I i•;T11C11 PROPOSED AMENDMENTS TO SECTIONS 3, 52, AND 53 OF THE CITY (AlARTER PROVIDING FOR THE POWER AND METHOD OF ACQUTRTNG AND DISPOSING OF ALI, REAL AND PERSONAL 1'ROPEl:TS", INCLUDING WATER- FRONT PROPERTY, IMiLIC Id01:1 S AND IMPROVEMENTS, UNIFIED DI:Vi:1,0P?1ENT PROJECTS, AND SERVICES; DEFINING AND AUTHORIZING UNIFIED DEVELOP?LENT PROJI-:CTS; RENAMING AND REDEFINING "CITE DUTIES OF THE PURCHASING AGI-'.NT, PROVIDING SAFEGUARDS; AND PROVIDING FOR AFFIRMATIVI: ACTION, SAID ELECTTON RESULTING LN THE. APPROVAL OF THE SAID PROPOSED CHARTER A?II:NDMENT. WHEREAS, a special municipal election was duly held in the City of Miami, Florida, on November. 2, 1.982; and WHEREAS, said election was duly conducted in accordance with the provisions of. the "Electronic Voting Systems Act" (§101.5601 through §101..5615, F.S.); and IdHEREAS, the official. returns of each of 86 election precincts in the herein election of. November 2, 1982 have been duly certified by RALPH C. ONGIE, City Clerk, Supervisor of Elections for the City of Miami, Florida, upon due certi- fication by tine Supervisor of Elections for Metropolitan Dade County, Florida, and those official returns have been delivered to and duly canvassed by the City Commission; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The results of the special municipal election lield on November 2, 1982 in the City of Miami, Florida, on the proposed Charter Amendment No. 1 which was duly submitted in the following form: "Shall the measure known as Ordinance No. 9489, proposing amendments to Sections 3, 52, and 53 of the City Charter: providing for the power and method of acquiring and disposing of all real acid personal property, including waturfront property, public works and improvements, unified development pro- JeCtS, and ServiceS; defining and authorizing unified development projects; renaming and redefining the duties of the purchasing agent; providing safeguards; and providing for affirmative action, be approved?" My COMMISSION MEETING OF NOV_� i932 kak............ are as follows: There were 19,917 votes cast for ap= proval of the said proposed amendment and 18,712 votes cast against the approval. of the said proposed amendment, and the City Commission hereby finds, declares, and certi- fies that the said proposed amendment was approved by the electorate; further, the City Commission hereby declares the total number of votes cast upon the said proposed amendment, including absentee ballots, at said election in the 86 voting precincts was 38,629. Section 2. The City Commission also hereby finds, de- clares and certifies: (a) said special municipal election was duly held and notice thereof was given in accordance with law; (b) all steps in connection with and leading up to said special. election were duly, regul.arly and lawfully taken and had; and (c) all applicable provisions of the Constitution and statutes of the State of Florida, the Dade County Election Code and the City Code have been duly com- plied with. Section 3. The City Clerk is hereby authorized and di- rected to perform any and all incidental duties in connection herewith as required by law. ONGIE, City Clerk of the City of Miami, Florida, do hereby certify that all necessary legal steps in connection with the conducting of a Special City of Miami Election held on November 2, 1982 were followed, i.e., logic and accuracy tests were held on October 29 and November 2, 1982, using dummy ballots to determine that the computer was functioning correctly, and that all documents concerning; these logic and accuracy tests showed the computer to be functioning correctly and are in the possession of the Supervisor of Elections of Metropolitan Dade County, under sealed vault. I further certify that the aforesaid election was conducted in accordance with the provisions of the "Electronic Voting Systems Act, (§101.5601 through §101.5615, F.S.).
