A RESOLUTION OF THE MIAMI CITY COMMISSION TO INITIATE THE CONFLICT
RESOLUTION PROCEDURES OF CHAPTER 164, FLORIDA STATUTES, PRIOR TO
INITIATING COURT PROCEEDINGS OR PROSECUTING ACTION ON A
PREVIOUSLY FILED COURT PROCEEDING, TO RESOLVE A CONFLICT BETWEEN
THE CITY OF MIAMI AND MIAMI-DADE COUNTY REGARDING RESTRICTING CUT-
THROUGH VEHICULAR TRAFFIC AT SOUTHWEST 23RD STREET AT ITS
INTERSECTIONS WITH SOUTHWEST 14TH AVENUE, SOUTHWEST 16TH
AVENUE, SOUTHWEST 16TH COURT, AND SOUTHWEST 17TH AVENUE.
WHEREAS, the Silver Bluff area has historically experienced increasing cut-through
traffic, particularly near Southwest 17th Avenue in the areas closest to both South Dixie

WHEREAS, this cut-through traffic causes noise, gridlock, and increased accidents
negatively affecting life and property in addition to general misery for the residents of the area;
and
WHEREAS, the City Commission wishes to restrict vehicular cut-through traffic to
address this long-standing problem; and
WHEREAS, in January 2021, the City Commission directed the City Manager to place
temporary barriers to restrict cut-through vehicular traffic at Southwest 23rd Street at its
intersections with Southwest 14th Avenue, Southwest 16th Avenue, Southwest 16th Court, and
Southwest 17th Avenue; and
WHEREAS, after the placement of the temporary barriers in March 2021, Miami-Dade
County filed suit in Miami-Dade County v. City of Miami, Case No. 2021-5408-CA-01, and
sought injunctive relief to lift the temporary barriers; and
WHEREAS, after a hearing held on June 2, 2023, the City lost the injunction but wants
to discuss the life safety concerns with the County Commission; and
WHEREAS, Chapter 164, Florida Statutes (the Florida Governmental Conflict Resolution
Act), requires that certain disputes between governmental entities be submitted for conflict
resolution prior to initiating court proceedings or prosecuting action on a previously filed court
proceeding; and
WHEREAS, the City has a conflict with the County covered by Chapter 164, Florida
Statutes; and
WHEREAS, the issues of conflict are protecting the public health, welfare, and safety of
-through vehicular traffic at Southwest 23rd Street at its
intersections with Southwest 14th Avenue, Southwest 16th Avenue, Southwest 16th Court, and
Southwest 17th Avenue; and
WHEREAS, in order to initiate the conflict resolution process under Chapter 164, Florida
Statutes, the City is required by resolution to state its intention to initiate the conflict resolution
procedures and send the resolution to the chief administrator of the County;
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF
MIAMI, FLORIDA:
Section 1. The recitals and findings contained in the Preamble to this Resolution are
adopted by reference and incorporated as fully set forth in this Section.
Section 2. It is the intention of the Miami City Commission to initiate the conflict
resolution procedures of Chapter 164, Florida Statutes, prior to initiating court proceedings or
prosecuting action on a previously filed court proceeding against the County.
Section 3. Within five (5) days from the passage of this Resolution, the Resolution shall
be provided to the chief administrator of the County in compliance with Chapter 164, Florida
Statutes.
Section 4. This Resolution shall become effective immediately after adoption.
