OF APPROVAL OF TENTATIVE PLAT NO. 1182,

WHEREAS, the Miami Zoning Board at its meeting of November
15, 1982, Item No. 1, following an advertised hearing, adopted Re-
solution No. ZB-204-82, by a 7 to 0 vote, RFCOMMENDINC APPROVAL of
the official vacation and closure of a street, as hereinafter set
forth; and
WPERPAS, the Citv Commission deems it advisable and in
the best interest of the general welfare of the City of Miami and
its inhabitants to "rant the vacation and closure of the street
in question;
NOW TPFREFORE, BE IT RESOLVED BY TER' COrSIISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. That portion of northwest 1 Court lying South
of the South right-of-way line of Northwest 9 Street and North
of the North right-of-way line of Northwest 8 Street for a distance
of +300.9'; and N-S alley located within the distance of +300.9';
as a condition of approval of Tentative Plat No. 1182, "DORSEY HEIGHTS"
is henceforth closed, vacated, abandoned and discontinued for public
use.
PASSED AND ADOPTED this 13 day of January ,1983.

CITY COMMISSION AGENDA FOR JANUARY 13, 1983 WAS HEARD BY THE
CITY COMMISSION AS SCHEDULED. A PUBLIC HEARING WAS CONDUCTED
AND MEMBERS OF THE PUBLIC WERE PERMITTED TO MAKE STATEMENTS.
AFTER CONSIDERABLE DISCUSSION, THE CITY COMMISSION
DECIDED TO TAKE NO ACTION ON THE APPEAL BY THE PLANNING DEP-
ARTMENT OF THE VARIANCE GRANTED TO PERMIT ESTABLISHMENT OF A
LIQUOR LICENSE AT 5249 S. W. 8TH STREET.
SINCE NO OFFICIAL CITY COMMISSION ACTION WAS TAKEN, THE
DECISION OF THE ZONING BOARD WAS UPHELD AND STANDS.
THE APPLICANT FOR A LICENSE TO PERMIT THE SALE OF LIQUOR
AT 5249 S. W. 8TH STREET IS NOW LEGALLY PERMITTED TO FILE FOR
THE APPROPRIATE LICENSE.

The Zoning Board, at its meeting of December 6, 1982, Item 6, following an
advertised nearing, adopted Resolution Zia 215-82, granting a variance by a
six to one vote for the above petition with the condition of no live enter-
tainment, as per site plan on file, said establishment to be located 1,550'
(Club Trianon) and 2,130' (Sugar Shack) from established licenses (2,500'
required), zoned C-2 (Community Commercial).
Three objections received in the mail; twenty -taro proponents present at the
meeting.

a liquor licensr_ at approximately 5249 SW
The Zoning Board, by a 6-1 vote on December 6, 1982, granted
a variance to per -:it the establishment of a liquor license
at approximately 5249 Std 8th Street with the condition that
no live entertainment be included.
The Planning Department cites the following factors as forming
a basis for review by the City Commission:
1. The establishment is located 1,550' from the Club
Trianon and 2,130' from the Suclar. Shack, which hold
liquor licenses, where 2,500' is required.
2. This establishment currently holds a beer and wine
license. The Cite has no obligation to reinforce
this use through a grant of variance for a liquor
license.
3. The potential impact of an additional liquor establish-
ment on the surrounding area is important enough to have
the Conunission review the variance and establish their
policy. (Se,,3 enclosed chart for other establishments
already dispensing alcoholic beverages in the surrounding
area.)
It is requested that this item be heard on the City Commission
meeting on Planning and 'Zoning of January 13, 1983.

This variance has been brought up so many times in the past
year that we can no longer get the neighbors to take off
from work to attend the hearings.
There have been several of us present at the first few
meetings and at least one petition with 20-30 names,
addresses and phones was sent in protesting this variance.
The cards sent to us on subsequent meetings have also been
returned protesting.
Now we find that at the December 6, 1982, meeting the Miami
Zoning Board adopted Resolution No. 215-82 granting the above
by a six to one vote but that the item has been appealed by
the planning Department.
Since our previous protests as to the problems already caused -
by this bar throughout our neighborhood with only a beer
and wine license and our justifiable fears as to what will
happen if they are allowed to sell hard liquor has had no
effect on your decision, we beg you to consider the fact that
they ARE closer than the permitted 2,500' required from the
next two nearest bars and the appeal by the Planning Department
be sustained and the variance be denied.
Hoping this has more effect on your thinking than all our
previous protests, I remain,
