HomeMy WebLinkAboutR-82-1081.1-bZ-197 sd 4ki AV RESOLUTION NO.82-1061 A RESOLUTION EXPRESSING TO THE GOVERNOR OF THE STATE OF FLORIDA THE CONCERN OF THE CITY COMMISSION OVER THE INADEQUATE ENFORCEMENT PROVISIONS OF THE FLORIDA RESIDENTIAL LANDLORD AND TENANT ACT RELATING TO THE RETURN TO TENANTS OF SECURITY DEPOSITS, AND URGI,,G HIM TO PROPOSE REVEDIAL LEGISLATION. WHEREAS, the Florida Residential. Landlord and Tenant Act., Fla. Stat. Ann. S';53.40 et seq., provides in part for the return by landlords to tenants of monies collected as security deposits upon the completion of the tenancies and the redelivery of the premises by the tenants in compliance with all lease requirements; and WHERL•'AS, it has come to the attention of the Citv Commission that there is a chronic failure bl, landlords in the Cite of Miami to return security deposits to tenants upon tho completion of the tenancies; and WHFREAS, said failure constitutes both a violation of law and an economic burden upon tenants in the City of Miami, to the dctri.ment of the residents of the City of 1'1iami; and 1,)HEREAS, said tenants often find it economi,7ally un- feasible or otherwise difficult to avail themselves of the legal process to enforce their rights under said law; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI. FLORIDA: Section 1. The City Commission hereby expresses to the Governor of the State of Florida its concern over the inadequate enforcement provisionsof the Florida Residential. Landlord and Tenant Act relating to the return to tenants of security deposits upon the completion of the tenancies. Section 2. The City Commission hereby urges the Governor of the State of Florida to propose appropriate legislation to remedy the inadequacy of the enforcement provisions of said Act. CITY COMMISSION MEETING OF DEC 4 Section 3. The City Clerk is hereby directed to forward a copy of this Resolution to the Governor of the State of Florida and otherwise to disseminate its contents to the public and the press.
