REPEALING ALI, ORDINANCES, CODE SECTIONS OR
PARTS THEREOF IN CONFLICT AND CONTAINING A
SEVERABILITY CLAUSE.
[•FEREAS, the Miami Zoning Board at its meeting of
November 1, 1982, Item No. 1, following an advertised hearing,
adopted Resolution No. ZB 194-82, by a 6 to 0 vote RECONTMFTIDING
APPROVAL of a change of zoning classification as hereinafter set
forth; and
I.n'LEREAS, the City Commission after careful considera-
tion of this matter, deems it advisable and in the best interest
of the welfare of the City of Miami and its inhabitants to grant
this change of zoning classification as hereinafter set forth;
NOW, TI'EREFORT , BF IT ORDAINED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. Ordinance No. 6871, as amended, the Compre-
hensive Zoning Ordinance for the City of Miami, be and the same
is hereby amended by changing the zoning classification of the
northerly 293.63' of Lot 6 and the northerly 398.47' of Lot 7,
TROPICAL TRADES CO. STATION "A" (4-6), being approximately 3665-71
Northwest 7 Street and approximately 821-899 Northwest 37 Avenue
from R-4 (Medium Density Multiple Dwelling) to C-1 (Local Commercial);
and by making all the necessary changes in the zoning district map
made a part of said Ordinance No. 6871, by reference and description
in Article III, Section 2, thereof, by repealing all Ordinances,
Code Sections, or parts thereof in conflict, and containing a sever -
ability clause.

Section 2. That all Ordinances, Code Sections, or
parts thereof in conflict herewith be and the same are hereby
repealed insofar as they are in conflict.
Section 3. Should any part or provision of this Or-
dinance be declared by a court of competent jurisdiction to be
invalid, the same shall not affect the validity of the Ordinance
as a whole.

PLANNING DEPT. Denial. Although the proposed change of zoning
to C-2 is less liberal than the previous request
of C-4, the Planning Department still believes
that a commercial use is inappropriate in the

residential. Thus, essentially the same reasons

REQUEST Change of Zoning to C-4 (General Commercial).
RECOMMENDATIONS
PLANNING DEPT. DENIAL. The Planning Department recommends
d—eniaT-of the proposed zoning change based on
the following reasons.
a) a change from R-4 to C-4 Ts too drastic -
the potential usage is to liberal and the
intensity permitted much too high;
b) the change would result in an illogical
boundary line which would create two
isolated R-4 districts: One to the east
of the property and a smaller in the SW
corner of the property;
c) the change would alter population density
and would contribute to further traffic
and pedestrian congestion along 37th Avenue;
d) the change will be in conflict with adopted
City Comprehensive plans. The plan provides
for medium density residential development;
e) the change to liberal commercial uses
permitted by the C-4 district will adversely
affect neighborhood conditions to the north
and east of the site which is all zoned
residential;
f) the change would constitute a grant of
special prvilege to an individual owner
as contrasted with the public benefit and
weIfare .
The Planning Department recommends as an alternate
solution the granting of a conditional use for
the R-4 portion of the property into Hotel and/or
Mote Development, while the rest of the site
existing under C-4 is developed into offices.
The cross parking and access easements could
still be considered.

DECLARATION OF RESTRICTIVE COVENANTS
This Declaration of Restrictive Covenants Running with the
Land ("Declaration") is made and entered into this lstday of No-
vember, 1982 by PACASA N.V., a Netherlands Antilles corporation
("Ou-ner") and by MAN= GARCIA, as representative of property
owners within 375 feet of 0w-ner's property to be herein defined.
BACKGROUND FACTS
The Owner holds fee simple title to the Property described
in E%hibit "A" attached hereto and made a part hereof t " ( Proper y
Owner has applied to the City of Miami ("City") to rezone
the Property to C-1 under the City of tiiami Zoning Code.
Owner desires to offer certain assurances to the owners of
properties within 375 feet of the Property ("Neighbors") and to
the City, that if the Property is developed unde the C-1 classifi-
cation, Owner will buffer the Property to reduce any adverse impacts
to Neighbors and will limit certain uses thereon.
The Owner recognizes and acknowledges that the Covenants
listed below are offered as a benefit to the public health, welfare
and safety.

Owner hereby agrees and covenants as follows:
1. That if the Poperty is rezoned to C-1, Owner will provide
a landscape buffer and a wall or planters of no less than 5 feet in
height to run along the North Property line. Said landscape buffer
and wall or planters shall have a driveway opening which may be used
as a service drive, and shall be clearly designated whereby, only
left turns will be permitted to those exiting the driveway.
2. That the landscape buffer will be maintained in a good
and healthy condition.
3. That if the Property is zoned C-1, the following C-1 uses
described below shall not be permitted thereon:
1. Clubs or Lodges, Fraternal or Religious Associations.
2. Parking lots and parking garages. (ORD.8066)

Homes and Nur s in Homes.
4. Employment Office. (ORD.7310)
5. Coin Operated Laundries.
6. Automobile and boat repair, service and
maintenance facilities.

8. Amusements Events, Temporary. (ORD.7267)
9. Educational Institutions of a business, professional
or scientific nature. (ORD . 7310)
10. Gun Shops and Shooting Galleries.
Furthermore, in order to avoid certain uses that are in
violation of the C-1 classification and, because said uses have been
specifically designated as highly offensive by the Neighbors, the
Owner shall not permit the establishment and operation of any kind
of wholesale stores, and specifically the following wholesale stores:
1. Fruit and Vegetables.
2. Grocery.
3. Hardware.
4. Meat Market or Delicatessen.
4. These covenants shall be covenants running with the land
and shall be binding upon 0w:-ner, Owner's successors in title and
assigns and shall inure to the benefit of and be enforceable by all
owners of property within 375 feet of the Property.
5. This Declaration shall be in effect for a period of
THIRTY (30) years from the date the documents are recorded in the
Public Records of Dade County, Florida, after which time they shall
be extended automatically for successive periods of TES' (10) years
unless released, modified or amended as provided below.
6. This Declaration may be released, modified or amended as
to all or any portion of the Property by a Britten instrument approved
after a public hearing by Resolution of the Board of City Commissioners
or the Zoning Board of the City, whichever, by lay:, has jurisdiction
over the subject matter.

7. This Declaration is enforceable by the City or by any
owner of property within 375 feet of the perimeter of the Property,
by action at law or In equity with costs anG reasorable attorneys
