WIIEREAS, the Miami Planning_ Advisory Boar(I, at i t S 1110etin0
of October 20, 1982, Item 6, following an advertised hearing,
adopted Resolution No. PA13 68-82 by a 5 to 0 vote, RECOMMENDING;
APPROVAL of an amendment to Ordinance No. 9500; and
WHEREAS, the City Commission after careful consideration of
this inatter, deems it advisable and in the best interest of the
general welfare of the City of Miami and its inhabitants to grant
this amendment, as hereinafter set forth;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY
OF MIAMI, FLORIDA:
Section 1. Ordinance No. 9500, (effective April 6,
1983), the Zoning Ordinance of the City of Miami, Florida, is
hereby amended by amending Article 16 of said Ordinance entitled
"HC: HERITAGE CONSERVATION DISTRICTS"; more particularly by
adding a new "SECTION 1610: HC-1: GENERAL USE HERITAGE CONSERVA-
TION OVERLAY DISTRICT"; providing for intent, effect, and
requirements for certificates of appropriateness, to read as
follows:l

This district is intended to carry out the intent
and ur.)oses of FIFRITAGE CONS FRVATION ZONING DISTRICTS
as setforthin^Section 1.600, for al.if:ied historic
sites -which are in ',jovernmental nr institutional use,
or which do not re( Lire special modifications oC the
underlying zoning- di.strict_in order -to assure-preser.va-
tion of significant -historic features.
SECTION 1610.2 EFFECT OF HC-1 OVERLAY
The HC_1 Overlay_ district shall have the effect n1
modifying requirements and procedures applying in
existing zoning districts indicated in the Official
Zoning Atlas, or zoning districts hereafter created and
remaining after the HC-1 overlay district is suner-
imposed, to the extent ovided herein. All zoning
requirements, regulations, and procedures not �peci-
fically_modified by the HC-1 overlay shall remain in
full force and effect.
SECTION 1610..3 CERTIFICATES OF APPROPRIATENFSS
All applicable actions within the HC-1 overly
district shall be subject to the requirements, proce-
dures, and guidelines for Certificates of_ Ap2ropriate-
ness, as set forth in Section 1605."
Section 2. The Zoning Atlas made a part of said
Ordinance No. 9500, by reference and description in Article 3,
Section 300, thereof, is hereby amended to reflect any changes
made necessary by the amendments.
Section 3. That all ordinances, code sQcti(-)ns or ;arts
thereof in conflict herewith are hereby repealed insofar as they
are in conflict.

for Certificates of Appropriateness.
REQUEST: To create a new zoning overlay district, HC-1,
that can be applied to historic sites City-v.,ide.
BACKGROUND: The General Provisions for "I -IC", heritage Conser-
vation Districts were adopted by Ordinance No.
9425 on May 27, 1982. These general provisions
allow for the creation of an unlimited number of
individual HC zoning districts, to be labeled
HC-1, H C-2, 11C-3...etc., as necessary to provide
special zoning regulations for qualified historic
sites, historic districts, and archeological
zones.
ANALYSIS: The proposed HC-1: General Use heritage Conserva-
tion Overlay District is intended for application
on historic sites which do not require any special
modification of existing zoning regulations in
order to promote historic preservation. The only
effect of the HC-1 overlay would be to require
a Certificate of Appropriateness for all future
alteration, now construction or demolition on
the property.
