WHEREAS, pursuant to Section 62-521 of the Code of the City of Miami, Florida, as amended ("City Code"), titled "Temporary Events in General", temporary events are limited to no more than two (2) events per year per property for a maximum of two (2) weeks per permit; and WHEREAS, pursuant to Section 62-521(b)(4) of the City Code, the number of events can be waived upon affirmative vote of the City Commission; and WHEREAS, padel ball is a close cousin to tennis, racquetball, and squash which was invented in Mexico in 1969; and WHEREAS, the lessee at the public property located at 1000 MacArthur Causeway, Miami, Florida ("Event Site") wishes to continue to host two more, two week padel ball events ("Event") to provide clinics and open play to both children and adults and well as tournament play; and WHEREAS, Reserve Padel Miami has created pop-up courts in order to bring this new game to Miami, both for residents as well as visitors; and WHEREAS, the Event Site is already holding special events through the City process and the 10 events at two weeks for each event will expire as of July 21, 2023; and WHEREAS, in order to continue for the remainder of the year, the Event requires a City Commission waiver for the remaining twenty-three (23) weeks, which is 11 and '/2, two -week events; and WHEREAS, the Event at the Event Site do require permits to be issued by the City of Miami ("City") to ensure life -safety and quality of life issues and appropriate conditions may be imposed on each permit; and WHEREAS, the Event Site shall not have any helicopter activity and/or usage occurring at any time; and WHEREAS, the Event at the Event Site will be beneficial to the City's residents and visitors; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as if fully set forth in this Section. Section 2. Pursuant to Section 62-521(b)(4) of the City Code, titled "Temporary Events in General", the ten (10) temporary event per year per public property limitation is hereby waived to allow the Event at the Event Site from July 21, 2023, through December 31, 2023. Section 3. There shall be no helicopter takeoffs, landings, or parking operations on or above any part of the Property. Any instance of helicopter takeoffs, landings, or parking operations on or above any part of the Property will render the Temporary Event permit null and void. Section 4. This Resolution does not waive any other requirements of the City Code, including but not limited to, noise restrictions, applicable fees, inspections, and permits. Section 5. This Resolution shall become effective immediately upon its adoption.
