WHEREAS, the Miami Zoning Board at its meeting of November 15, 1982, Item No. 1, following an advertised hearing, adopted Re- solution No. ZB-204-82, by a 7 to 0 vote, RFCOMMENDINC APPROVAL of the official vacation and closure of a street, as hereinafter set forth; and WPERPAS, the Citv Commission deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to "rant the vacation and closure of the street in question; NOW TPFREFORE, BE IT RESOLVED BY TER' COrSIISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The Planning Department cites the following factors as forming a basis for review by the City Commission: 1. The establishment is located 1,550' from the Club Trianon and 2,130' from the Suclar. Shack, which hold liquor licenses, where 2,500' is required. 2. This establishment currently holds a beer and wine license. The Cite has no obligation to reinforce this use through a grant of variance for a liquor license. 3. The potential impact of an additional liquor establish- ment on the surrounding area is important enough to have the Conunission review the variance and establish their policy. W. 8th St., Lots 8, 9, and 10 Block 1 HILL'S TRAIL GROVE (21-75) Gentlemeni This variance has been brought up so many times in the past year that we can no longer get the neighbors to take off from work to attend the hearings. There have been several of us present at the first few meetings and at least one petition with 20-30 names, addresses and phones was sent in protesting this variance. The cards sent to us on subsequent meetings have also been returned protesting. Now we find that at the December 6, 1982, meeting the Miami Zoning Board adopted Resolution No. 215-82 granting the above by a six to one vote but that the item has been appealed by the planning Department. Since our previous protests as to the problems already caused - by this bar throughout our neighborhood with only a beer and wine license and our justifiable fears as to what will happen if they are allowed to sell hard liquor has had no effect on your decision, we beg you to consider the fact that they ARE closer than the permitted 2,500' required from the next two nearest bars and the appeal by the Planning Department be sustained and the variance be denied.
