HomeMy WebLinkAboutR-83-00979 RESOLUTION NO. 803-97: A RESOLUTION WAIVING THE REQUIREMENTS AND PROHIBITION CONTAINED IN CITY CODE SECTION 2-302; AUTHORIZING THE CITY ATTORNEY TO ENGAGE THE LEGAL SERVICES OF TERRY V. PERCY, PRIMARILY IN CONNECTION WITH THE MIAMI CONVENTION CENTER PROJECT, FOR SUCH PERIODS OF TIME AS NEEDED, IN THE DETERMINATION OF THE CITY ATTORNEY, AT A FIXED HOURLY RATE; ALLOCATING MONIES THEREFOR FROM PREVIOUSLY APPROPRIATED FUNDS. WHEREAS, Deputy City Attorney Terry V. Percy resigned from City of Miami employment on January 14, 1983 after many years of faithful and effective service; and WHEREAS, the City of Miami has a vital interest in the ongoing successful operation of the Miami Convention Center Project; and WHEREAS, Mr. Percy has been involved with this Project for several years preceding his departure from office; and WHEREAS, it is to the best interest of the City that this Project involvement by Mr. Percy be preserved, continued and maintained. I NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY I OF MIAMI, FLORIDA: Section 1. The authorization set forth in Section 3 hereof is based upon the following findings by four -fifths of the members of the City Commission: (a) The services of Terry V. Percy are unique in character as they relate to certain pending Capital Improvement Projects of the City of Miami which projects will be the primary object of his services when he is called upon by the City Attorney. (b) The City of Miami cannot avail itself of such services without authorizing the herein proposed relationship which would be in violation of City Code Section 2-302 were there not a waiver of the requirements and the prohibition contained in said Section 2-302. (c) The herein proposed relationship will be to the best interest of the City of Miami. CITY COMMISSION MEETING OF F E B 10 1983 RQI = ............................ Based upon the findings set Forth in Section 1 hereof, the requirements and prohibition contained in Section 2-302 of the City Code are hereby waived. Section 3. The City Attorney is hereby authorized to engage the professional legal services of Terry V. Percy, primarily in connection with the Miami Convention Center Project for such periods of time as needed, in the determination of the City Attorney; said Terry V. Percy to be compensated for such services at the hourly rate of $90.00, said monies being hereby _ allocated from funds previously appropriated for the Miami Convention Center Project. Percy, Former Deputy City Attorney Jose R. Garcia -Pedrosa City Commission Meeting City Attorney February 10, 1983 Due to former Deputy City Attorney Terry V. Percy's exten- sive involvement in the Miami Convention Center Project for several years preceding his departure from the City Attorney's Office and because of the City's vital interest in the ongoing successful operation of this Project, the City Manager has recommended that Mr. Percy's involvement be preserved and maintained. The attached Resolution will enable the City to engage the legal services of dr. Percy on as -needed basis primarily in connection with the Miami Convention Center Project. The autho- rization, if approved, will ,call for remuneration of Mr. Percy at an hourly rate of $90.00 and such funds are available in the Convention Center Project funds. The original of this resolution is being sent to the City Clerk together with a public notice for publishing by him no later than February 3, 1983.
