A RESOLUTION UPHOLDING DENIAL OF VARIANCE PROM ORDINANCE NO. 6871, ARTICLE XVI, SECTION 4(b) AND ARTICLE XXIII, SECTION 2(2), 3(3) (b), 4 (25) (27), TO PERMIT AN EXISTING RETAIL/WARE- HOUSE ADDITION UNDER CONSTRUCTION TO AN EXIST- ING WAREHOUSE USE ON THE N 100' OF LOT 10, BLOCK 8S, MIAMI (B-41); LOCATED AT 774 NORTH -TEST l STREET, AS PER FLANS ON FILE, tdITH A 3.67' STAIR= MAY FNCROACIIMENT ON THE SIDE STREET YARD (5' RE- OUIRED) , WAIVING 2 OF 6 COMBINFD (RETAIL/1,1ARE- HOUSE) REQUIRED OFF-STREET PARI:ING SPACES, WAIVING PERIPHERY LANDSCAPING (5' REQUIRED) AND PROVIDING 21.98' ACCESS AISLE TO PARKING SPACES (23' RE- QUIRED); ZONED C-4 (GENERAL COMMERCIAL). WHEREAS, the Miami Zoning Board at its meeting of November Item No. 3, following an advertised hearing, adopted Re- solution No. ZB-206-82, by a vote of 7 to 0, DENYING VARIANCE as hereinafter set forth; and 1411EREAS, the objectors have taken an appeal to the City Commission of said denial; and I,,'I'EREAS, the City Commission notwithstanding the appeal by the objectors and after careful consideration of this matter deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to uphold the Zoning Board's denial of the variance, as hereinafter set forth; NOW, THEREFORE, BE IT RESOLVED BY TILE COMMISSION OF THE. CITY OF MIAMI, FLORIDA: Section 1. The request for variance as per Ordinance No. 6871, Article XVI, Section 4(b) and Article XXIII, Section 2(2), 3(3) (b), 4 (25) (27), to permit an existing retail/warehouse addition under construction to nn existing warehouse use on the N 100' of Lot 10, Block 8S, MIAMI (B-41); located at 774 Northwest 1 Street, as per plans on file, with a3.67' stairway encroachment on the side street yard (5' required) waiving 2 of 6 combined (Retail/Warehouse) required off-street parking spaces, waiving periphery landscaping (5' required) and providing 21.98' access aisle to parking spaces (23' required); zoned C-4 (General Commercial) is denied. The Zoning Board, at its meeting of November 15, 1982, Item 3, following an advertised hearing, adopted Resolution ZB 206-82, denying variances by a vote of seven to zero for the above petition, as per plans on file, with a 3.67' stairway encroachment on the side street yard (5' required), waiving 2 of 6 combined (retail/warehouse) required off-street parking spaces, waiving periphery landscaping (5' required) and providing 21.98' access aisle to parking spaces (23' required). The subject property zoned C-4 (General Commercial) is also described as the N 100' of Lot 10, Block 8S, Miami (B-41). Two objections received in the mail; one response in favor received in the mail; three proponents present at the meeting. Backup information is included for your review. A RESOLUTION to provide for the above has been prepared by the City Attorney's Office and submitted for consideration of the City Commission. Phone 9661-1556 •� Variance to permit an existing retail/warehouse addition under construction to an existing warehouse use on above site, as per plans on file with a 3.67' stairway encroachment on the side street yard (5' required), waiving 2 of 6 combined (retail/warehouse) required off-street parking spaces, waiving periphery landscaping (5' required) and providing 21.98' access aisle to parking spaces (23' required). DENIAL OF THE VARIANCES. The Planning Department recommends that parking should be provided offsite since this is a congested area. This would provide an opportunity to place landscaping along the periphery as required, and would eliminate the need for an access aisle to parking spaces. The Planning Department would again like to reiterate its position that there is no excuse for construction to occur without a permit. Request the dedication of the west 10 feet of the north 100 feet of lot 10. This item was deferred from the meeting of October 4, 19002.
