HomeMy WebLinkAboutR-82-1115J-82 -1 57 RESOLUTION NO.'''�•� 1i '� A RESOLUTION RESCINDING RESOLUTION NO. 82-543, ADOPTED JUNE 17, 1982, WHICH ACCEPTED THE LOW BID AND AUTHORIZED THE CITY MANAGER TO ENTER INTO A CONTRACT WITH PAVEMENT MAINTENANCE COR- PORATION FOR THE CONSTRUCTION OF SIMON BOLIVAR PLAZA; DECLARING SAID CONTRACT NULL AND VOID AND REJECTING ALL BIDS FOR SAID PROJECT; SAID ACTIONS BEING NECESSARY TO RELEASE THE CON- TRACTOR DUE TO THE FAILURE. OF FUNDS BEING PROVIDED FOR THIS PROJECT. WHEREAS, by Motion 81-522, passed June 8, 1981, the City Commission directed the City 'Manager to accept a Simon Bolivar statue and plaza offered by the Ministry of Venezuela; and WHEREAS, the government of Venezuela had agreed to fund all costs for construction of SIMON BOLIVAR PLAZA at Bayfront Park; and WHEREAS, bids were received on May 25, 1981 for the con- struction of said plaza; and WHEREAS, by Resolution No. 82-543, passed June 17, 1982, a contract was awarded to Pavement Maintenance Corporation for the construction of said plaza in the amount of $105,000; and WHEREAS, the governement of Venezuela has, to this date, not made available to the City of Miami the funds necessary to construct said plaza; and WHEREAS, after a period of 6 months since the award of the contract, the low bidder, Pavement Maintenance Corpora- tion, has requested to be released from said contract; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Resolution No. 82-543, passed June 17, 1982 by the City Commission, which accepted the bid of Pavement Maintenance Corporation for the construction of SIMON BOLIVAR PLAZA, allocated funds for the project, and authorized the City Manager to execute a contract with Pavement Maintenance Cor- poration, is hereby rescinded. The contract made and entered into on June 23, 19829 by and between the City of Miami and Pavement :Maintenance Corporation, is hereby declared null and void. Section 3. All bids received on Mav 25, 1982 for SIMON BOLIVAR PLAZA are hereby rejected. Section 4. C11 The Department of Public Works and the Department of Parks recommend adoption of the attached resolution rescinding Resolution 82-543; and voiding the contract between The City of Miami and Pavement Maintenance Corporation; and rejecting all bids. On May 25, 1982, bids were received for SIMON BOLIVAR PLAZA, with funds for the project to have been provided by the Republic of Venezuela. The low bidder was Pavement Maintenance Corporation. A contract was awarded to Pavement Maintenance Corporation on June 17, 1982. However, funds for the project are still not available from Venezuela. The contractor, after all this time, has requested that the City return his performance bond, thereby releasing him from the contract. It is now in order for the City Commission to adopt the attached resolution which rescinds Resolution 82-543, and voids the contract with Pavement Maintenance Corporation; the attached resolution also rejects all other bids received on May 25, 1982 for this project. Bids for the construction of the Plaza were received on May 25, 1982, and the low bidder has been on hold since then as the funds for the project have never been supplied by the government of Venezuela. It is our recommendation that the return of the bid bond for Simon Bolivar Plaza be placed on the December 9th City Commission agenda.
