A RESOLUTION CONFIRMING ORDERING RESO- LUTION NO. 82-1032 AND AUTHORIZING THE CITY CLERK TO ADVERTISE FOR SEALED BIDS FOR THE CONSTRUCTION OF "KINLOCH SANITARY SEWER IMPROVEMENT" IN "KINLOCH SANITARY SEWER IMPROVEMENT DISTRICT SR-5485-S (SIDELINE SEWER)". WHEREAS, at the City Commission meeting of November 4, 1982, Resolution No. 82-1032 was passed which ordered a sanitary sewer improvement identified as "KINLOCH SANITARY SE14ER IMPROVEMENT" in "KINLOCH SANITARY SE14ER IMPROVEMENT DISTRICT SR-5485-S (sideline sewer)"; and WHEREAS, pursuant to due public notice a public hearing was held before the City Commission on December 9, 1982 as to any objections to the confirmation of Resolution No. 82-1032, which resolution ordered "KINLOCH SANITARY SE14ER IMPROVEMENT" in "KINLOCH SANITARY SEWER IMPROVEMENT DISTRICT SR-5485-S (sideline sewer)"; and WHEREAS, no objections to the confirmation of said sewer improvement were sustained by the Commission, it is therefore in order for the Commission to confirm said ordering resolution and authorize the City Clerk to advertise for sealed bids for the construction of said improvement; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Resolution No. 82-1032 dated November 4, 1982, which ordered "KINLOCH SANITARY SEWER IMPROVEMENT" in "KINLOCH SANITARY SEWER IMPROVEMENT DISTRICT SR-5485-S (sideline sewer)", is hereby confirmed. Two 2 Resolutions The Department of Public Works recommends the adoption of the resolutions confirming Ordering Resolutions No. 82-1032 and 82-1033, and authorizing the City Clerk to advertise for sealed bids for the construction of KINLOCH SANITARY SEWER IMPROVEMENT in KINLOCH SANITARY SEWER IMPROVEMENT DISTRICT SR-5485-C (centerline sewer) and SR-548 5-S (sideline sewer). This district consists of properties in an area bounded approximately by N.W. 42 Avenue, N.W. 47 Avenue, N.W. 7 Street, and the West Flagler Street. The construction of this sanitary sewer improvement is part of the City's continuing program to provide sanitary sewers throughout the City of Miami. This area is presently served by septic tank and drainfield installa- tions which are to be abandoned by the property owners after comple- tion of the sanitary sewer system. To serve this area, the Department of Public Works has designated KINLOCH SANITARY SEWER IMPROVEMENT in KINLOCH SANITARY SEWER DISTRICT SR-5485-C (centerline sewer) and SR-5485-5 (sideline sewer) as asses- sable improvements under Section 56 of the City Charter. Each property designated for assessment under the ordering resolutions will receive a sewer service lateral to their property line. This improvement was ordered by the of November 4, 1982. Dear Mr. Garcia -Pedrosa: Upon reviewing the file on the above referenced proposed amendments, I find that this matter was referred to the City Commission by Inter -Office Memorandum of Aurelio E. Perez-Lugones dated September 7, 1982. More than ninety days have passed since this matter was referred to the City Commission, therefore pursuant to Article XXX Section 13, of the Comprehensive Zoning Ordinance of Miami, Florida, this application must be deemed to have been denied. I am also concerned by your memo of November 18, 1982, to Ralph Ongie, which implies that the City need not comply with Article XXX Section 120) which requires posted and mailed notice. No posted notice of either the Planning Advisory Board meeting or any of the City Commission meetings was ever done. The mailed notice is insufficient in that it does not "clearly explain the proposed ordinance" and does not notify the person of both public hearings on this proposed ordinance. 'Nailed notice is also required by section 62-55(3) of the City code. I apologize for bringing this to your attention only the day before the scheduled City Commission meeting on this item, but would welcome the opportunity to discuss it further with you.
