Miami and its inhabitants to grant this amendment as hereinafter set forth; NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Ordinance No. 6871, as amended, the Com- prehensive Zoning Ordinance for the City of Miami, is hereby amended by amending ARTICLE III - ZONING DISTRICTS, SECTION 1-CLASSES AND SYMBOLS, to read as f_ollows:l ARTICLE III. - ZONING DISTRICTS Section 1. - CLASSES AND SYMBOLS SYMBOL, RESIDENTIAL DISTRICTS R-1 One -Family Dwelling 1 Words and/or figures stricken through shall be deleted. Said Ordinance No. 6871. is fit-?rehy Eurther amen6ed by adding a new Article XXI-10 (HC-1) General Use Heritage Conservation Overlay District; providing for intent, effect, and requirements for Certificates of Appropriateness, to read as follows: "ARTICLE XX1-10 HC-I-GENERAL UST !iERITAGE CONSERVATION OVERLAY DISTRICT _ SECTION 1: INTI'NT This district is intended to carr.y out the intent andrposes of HERITAGE CONSERVATIONZONINGDIS'PRICTS asset forth in the GENERAL PROVISIONS, Article IV, Section 46, for _qualified _historic _sites which -are in governmental or institutional -use, or which do not require special modifications of the underlying zoning district in order to assure preservation of significant historic features. SECTION 2.: EFFECT The HC-1 overlay district shall have the effect of modifying requirements and procedures applying in existinq zoning districts, or zoning districts here- after created and remaining after the HC-1 overlay district is superimposed, to the extent provided herein. _ All zoning requirements, regulations, and procedures not specifically_modif_ied kby_ the HC-1 overlay shall remain in full -force-and effect. BACKGP.GU'D: The General Provisions for "IIC", Heritage Conser- vation Districts were adopted by Ordinance No. 9425 on May 27, 1982. These general provisions allow for the creation of an unlimited nuriber of individual IJC zoning districts, to be labeled IJC-1, I1C-2, HC-3... etc., as necessary to provide special zoning regulations for qualified historic sites, historic districts, and archeological zones. ANALYSIS: The proposed I1C-1: General Use Ieritage Conserva- tion Overlay District is intenOOd for application on historic sites which do not require any spacial modification of existing zoning regulations, in order to promote historic pre:lervati.on. The only effect, of the IJC-1 overlay would be to require a Cert.ificatc of Appropriateness for all future alteration, now construction or demolition on the property.
