ORDINANCE
AN ORDINANCE TO AMEND CHAPTER 54, STREETS AND
SIDEWALKS, OF THE CODE OF THE CITY OF MIAMI,
FLORIDA, BY ADDING SECTIONS 90 TO 99
(INCLUSIVE) RESERVED; BY ADDING A NEW ARTICLE
V. BASE BUILDING LINES, PROVIDING FOR THE
ESTABLISHMENT OF BASE BUILDING LINES, THEIR
SPECIFICATION AND MEASUREMENT; PROVIDING FOR
TEMPORARY ENCROACHMENTS, AND PROHIBITING
ILLEGAL ENCROACHMENTS; PROVIDING FOR AN
EFFECTIVE DATE; REPEALING ALL ORDINANCES,
CODE SECTIONS, OR PARTS rHEREOF IN CONFLICT
AND CONTAINING A SEVERABILITY CLAUSE.
WHEREAS, the City Commission, on September 23, 1982, passed
and adopted on second reading, by title only, Ordinance No. 9500,
Zoning Ordinance of the City of Miami, Florida, with an effective
date of May 1, 1983; and
WHEREAS, Ordinance No. 6871, Comprehensive Zoning Ordinance
of the City of Miami, Florida, as amended, was repealed by this
action; and
WHEREAS, Ordinance No. 9500 relates to the use and
development of private property only, thus eliminating any
requirement for right-of-way widths for streets and/or
establishing base building lines; and
WHEREAS, the City Commission deems it advisable in the
interest_ of the general health, welfare and safety of the
residents of the City of Miami to retain the establishment of
such rights -of -way and/or base building lines;
NOW, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE CI`1'Y
OF MIAMI, FLORIDA:
Section 1. That Chapter 54, Streets and Sidewalks, of the
Code of the City of Miami, Florida, as amended, is hereby further
amended by adding the following:
"SEC`.['IONS 54-90 TO 54-99 RESERVED.
ARTICLE V. BASE BUILDING LINES.
Sec. 54-100. BASE BUILDING LINES ESTABLISHED.
Base Building Lines are hereby established for the purpose of
assuring that sufficient space occurs between the,str_eet fronts
of buildings and structures; to provide for natural light and

circulation of air; to lessen the adverse effect resulting from
fire, floods, tornadoes, and hurricanes; to provide for access
for fire -fighting apparatus
or
rescue and
salvaqe operations;
to
facilitiat-e provisions
for
traffic,
transportation
and
circulation, and to promote safety, health, amenity and general
welfare within the City. No building, structure, or part
thereof, shall be erected, structurally altered, enlarged or
extended beyond the base building lines established by this
Ordinance with the exception of encroachments or temporary
structures which are specifically permitted by the South Florida
Ruilding Code or this Chapter. Further_, restaurant arcades are
allowed by revocable permits granted by the City Commission in
the Flagler Street special overlay district after approval by the
City Manager and recommendations by the Director of Public Works,
the Director of Planning, and the Director of Fire, Rescue, and
Inspections Services.
SECTION 54-101 SAME, STANDARD STREET WIDTHS.
All streets in the City of Miami not otherwise designated by this
Ordinance shall be established at a minimum width of fifty (50)
feet, and the base building line shall be located twenty-five
(25) feet from the official center -line, said official
center -line to be determined and established by the Director of
the Department of Public Works of the City of Miami.
SECTION 54-102 SAME, PLATTED WIDTH GREATER.
Where the existing platted or dedicated street right-of-way lines
are at a greater distance from the official center -line than
established base building lines, then such existing right-of-way
lines shall constitute the base building lines.
SECTION 54-103 SAME, CENTER -LINE DESCRIPTIONS.
Center -line descriptions for the streets described herein are on
file in the offices of the City Clerk and the Department of.
Public Works of the City of Miami and are hereby adopted by
reference and are to be considered as being embodied in this
Chapter in the same manner as if hereinafter set forth.
Section 54-104 SAME, NON-STANDARD STREET WIDTHS.

"SECTION 54-105 SAME, TEMPORARY ENCROACHMENTS.
Whenever the owner(s) of property within the City of Miami wishes
to install a temporary encroachment, i.e. fence, wall or hedge,
within the undedicated area between the platted or dedicated right-
of-way line and the established base building line, the owner_ shall,
before beginning any installation, construction or planting, make
formal request for such an encroachment, in writing, to the Director
of the Department of Public Works. The owner shall submit, with
his request, a current survey of the property, and a sketch or
drawing showing sufficient detail to accurately portray the nature
and extent of the encroachment.
The Director of the Department of Public Works, or his
designee, shall evaluate the request and the information supplied
with regard to its effect on the health, welfare and safety of the
community. In evaluating the request, the Director may confer with
representatives of other departments or agencies, as may be necessary.
If there is a negative effect on the health, welfare or
safety of the community, the request for encroachment shall be denied.
If there is no negative effect on the health, welfare or
safety of the community, the Director may approve the application
subject to the recording of a covenant to run with the land executed
by the owner, with the payment, by the owner, of the requisite fees
for preparation and recording of said covenant.
The provisions of the covenant shall include, but not be
limited to:
(a) Removal of the encroachment by the property owner with-
in thirty (30) days of notification by the Director of the Department
of Public Works, that said removal is necessary, and at no cost to
the City.
(b) In the event of failure of the property owner to remove
the encroachment when notified, the City may cause the removal of
the encroachment, and place a lien against the property for the cost
of the removal.

(c) Dedication to the City of the necessary right-of-
way upon removal of the encroachment.
(d) Provision of an insurance policy, in an amount to be
determined by the Department of Law, naming the City as insured for
public liability and property damage, or certificate of inclusion
of the City as insured on an existing insurance for the property,
subject to approval of the Department of Law.
Upon recording of the above covenant, and not before, the
Director shall approve a permit for the construction or installation
of the temporary encroachment, with the payment of the necessary
permit fee by the property owner.
SECTION 54-106 SAME, SERVICE ROAD ADJACENT TO BRICKELL AVENUE.
Under Ordinance No. 9500, Zoning Ordinance of the City of Miami,
Florida, it is required that a seventy (70) foot wide service road
be provided along the southeasterly side of, and parallel to, Brickell
Avenue, between S.E. 15th Road and S.E. 25th Road.
If, the owner(s) of property along this portion of Brickell
Avenue wish to install a sign, for purposes of building identification,
in the landscaped area between Brickell Avenue and the parallel
service road, a request, in writing, must be addressed to the Director
of the Department of Public Works, following the guidelines and
procedures set forth in Section 54-105, including the recording of
a covenant to run with the land for the installation of said sign.
The design for such a sign must comply with all applicable
regulations concerning signs. In addition, the design and placement
of this sign shall be approved by the Director of the Planning
Department and the Director of the Department of Public Works.
SECTION 54-107 SAME, ILLEGAL ENCROACHMENT
When any owner of property within the City shall cause the construction
or installation of an encroachment within the dedicated right-of-way,
or when said property owner shall cause the construction or installation
of an encroachment within the undedicated area between the platted or

dedicated right-of-way line and the tease building line, and a
covenant and permit have not teen granted as set forth in
Section 54-105, the Director of the Department of Public
Works, upon being notified of the encroachment, shall give
notice to the property owner, by certified letter, of the
encroachment, and shall require the removal of said
encroachment within thirty ( 3 0 ) days of the date of said
certified letter.
If the property owner shall fail, or refuse, to remove
the encroachment within the specified time period, the
Director shall cause the encroachment to be removed, and a
lien shall be placed against the property for the cost of
said removal.

dedicated right-of-way line and the base building line."
Section 2. The provisions of this Ordinance shall take
effect May 16, 1983.
Section 3. All ordinances or parts of ordinances in
conflict herewith, insofar as they are in conflict, are
hereby repealed.
Section 4. If any section, part of section, paragraph,
clause, phrase, or word of this Ordinance is declared
invalid, the remaining provisions of thus Ordinance shall not
be affected.

hensive Zoninq Ordinance 6871 be placed in the City Code, together
with related material. Comn_rehensive Zoning Ordinance 6871 will
expire on May 1, 1983; base building lines were purposely not in-
cluded in new Zoning Ordinance 9500 effective May 1, 1983.
These a::iendments provide for the establishment of base building;
lines, tlieir specification and measurement. Temporary encroach-
ments are provided and illegal encroachments are prohibited.

AN ORDINANCE TO AMEND CHAPTER 54, STREETS AND
SIDEWALKS, OF THE CODE OF THE CITY OF MIAMI,
FLORIDA, BY ADDING SECTIONS 90 TO 99 (INCLUSIVE)
RESERVED; BY ADDING A NEW ARTICLE V BASE BUILD-
ING LINES, PROVIDING FOR THE ESTABLISHMENT OF
BASE BUILDING LINES, THEIR SPECIFICATION AND
MEASUREMENT; PROVIDING FOR TEMPORARY
ENCROACHMENTS, AND PROHIBITING ILLEGAL
ENCROACHMENTS; PROVIDING FOR AN EFFECTIVE DATE;
REPEALING ALL ORDINANCES, CODE SECTIONS, OR PARTS
THEREOF IN CONFLICT AND CONTAINING A SEVERABIL-
ITY CLAUSE.
Said proposed ordinance(s) may be inspected by the public at the
office of the City Clerk, 3500 Pan American Drive. Miami, Florida,
Monday through Friday, excluding holidays, during the hours of 8:00
a.m. to 5:00 p.m.
All interested parties may appear at the meeting and be heard with
respect to the proposed ordinance(s).
Should any person desire to appeal any decision of the City Com-
mission with respect to any matter to be considered at this meeting,
that person shall ensure that a verbatim record of the proceedings is
made including all testimony and evidence upon which any appeal
may be based.
