S3-2%8 A RESOLUTION GRANTING A ONE YEAR EXTENSION OF A VARIANCE AS LISTED IN ORDINANCE NO. 6871, ARTICLE XXIII, SECTIONS 4(23)(24) AND (25), TO PERMIT ADDITIONS TO THE EXISTING TWO STORY BUILDING (A/K/A THE I CHING BUILDING); BEING A PORTION OF BLOCK 14, EDWARD PENT HOMESTEAD (A-45) AS DESCRIBED BY THE METES AND BOUNDS DESCRIPTION ON FILE WITH THE PLANNING AND ZONING BOARDS ADMINISTRATION DEPARTMENT, LOCATED AT 3033-35 GRAND AVENUE, AS PER PLANS ON PILE; TO ALLOW A RESTAURANT, OFFICES, AND RETAIL USES, ALL IN ACCORDANCE WITH THE CONDITIONS SET FOR PROPERTIES IDENTIFIED BY THE CITY COMMISSION AS HISTORIC STRUCTURES, AND PROVIDING 0 OF 58 REQUIRED OFF-STREET PARKING SPACES; ZONED C-2A (SPECIAL COMMUNITY COMMERCIAL). WHEREAS, Article XXXI, of the Comprehensive Zoning Ordinance No. 6871, permits an extension of a variance by the City Manager with approval of the City Commission, for a one year period; and WHEREAS, the City Manager recommends the extension of the variance granted by Zoning Board Resolution No. ZB-153-82; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The request for a one year extension of a variance granted from Ordinance No. 6871, Article XXIII, Sections 4(23)(24) and (25), to permit additions to the existing two story building (a/k/a the I Ching Building); being a portion of Block 14, EDWARD PENT HOMESTEAD (A-45) as described by the metes and bounds description on file with the Planning and Zoning Boards Administration Department, located at 3033-35 Grand Avenue, as per plans on file; to allow a restaurant, offices, and retail uses, all in accordance with the conditions set for properties identified by the City Commission as historic structures, and providing 0 of 58 required off-street parking spaces; zoned C-2A (Special Community Commercial) is granted. The Zoning Board, at its ineeting of September 20, 1982, Item 3, following an advertised hearing, granted the request for a Variance to permit additions to the existing two-story building (A/K/A The I Ching Building) located at 3033-35 Grand Avenue by adopting Resolution ZB 153-82 by a 7 to 0 vote. The Variance shall expire on March 20, 1983 and an extension of time for a period of one year may be granted if substantial progress has been achieved by the applicant in terms of project planning and subject to approval of the City Commission. The Planning Department has no objection to the granting of the extension of this Variance. We are requesting the City Attorney's Office, by copy of this memo, to prepare the proper Resolution for this extension. RECO!•111ENDATIONS PLANNING DEPT. APPROVAL. The I Ching building has been designated by the National Register of Historic Places and by the Heritage conservation Interim Zoning Ordinance (No. 9317) as a historic structure which should be preserved. The proposed construction abides by all the requirements of the zoning designa- tion - C-2A enhancing the interrelationship between retail commercial land uses and pedestrian activity. In order to preserve the historic building, a trade- off has to occur in which the property owner can derive an economic gain from the preservation, so that no hardship is imposed on him. This trade off consists of a development bonus in the F.A.R. and a waiver for the required number of parking spaces. PUBLIC WORKS No dedication is requested. At the September 20, 1982 meeting of the Zoning Board of the City of Miami, the Board approved Resolution Z13153-82, granting a variance from Ordinance 6871, Article XXIII, S§4(23)(24) and (25) in connection with the above -referenced property. It•is my understanding that the approval of this Variance will expire on March 20, 1983 unless a building permit based upon and incorporating the variance is obtained on or before that date. GARY, City Manager January 31, 1983 Page Two For this reason, I must respectfully request, on behalf of the property owner, that the date upon which the variance would otherwise expire be extended for one year in order to allow the property owner to proceed with the restoration and rennovation of this property in accordance with the plans previously submitted to the Planning Department, the Urban Development Review Board and, the Heritage Conservation Board. I have enclosed for your information photocopies of the subject Resolution, and the letter of November 17, 1982 from the Director of the Planning and Zoning Board's Administration Department. PLEASE NOTE THAT THIS APPROVAL WILL EXPIRE ON MARCH 20, 1983 unless a building permit based upon and incorporating the variance is obtained within this six (6) months period, or unless the provisions of the variance are adhered to within the aforesaid six (6) months period. The expiration of this approval may be extended for a period of up to one (1) year by the City Manager if after review it is determined that substantial progress has been achieved by the applicant in terms of project planning, and subject to approval of the City Commission. This request for extension must be received by the Director of the Planning and Zoning Boards Administration Department no less than thirty (30) days prior to the expiration date listed above.
