A RESOLUTION APPROVING THE CITY MANAGER'S
SELECTION OF LEON ROSENBLATT TO CREATE A
SERIES OF LARGE PHOTOGRAPHIC MURALS FOR
THE FIRE -RESCUE TRAINING FACILITY, FIRE
MUSEUM, LOCATED AT 3425 JEFFERSON STREET,
MIAMI, FLORIDA; AUTHORIZING THE CITY
MANAGER TO EXECUTE AN AGREEMENT, IN
SUBSTANTIALLY THE FORM ATTACHED HERETO,
BETWEEN THE, CITY AND THE ARTIST FOR A FEE
OF $15,000 UTILIZING 1981 FIRE FIGHTING,
FIRE PREVENTION AND RESCUE FACILITIES
BOND FUNDS SET ASIDE FOR SAID PURPOSES.
WHEREAS, the Arts -in -Public Places Committee, in
accordance with Sections 18-6 through 18-10 of the City Code,
submitted a report to the City Manager for his approval,
wherein the Committee recommended that the Artist, Leon
Rosenblatt, be commissioned to create a series of large
photographic murals depicting the history of Miami's fire
service for the new Fire -Rescue Training Facility, Fire
Museum, located at 3425 Jefferson Street, Miami, Florida; and
WHEREAS, the City Manager has approved said report and
has submitted it to the City Commission for discussion;
NOW, THEREFORE,, gE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The selection by the City Manager of Artist,
Leon Rosenblatt, to create a series of large photographic
murals for the new Fire -Rescue Training Facility, Fire
Museum, is hereby approved.
Section 2. The City Manager is hereby authorized to
execute an agreement, in substantially the form attached
hereto, commissioning said Artist for artistic services.
Section 3. The City Manager is hereby authorized to
expend an amount not to exceed $15,000 which has been set
aside from the 1981 Fire Fighting, Fire Prevention and Rescue
Facilities Bond sale to cover the cost of the said agreement
in conformance with Section 18-6 of the City Code.

THIS AGREEMENT made and entered into this day of
by and between the City of Miami, a Municipal
Corporation of the State of Florida, hereinafter referred to as the
"CITY", and Leon Rosenblatt, hereinafter referred to as the "ARTIST".
W I T N E S S E T H:
WHEREAS, the CITY has allocated $15,000 from the 1981 Fire
Fighting, Fire Prevention and Rescue Facilities Bond Funds for Arts -
in -Public Places, in conformance with Section 18-6 of the City
Code; and
WHEREAS, the CITY desires to commission an ARTIST to provide
certain works of art prescribed herein in connection with the Fire -
Rescue Training Facility, 3425 Jefferson Street, Miami, Florida; and
WHEREAS, the ARTIST, having examined the scope of the
services required hereunder, and having expressed his desire and
willingness to provide such services, and having presented his qual-
ifications'to the CITY in support of his expressed desires; and
WHEREAS, as a result of the aforementioned mutual under-
standings, the CITY desires to enter this Agreement with the
ARTIST; and

WHEREAS, the City Manager has been authorized by the City
Commission, by

NOW, THEREFORE, in consideration of the premises and the
mutual covenants herein contained, the CITY agrees to commission the
ARTIST and the ARTIST agrees to perform all required services in
connection with the WORK as described herein, upon the following
terms and conditions; namely:
SECTION I - DEFINITIONS
A. CITY - is hereby defined as the City of Miami, Florida.
H. CITY MANAGER - is hereby defined as the City Manager of
the CITY.

Co ARTS -IN -PUBLIC PLACES COMMITTEE is hereby defined
as the committee appointed by the City Commission under City Code
Section A-10, and referred to hereinafter as the "COMMITTEE".
D. COORDINATOR is hereby defined as the Coordinator for
this Agreement.
E. ARTIST - is hereby defined as Leon Rosenblatt, 4437 Post
Avenue, Miami Beach, Florida, 33140, (305) 674-9336.
F. WORK - is hereby defined as a series of large photographic
murals to be designed and executed by the ARTIST depicting the
history of fire service in Miami exclusively for the CITY under
commission for this Agreement.
G. LUMP SUM FEE - is hereby defined as the amount of money
that the CITY agrees to pay and the ARTIST agrees to accept as
payment in full for all artistic services rendered pursuant to this
Agreement, to complete the WORK as further described in SECTION III -
SERVICES, hereof.
SECTION II - GENERAL
A. The ARTIST and the CITY are fully aware of the time re-
quirements for this undertaking and the ARTIST will therefore proceed
with all diligence to carry out the WORK and to meet such requirements.
B. The ARTIST shall perform all required artistic services
as hereinafter set forth and'in general accordance with the instruc-
tion of the CITY.
C. The CITY agrees to pay and the ARTIST agrees to accept
as payment in full for all artistic services rendered, as outlined in
SECTION III - SERVICES hereof, the LUMP SUM FEE of FIFTEEN THOUSAND
AND N0/100 DOLLARS ($15,000.00).
SECTION III - SERVICES
The ARTIST shall perform the.following services in connection
with the WORK.
A. Works of Art - create a series of large photographic murals
incorporating historical photographs from the City of Miami Fire,
Rescue and Inspections Services Department, more recent documentary
photographs of the Department in action, as well as, some photographic
portraits of present fire rescue equipment and personnel. The
photographs will be enlarged to mural size and designed in a four
dimensional artistic and graphic design. In order to achieve the

most dramatic effect possible, the photographic images will be
processed in mono, duo and four color printing utilizing various pho-
tographic/printing techniques. The murals, whose combined surfaces
will cover an area of approximately 640 sq. ft., will range in sizes
varying from 48" x 48" to 96" x 120". There will be from 8 to 16
panels that will be mounted permanently on 1/2" thick mounting boards
and then suspended from a ceiling grid with steel or nylon cabling
with metal swivel hooks. The Artist will obtain assurances that the
color printing will be permanent.
B. General
1. Prepare a drawing or other display for presentation
and approval by the City and COMMITTEE prior to beginning the WORK.
2. Fabricate and execute the WORK into its final form
after approval by the CITY and the COMMITTEE of the preliminary
presentation.
3. Supervise and be responsible for all aspects of the
work including any transport.
4. Supervise the installation of the WORK at the Fire
Rescue Training Facility.
5. Provide and pay for all materials, labor and related
services in connection with this Agreement.
C. Preliminary Presentation
After execution of this Agreement and after receiving a
Notice to Proceed from the CITY MANAGER, meet with COMMITTEE to
review the proposed design of the murals and discuss any revisions
which will be incorporated by the ARTIST into the WORK. The Pre-
liminary Presentation shall be considered complete by the CITY when
the COMMITTEE approves the ARTIST'S concepts.
D. Execution
Upon approval of the Preliminary Presentation, begin the
undertaking of the WORK under this Agreement in accordance with the
approved concept. All materials used shall be new and free from
defects.
Execution shall be considered complete when the ARTIST
notifies the COORDINATOR that the work is ready for transport to
the site.

F. Installation
Supervise the installation of the WORK at the Fire -
Rescue Training Facility. The Artist shall be responsible for all
crating, uncrating, transportation, supervision of installation and
related activities that may be required to transport the WORK from
the ARTIST'S studio or place of execution and to supervise the
installation of same.
The installation shall be considered complete by the
CITY when the CITY accepts the WORK in place and after the ARTIST
has returned all documents loaned to him.
SECTION IV - CITY'S SERVICES
A. The CITY MANAGER will appoint a COORDINATOR who will act
as the liaison between the CITY MANAGER and the ARTIST. The ARTIST
will contact the COORDINATOR on all matters pertaining to this
Agreement and, in general, follow the COORDINATOR'S instructions and
directions in regard to the execution of this Agreement.
B. The CITY will furnish the ARTIST with photographs and
other documents that the ARTIST may require and which are available
in the CITY'S files and which pertain to the services to be performed.
It is understood that such items will be on a loan basis and that
the ARTIST will return them to the CITY prior to the time the CITY
makes final payment to the LRTIST.
SECTION V - TIME FOR COMPLETION
The ARTIST and the CITY have examined the conditions per-
taining to the execution of the WORK and have determined that a
reasonable time for its completion will be four months after the CITY
MANAGER has authorized the ARTIST to proceed with the WORK. The
ARTIST agrees to complete the WORK, therefore, on or before
SECTION VI - COMPENSATION
A. The CITY agrees to pay and the ARTIST agrees to accept
a LUMP SUM FEE OF FIFTEEN THOUSAND AND NO/DOLLARS ($15,000.00) as
payment in full for services rendered, pursuant to the WORK in
accordance with the terms and conditions of this Agreement.
B. This payment will be made periodically in proportion to
the services performed so that compensation at the completion of

certain portions of the WORK shall equal the amounts of the LUMP
SUM PEE, as shown in the following schedule of payments which shall
be made in accordance with City Code Section 18-9:

SECTION VII - INDEMNIFICATION
A. The ARTIST shall indemnify and hold harmless forever,
the CITY and all of the CITY'S officers, agents and employees from*
the following:
1. All charges or claims resulting from any and
all accidents to persons or property relating
to the ARTIST undertaking the WORK under this
Agreement.
2. Any other injury or claim arising under this
Agreement or the WORK to be performed herein,
whether sounding in tort or contract, law or
equity, patent rights or fees from the claims
relating to labor or materials furnished for
the WORK. i
B. The ARTIST shall become defendant in every suit brought
for any of the above against the CITY, or the CITY'S officials,
agents and employees. The ARTIST shall settle all such claims. The
ARTIST shall certify that he has paid or otherwise satisfied all
outstanding claims before final payment will be made to the ARTIST.
C. The ARTIST shall be held responsible for any violation
of laws or ordinances growing out of this Agreement.
SECTION VIII - SUBLETTING
The ARTIST shall not sublet, assign, or transfer any creative
WORK under this Agreement without the written consent of the CITY.
SECTION IX - AWARD OF AGREEMENT
The ARTIST warrants that he has not employed or retained any
company or person, other than a bona fide employee working solely
for the ARTIST, to solicit or secure this Agreement, and that he has

fide employee working solely for the ARTIST, any fee, commission,
percentage fee, gifts, or any other considerations, contingent upon
or resulting from the award or making of this Agreement. Pot breach
or violation of this warranty, the CITY shall have the right to
annul this Agreement without liability.
SECTION X - OWNERSHIP OF DESIGN
All designs and other data developed by the ARTIST for the
purpose of this Agreement, shall become the property of the CITY
without restriction or limitation upon their use and shall be made
available by the ARTIST at any time upon request of the CITY.
The ARTIST shall turn over to the COORDINATOR all such items
prior to final payment.
It is further agreed that the ARTIST may not duplicate the
murals at any time and that the CITY will consult the ARTIST prior
to altering or rearranging the art work.
SECTION XI - NOTICES
Any notices, reports, or other written communications from
the CITY to the ARTIST shall be considered delivered when posted to
the ARTIST at the last address left on file with the CITY, or
delivered in person to said ARTIST or his authorized representative.
SECTION XII - RIGHT OF DECISIONS
All services shall be performed by the ARTIST to the satis-
faction of the COORDINATOR who will be responsible for administration
of this Agreement and who will act on behalf of the CITY MAItAGER.
The COMMITTEE shall be the sole judge of the acceptability of the
ARTIST'S creation and the ARTIST shall abide by the COMMITTEE'S
comments as to compliance with the approved Preliminary Presentation.
SECTION XIII - ENTIRETY OF AGREEMENT
This writing embodies the entire Agreement and understanding
between the parties hereto, and there are not other agreements and
understandings, oral and written, with reference to the subject
matter hereof that are not merged herein and superseded hereby.
No alteration, change, or modification of the terms of this
Agreement shall be valid unless made in writing and signed by both
parties hereto.

This Agreement shall be governed by and construed according
to the laws of the State of Florida.

Funds in the amount of $15,000 from the 1981 Fire Fighting, Fire
Prevention and Rescue Facilities Bond sale have been set aside for
the acquisition of art for the new Fire -Rescue Training Facility,
Fire Museum.
The following is a report of the Arts in Public Places Committee's
actions in selecting an artist for the Fire -Rescue Training Facil-
ity, located at 3425 Jefferson Street, Miami, Florida. In conformance
with Section 18-9 of the City Code, a report must be submitted to the
City Commission for discussion at a regular Commission meeting on the
action proposed to be taken by the City Manager in the selection and
commissioning of an artist prior to any expenditure of funds appro-
priated for the acquisition of art for a project.
In October 1980, Chief McCullough and Architect, Amaro Tacquechel,
made a preliminary presentation to the Arts in Public Places Committee
regarding the use of the $15,000 that was set aside for the acquisition
of art for the proposed Fire -Rescue Training Facility.
The Department's and Architect's recommendation at that time was to
utilize the art funds for the area of the building that will become
the Fire Museum.
A review of the drawings of the facility and a discussion of how to
utilize art as an integral part of both design and of learning the
history of fire service in Miami followed. The Committee endorsed the
idea of using the funds in the museum area for possibly three dimen-
sional displays, collages or other art. Further discussion was
deferred until such time as the Fire, Rescue and Inspection Services
Department had finalized the program for the facility and museum area.
In September 1982, representatives from the Fire, Rescue and Inspection
Services Department and the architects for the Fire -Rescue Training
Facility appeared before the Committee to discuss the art expenditure.
The Committee was reminded of the October 1980 discussion. The
building architects, Amaro Tacquechel and Raul Alvarez, presented a
rendering of the museum area showing photographic murals suspended
from the ceiling. They recommended that the art funds be used for non-

static, suspended art, since the ceiling is 32' high and when
approaching the facility, eye level moves from the ceiling down. Due
to a limited number of exhibits initially available for the museum, the

architects recommended a form of art, preferably photography applied
to plexiglas, which would create dimension in order to deal with the
spatial aspects of the area.
The Committee endorsed the architects recommendation and requested
that three local artists known for their experience with photography,
photographic techniques and use of plexiglas be invited to the next
meeting. They further requested that the staff liaison review the
County art files for other artists to be considered.
The Committee met on October 25, 1982 at which time slides of numerous
artists obtained from the County art files were reviewed including
fiber artists, muralists, sculptors, photographers, artists working
in prisms and ceramicists, in order that the committee not preclude any
particular art medium as a possibility for this project.
Additionally, proposals from artists who had heard of the commission
were presented for Committee review.
Two local artists, at the invitation of the Committee, presented their
ideas regarding the use of suspended panels with photographs applied
to plexiglas and discussed their experience in this medium.
At the invitation of a Committee member, Leon Rosenblatt, artist, at-
tended the November 29, 1982 meeting. He proposed the use of existing
photographs, available at the Fire, Rescue and Inspection Services
Department, as the basis for the art work which would be enlarged on
panels suspended from the ceiling to historically document Miami fire
service. He stated that he would use various photographic techniques
ranging from a new 3-M scanner process to a mono, duo and four color
printing process.
Mr. Rosenblatt presented a slide show illustrating his design, graphics
and fine arts background as well as his experience in dealing with
various photographic techniques.
The Fire, Rescue and Inspections Services Department emphasized their
desire that the art work be realistic and identifiable to the primarily
young audience expected to visit the museum. They, along with the
architect, supported Mr. Rosenblatt's proposal, particularly the idea
of using existing old and new photographs as the basis for the art
work and the non -static aspect of suspended art which would create
-
dimension needed by the museum space. Furthermore, his proposal allows
for re -arrangement to accomodate any special exhibits or additional
panels.
After discussion, a majority of the Committee members supported a
recommendation that Mr. Rosenblatt be engaged for this commission, sub-

supported the use of a combination of existing old and new photographic
images and the use of varied photographic techniques.

One of the Committee members requested that the Committee defer
making a recommendation since an interested artist had contacted him
requesting an appearance before the Committee. The member felt that
this artist should be provided the opportunity to submit a proposal
for this project prior to finalizing their recommendation.
The Committee agreed to defer action and requested that the artist,
Carl Latimore, be advised by the member that the Committee intended
to recommend the use of photographic images to be suspended on panels
from the ceiling as the art form. The architect and Department staff
offered to provide drawings and a tour of the space. It was further
requested that Mr. Rosenblatt return to the next meeting with a
written proposal and budget for the project.
On December 13, 1982 the Committee re -convened for the purpose of
finalizing the selection of an artist for the Fire Museum.
Mr. Carl Latimore submitted a model proposing the use of 12, 2' x 6'
particle board panels that would be wrapped around two walls of the
museum area and that would depict the history of fire. He proposed
using photographs for the basis of the images to be painted with
acrylics.
After discussion, the three members present unanimously recommended
that the proposal submitted by Mr. Leon Rosenblatt be submitted to
the City Manager for approval. The Fire Rescue and Inspections
Services Department as well as the building architect supported the
Committee's recommendation.
The Committee recommends that the City Manager accept their recommen-
dation that Mr. Rosenblatt be engaged for this art commission.
Attached is a copy of a written proposal and budget submitted by
Mr. Rosenblatt. Please note that most of the funds will be utilized
for materials, labor and installation and that the artist has agreed
to accept a modest fee for his artistic services.

the addition of new panels.
