WIIEREAS, the Miami Planning_ Advisory Boar(I, at i t S 1110etin0 of October 20, 1982, Item 6, following an advertised hearing, adopted Resolution No. PA13 68-82 by a 5 to 0 vote, RECOMMENDING; APPROVAL of an amendment to Ordinance No. 9500; and WHEREAS, the City Commission after careful consideration of this inatter, deems it advisable and in the best interest of the general welfare of the City of Miami and its inhabitants to grant this amendment, as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Ordinance No. 9500, (effective April 6, 1983), the Zoning Ordinance of the City of Miami, Florida, is hereby amended by amending Article 16 of said Ordinance entitled "HC: HERITAGE CONSERVATION DISTRICTS"; more particularly by adding a new "SECTION 1610: HC-1: GENERAL USE HERITAGE CONSERVA- TION OVERLAY DISTRICT"; providing for intent, effect, and requirements for certificates of appropriateness, to read as follows:l ARTICLE 15. REQUEST: To create a new zoning overlay district, HC-1, that can be applied to historic sites City-v.,ide. BACKGROUND: The General Provisions for "I -IC", heritage Conser- vation Districts were adopted by Ordinance No. 9425 on May 27, 1982. These general provisions allow for the creation of an unlimited number of individual HC zoning districts, to be labeled HC-1, H C-2, 11C-3...etc., as necessary to provide special zoning regulations for qualified historic sites, historic districts, and archeological zones. ANALYSIS: The proposed HC-1: General Use heritage Conserva- tion Overlay District is intended for application on historic sites which do not require any special modification of existing zoning regulations in order to promote historic preservation. The only effect of the HC-1 overlay would be to require a Certificate of Appropriateness for all future alteration, now construction or demolition on the property.
