A RESOLUTION AMENDING RESOLUTION NO. 82-906 WHICH CONFIRMED THE PRELIMINARY ASSESSMENT ROLL FOR CONSTRUCTION OF CRESTWOOD SANITARY SEWER IMPROVEMENT IN CRESTWOOD SANITARY SEWER IMPROVEMENT DISTRICT SR-5432-C (CENTERLINE. SEWER); AND REDUCING THE TOTAL ASSESSMENT COST OF SAID IMPROVEMENT BY THE AMOUNT OF $90.01; THIS ACTION BEING NECESSARY TO REDUCE. THE ASSESSMENT AGAINST ONE PROPERTY WITHIN THE DISTRICT. WHEREAS, the City Commission met on October 14, 1982, pursuant to due legal notice of said meeting under Section 56 of the City Charter, as amended, to review all written objections to the confirmation of the preliminary assessment roll for the cost of CRESTWOOD SANITARY SEWER IMPROVEMENT in CRESTWOOD SANITARY SEWER IMPROVEMENT DISTRICT SR-5432-C (centerline sewer); and WHEREAS, said preliminary assessment roll included an assessment against property number 01-3123-06-0210, Lot 12, Block 2, Bowling Green, PB 5-101, Dade County, Florida, for the cost of providing; sanitary sewer to said property; and WHEREAS, the owners of said property formally dedicated to the City a strip of said property 10 feet wide on .July 7, 1982, recorded in Official Record 11149, page 1321; and WHEREAS, said dedication reduces the frontage on which assessments are based from 40 feet to 30 feet; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Section 3 of Resolution No. 82-906 adopted October 14, 1982 which confirmed the preliminary assessment roll for construction of CRISTWOOD SANITARY SEWER IMPROVEMENT in CREST1400D SANITARY SEWER IMPROVEMENT DISTRICT SR-5432-C (centerline sewer) is hereby amended in the following par- ticulars: "Section 3. The prima facie assessment as it appears in the preliminary assessment roll for CRESTWOOD SANITARY SEWER IMPROVEMENT in CRESTWOOD SANITARY SEWER IMPROVEMENT DISTRICT SR-5432-C (centerline sewer) against property number 01-3123-06-0210, is hereby reduced in the amount of $90.01. Cather Director of Public Works M -� November 10, 1982 B-5432C s = CRESTWOOD SANITARY SEWER IMPROVEMENT - Resolution Amending Preliminary_ FE«REN-ES Assessment Roll (For Commission Meeting of December 9. 1982) The Department of Public Works recommends the adoption of the resolution amending resolution No, 82-906 Which confirmed the preliminary assessment roll for construction of CRESTT,JOOD SANITARY SETTER IMPROVEMENT in CREST1400D SANITARY SEWER IMPROVEMENT DISTRICT SR-5432C (centerline sewer); and reducing the total assessment cost of said improvement by the amount of $90.01; this action being necessary to reduce the assessment against one property within the district. On October 14, 1982, the City Commission adopted resolution No. 82-906, which confirmed the assessment roll for the above referenced sanitary sewer district. Since then, the owners of one of the properties have contacted this department to advise of a 10 foot wide dedication to the City, which in turn reduces their assessable frontage. This dedication took place long after the completion of the project, and was requested of the owners by the City, in order to proceed with plans for a highway improvement. It has been the Dolicy of this department in the east to assess corner lots, such as this one, on the shortest side. Therefore, by dedicating the 10 foot strip, the owners have reduced their frontage on the short side from 40 feet to 30 feet. At an assessable cost of $9.00076, this renresent a difference in favor of the DroDerty owners of $90.61; this difference would have been absorbed by the City's share as part of the cost of intersections. It is thus in order to reduce the prima facie assessment against D rty number 01-3123-06-0210 by $90.01. GW z Resolution attached
