WHER.E,AS, the City Commission conclucted public hearings on Decemi:)er 1, 1981, and December 15, 1981, at Rayfront Park Auditorium to receive pul-)Iic comment on the New Zoning �i0rdinance; all City property owners hei.ng notitied by letter of the hear- ings; and WHEREAS, the City Commission wishes to encourage the orderly growth and development of the City nf Miarni through appropriate and efficiently implemented land use controls; and _ WHEREAS, Ordinance No. 9500, the tiew Zoning Ordinance for the City of Miami, Florida, was passed on first reading by title only July 29, 1982, and was passed and adopted on second and final reading by title only subject to an effective date one hundred and eighty days (180) after receipt of acknowledgment that Ordinance No. 9500 had been filed with the Secretary of State; and WHEREAS, the Secretary of State's acknowledgment was received by the City of Miami on October_ 8, 1982; and WHEREAS, additional time is needed to effectuate a smooth transition from the existing Comprehensive Zoning Ordinance to the New Zoning Ordinance (Ord. No. 9500); WHEREAS, the City Commission, after careful consideration of this matter, deems it: advisable and in the hest interest of the general welfare of the City of Miami and its inhabitants to approve this Ordinance as hereinafter set forth; NOW, THEREFORE, BF IT ORDAINED BY THE COMMISSION OF '1'HE CITY OF MIAMI, FLORIDA: Section ].. Ordinance No. 9500, the New Zoning Ordinance for the City of Miami, Florida, is hereby amended by delaying its effective data for an additional twenty-fi.ve (25) davF, from its previous effective date of April 6, 1983. Section 3. That all Ordinances, Code Sections, or parts thereof in conflict herewith are hereby repealed insofar as they are in conflict. Section 4. Should any part of provision of this nrdi- nance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the Ordinance as a whole. The existing effective date of new Zoning Ordi":ance 9500 is April 6, _ 1983. The Planning Department will offer a package of amendments to the Ordinance and to the City Code for first reading on February 24; second reading on March 24 which would normally hake a 30-day effective date or April 23, 1983. Ther.e.`_ore, a potential zoning "gap" would e.:ist for a 17-day period. In an abundance of caution, it is recoi,i- mended that this gap be closed by delaying the effective date of new Zoning Ordinance 9500 to May 1, 1983, and extending the provisions of Comprehensive Zoning Ordinance 6871 until that time.
