J-83-196 RESOLUTION NO. 83--wG5 A RESOLUTION GRANTING A ONE YEAR EXTENSION OF A VARIANCE AS LISTED IN ORDINANCE NO. 6871, ARTICLE XI-4, SECTIONS 5(4)(b), 6(1), 7(1), AND 8(2), TO PERMIT CONSTRUCTION OF AN OFFICE BUILDING ON LOTS 2, 3, 4, AND 5 LESS THE E 30' AND LOT 6 LESS THE E 30' OF THE S 101, CHARLES M. MUNDY'S SUBDIVISION OF LOT "A" (3-120); LOCATED AT APPROXIMATELY 2922-24 SOUTHWEST 27TH AVENUE, AS PER PLANS ON FILE, ZONED R-CC (RESIDENTIAL OFFICE) AND SPD -2 (COCONUT GROVE SPECIAL OVERLAY DISTRICT). WHEREAS, Article XXXI, of the Comprehensive Zoning Ordinance No. 6871, permits an extension of a variance by the City Manager with approval of the City Commission, for a one year period; and WHEREAS, the City Manager recommends the extension of the variance granted by Zoninq Board Resolution No. ZB-190-82; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The request for a one year extension of a variance granted from Ordinance No. 6871, Article XI-4, Sections 5(4)(b), 6(1), 7(1), and 8(2), to permit construction of an office building on Lots 2, 3, 4, and 5 less the E 30' and Lot 6 less the E 30' of the S 10', Charles M. Mundy's subdivision of Lot "A" (3-120); located at approximately 2922-24 Southwest 27th Avenue, as per plans on file, Zoned R-CC (Residential Office) and SPD-2 (Coconut Grove Special Overlay District) is granted. March 9, 1983 FILE REQUEST FOR EXTENSION OF TIME VARIANCE 2922-44 SW 27 AVENUE COMMISSION AGENDA - MARCH 24, 1983 PLANNING AND ZONING ITEMS "It is recommended that a request for an extension of time for the Variance granted at - W 27 Avenue Fe approved." The Zoning Board, at its meeting of October 18, 1982, Item 12, following an adver- tised hearing, granted the request for a Variance to permit construction of an office building at 2922-44 SW 27 Avenue by adopting Resolution ZB 190-82 by a 6 to 1 vote. The Variance shall expire April 18, 1983 and an extension of time for a period of one year may be granted if substantial progress has been achieved by the applicant in terms of project planning and subject to approval of the City Commission. The Planning Department has no•objection to the granting of the extension for this Variance although the Department recommended denial of the Variance. We are requesting the City Attorney's Office, by copy of this memo, to prepare the proper Resolution for this extension. REQUEST Variance to permit construction of an office building on above site, as per plans on file, with a proposed 6' wall following the parking deck profile (6' masonry wall along property line required), a proposed 48' height for the office structure (40' allowed), a proposed 35.6°: (12,958.40 sq.ft.) lot coverage (25`, (9,100 sq.ft.) allowed) and a proposed 1.131 floor area ratio (F.A.R.) (0.60 F.A.R. permitted). RECOMMENDATIONS PLANNING DEPT. DENIAL. There is no hardship to justify the requested variances. This project was previously approved, on a smaller site, with variances which are being exceeded by this application. Although amendments to the R-CC district were being proposed, the previously approved variances and the eminent adoption of the new zoning ordinance eliminated the -necessity of the amendments. Therefore, the requested variances should be denied and development should proceed under the new zoning ordinance without variances. In accordance with the instructions in that letter, please consider this letter a request that the use granted in Resolution #190-82, approved on October 18, 1982, be extended for a period of one year. This project is moving forward very rapidly. We are currently completing the final architectural plans in accordance with that approval; and we have applied for construction/permanent financing with a local lender with whom we are currently finalizing our Letter of Commitment. As this is a major project in the several million dollar range, I am sure you can understand the need for the additional time. We believe that we have made and are making substantial progress in terms of bringing this project to fruition. If you would like a copy of the construction plans in progress or any other documentation, please let me know. We will furnish whatever is appropriate.
