WHEREAS, Section 54-6 of the City Code prohibits proces- sions or parades along any public street except in accordance with a permit issued by the City Manager based on a recommen- dation from the Chief of Police; and WHEREAS, the written application for such permit shall be filed with the Chief of Police on a form sufficiently in advance of the proposed parade or procession to allow ade- quate arrangements to be made for the proper policing of same; and WHEREAS, such permits shall set forth conditions reason- ably necessary for the protection of the rights, property and personal safety of all parties; and WHEREAS, upon issuance of such permit the Police Depart- ment is required to furnish police services adjacent to the permit area as needed without diminishing routine service levels to the entire community; and WHEREAS, by applying for and being granted such permit, the applicant assumes all civil liability arising from con- ditions, restrictions, or omissions on the face of the permit; and WHEREAS, the Police Department charges a fee for admin- istrative costs involved in administration, processing and follow up of parade and procession permit applications; and WHEREAS, costs for the administration, processing and follow up on these permits have risen substantially; NOW, THEREFORE, BE 11' ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: 10 0 Section 1.. Subser_Cion ( f ) of Section 5 4 - 6 of the Cade of the. City of iiami, Florida, as amended, is hereby further amended in tile folloWing prirti.culars: "Scc. 54-6 11crill i t reciui red for parade~ and processions. (f) Pavment of a nonrefundable fee of €ift-een thirty dollar, f,s+14-.90} ($_30.00) for the adminis- trative costs involved in the processing of the herein parade or procession permit application shall accompany the filing of the permit appli- cation and shall remain in the general revenues of the city without regard to the final action taken by the city manager or his designee." Section ?. All ordinances or parts of ordinances insofar as they are .inconsistent or in conflict with the provisions of this ordinance are hereby repealed. Section 3. If any section, part of section, paragraph, clause, phrase, or word of this ordinance is declared in- valid, the remaining provisions of this ordinance shall not be affected. AN ORDINANCE AMENDING SECTION 54-6 OF THE CODE OF THE CITY OF MIAMI TO PROVIDE A FEE OF THIRTY DOLLARS TO APPLY FOR A PERMIT FOR PARADES AND PROCESSIONS. It is requested that the attached ordinance amending the fee for parade and procession applications be placed on the City Commission agenda. This ordinance amends the existing ordinance only in that it increases the fee for applying for parade or procession permits from fifteen dollars to thirty dollars. As is currently done, this money would remain in the general fund regardless of action taken on the application.
