The Planning Department recommends denial for the following reasons: 1) The proposed change is an encroachment into an R-1 residential neighborhood; granting the change would create a dangerous precedent for rezoning the rest of the area and would constitute a grant of special privilege to an individual owner. 2 ) The proposed change is not in conformity with the adopted City of Miami's Comprehensive plan. AN ORDINANCE ATTENDING ORDINANCE NO. 6871, AS AMETIDED, THE COTTPREIIENSIVF ZONING ORDINANCE FOR TiIF CITY OF MIAMI, BY CHANGING THE ZONING CLASSIFICATION OF LOTS 3 AND 4, BLOCK 1, BROOK- LAWId (12-32), BEING APPROXIMATELY 2169 SOUTH- 1JF.ST 12 STREET AND 2177 SOUT1117.ST 12 STREET FROM R-1 (OTIE-FAMILY DWELLING) TO R-2 (TWO FAMILY DWELLING) ; AND BY MAKING TiIF NECESSARY CHANGES IN THE ZONING DISTRICT MAP MADE A PART OF SAID ORDITIAaCE 140. 6871, BY REFER£NC£ AND DESCRIPTION ITT ARTICLE III, SECTION 2, THEREOF, BY REPEALING ALL ORDINANCES, CODE SECTIONS, OR PARTS THEREOF IN CONFLICT AND CONTAINING A SFVERABILITY CLAUSE. Ordinance No. 6871, as amended, the Comprehensive Zoning Ordinance�of'the City of Miami, is herebv amended by chang- ing the zoning cl,a�sslification of Lots 3 and 4, Bloch: 1, BROOKLAI-711 y (12-32); being apy imately 2169 and 2177 Southwest 12th Street from R-1 (One Family Dwelling) to R-2 (Two -Family Dwelling); and by making all the necessary changes in the Zoning District Map made a part of said Ordinance I. -To. 6871, by reference and descrip- tion in Article III, Section 2, thereof. Section 2. That all Ordinances, Code Sections, or Parts thereof in conflict herewith be and the same are hereby repealed insofar as they are in conflict. Section 3. Should any part or provision of this Ordinance be declared by a court of competent jurisdiction to be invalid, the same shall not affect the validity of the Ordinance as a whole.
