AN EMERGENCY ORDINANCE ESTABLISHING A NEW
TRUST AND AGENCY FUND ENTITLED "MIAMI
GRAND PRIX" FOR IMPLEMENTATION IN FISCAL
YEAR 1982-83 FOR THE PURPOSE OF PROVIDING
AN ACCOUNTING SYSTEM TO REIMBURSE THE
CITY FOR COSTS INCURRED IN THE STAGING OF
AN AUTO RACE ON FEBRUARY 26-27, 1983
WITHIN THE CITY OF MIAMI; WITH AN
APPROPRIATION THEREFOR OF $140,815 FROM
REVENUES TO BE COLLECTED FROM MIAMI
MOTORSPORTS, INC.; CONTAINING A REPEALER
PROVISION AND A SEVERABILITY CLAUSE.
WHEREAS, on February 11, 1982, the City Commission
passed Motion No. 82-81, approving the holding of an
automobile racing event; and
WHEREAS, an agreement was executed on June 14, 1982 to
grant the license and privilege to conduct auto races in
downtown Miami; and
WHEREAS, the license agreement provides that the
Licensee will reimburse the City for personnel, materials or
supplies which are required in the staging of the race; and
WHEREAS, the Licensee also agreed to provide for all
expenses incurred by the City subject to interest charges at
current prime rate, compornded daily, in providing emergency
police, fire, sanitation, or other services pertaining to the
staging of the race; and
WHEREAS, an estimate has been prepared which indicates
appropriations in the amount of $140,815 will be necessary to
cover the anticipated expenditures of the City in staging the
race which will be held February 26-27, 1983; and
WHEREAS, establishment of a Trust and Agency Fund is
necessary to properly allocate funds;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. The following Trust and Agency Fund is
hereby established and anticipated resources are hereby
appropriated as described herein:

Section 2. The herein Trust and Agency fund is established
for the purpose of providing an accounting system to
reimburse costs incurred by the City in staging an auto race
on February 26-27, 1983 within the City of Miami.
Section 3. All ordinances or marts of ordinances
insofar as they are inconsistent or in conflict with the
provisions of this ordinance are hereby repealed.
Section 4. If any section, part of section, paragraph,
clause, phrase or word of this ordinance shall be held to be
invalid, the remaining provisions of this ordinance shall not
be affected.
Section 5. The requirement of reading this ordinance on
two separate days is hereby dispensed with by an affirmative
vote of not less than four -fifths of the members of the
Commission.
Section 6. This ordinance is hereby declared to be an
emergency measure on the grounds of urgent public need for
the preservation of peace, health, safety and property of the
City of Miami and upon the further ground of the necessity to
make the required and necessary payments to its employees and
officers, payment of its debts, necessary payments to its
employees and officers, payment of its debts, necessary and
required purchases of goods and supplies and to generally
carry on the functions and duties of municipal affairs.

This item was distributed unapproved in the form of an ordinance
whose second reading was to be dispensed with by a 4/5th's vote
of the City Commission, although the printed Agenda topic
correctly describes the ordinance as an emergency ordinance.
The attached approved ordinance (J-83-48) has been prepared as an
emergency ordinance and the original is being forwarded to the
City Manager's Office.

It is recommended that a Trust
and Agency Fund be established
in the amount of $140,815 for
the Miami Grand Prix and that
appropriation of funds be
made for the attached Ordinance.
The City Commission passed on February 11, 1982, Motion 82-81
approving the holding of the automobile race event and on
March 11, 1982 authorized the City Manager to negotiate an
agreement which was executed June 14, 1982 which granted a
license to Miami Motorsports, Inc. to conduct the race.
- The agreement provides that the Licensee will reimburse for
all expenses incurred by the City required to stage the event,
subject to interest charges at the current prime rate, compounded
daily.
It is recommended that a Trust and Agency Fund be created and
appropriations in the amount of $140,815 be adopted which will
be reimbursed by the promoter.
