5601 through §101.5615, F.S.); and WHEREAS, the official returns of each of 86 elect ion precincts in the herein election of November 2, 1982 have been duly cert if ied by RALPH G. ONGI17, City Clerk, Supervisor of Elections for the City of Miami, Florida, upon due certi- fication by the Supervisor of Elections for Metropolitan Dade County, Florida, and those official returns have been delivered to and duly canvassed by the City Commission; NOW, THEREFORE, ITT: 1T RI:SOLvED BY THE COMMISSION OF THE CITY 017 MIAMI , FLORIDA: Section 1. The results of the special municipal election held on November 2, 1982 in the City of Miami, Florida, on the proposed Charter Amendment No. 2 which was duly submitted in the following form: "Shall the measure known as Ordinance No. 9490, proposing amendments to Sections 4, 8, 13-A and 13-11 of the City Charter to incorporate district elections fur the City Commission; to establish a boundaries committee to define the boundaries of the districts; to increase the number of commis- sioners from five, to seven; and to establish the terms of each Commissioner and the date and manner of their election, be approved?" CITY COMMISSION MEETING OF NOv4 W2 17 Yew+YisrMwo..rrw..lw.i Mrf ate as follows: There were 18,256 votes cast for ap- proval of the said proposed amendment and 22,499 votes cast against the approval of the said proposed amendment, and the City Commission hereby finds, declares, and certi- fies that the said proposed amendment was disapproved by the electorate; further, the City Commission hereby declares the total number of votes cast upon the said proposed amendment, including .-absentee ballots, at said election in the 86 voting precincts was 40,755. Section 2. The City Commission also hereby finds, de- clares and certifies: (a) said special municipal election was duly held and notice thereof wa i d n e with law; (b) all steps in c.onnecti said special election were duly, re taken and had; and (c) all applicab Constitution and statutes of the St County Election Code and the City C plied with. Section 3. The City Clerk is rected to perform any and all incid herewith as required by law. ONGIE, City Clerk of. the City of Miami, Florida, do hereby certify that all necessary legal steps in connection with the conducting of a Special City of Miami Election held on November 2, 1982 were followed, i.e., logic and accuracy tests were held on October 29 and November 2, 1.982, using dummy ballots to determine that the computer was functioning correctly, and that al.t documents concerning these logic and accuracy tests showed the computer to be functioning correctly and are in the possession of the Supervisor of Elections of Metropolitan Dade County, under sealed vault. I further certify that the aforesaid election was conducted in accordance with the provisions of the "Electronic Voting Systems Act, (§101.5601 through §101.5615, F.S.). RA—L'H rG.
