HomeMy WebLinkAboutR-23-0240City of Miami °x�y�`_ Resolution R-23-0240 alldl 11 li.Rl I + Legislation File Number: 13981 City Hall 3500 Pan American Drive Miami, FL 33133 www.miamigov.com Final Action Date: 5/25/2023 A RESOLUTION OF THE MIAMI CITY COMMISSION, WITH ATTACHMENT(S), AFTER A DULY NOTICED PUBLIC HEARING, AUTHORIZING AND DIRECTING THE CITY MANAGER TO TAKE ANY AND ALL ACTION(S) NECESSARY TO EXPEDITIOUSLY REQUEST THE MIAMI-DADE COUNTY DEPARTMENT OF TRANSPORTATION AND PUBLIC WORKS ("DTPW') CONSIDER THE PROPOSED TRAFFIC FLOW MODIFICATIONS AND WAIVE THE REQUIRED RESIDENT CONCURRENCE AND EXEMPT THE BALLOTING PROCESS IN ORDER TO EXPEDITIOUSLY PROCEED WITH THE DESIGN AND CONSTRUCTION OF TRAFFIC CALMING DEVICES AT TWENTY-THREE (23) LOCATIONS IN THE RESIDENTIAL NEIGHBORHOODS OF CITY OF MIAMI DISTRICT 4, AS MORE PARTICULARLY DESCRIBED IN EXHIBIT "B," ATTACHED AND INCORPORATED; DIRECTING THE CITY CLERK TO SEND A CERTIFIED COPY OF THE THIS RESOLUTION TO THE DTPW DIRECTOR. SPONSOR(S): Commissioner Manolo Reyes WHEREAS, several locations in the City of Miami's ("City") District 4 residential neighborhoods are experiencing significant cut -through traffic and speeding during rush hour periods; and WHEREAS, such cut -through traffic and speeding on local residential streets that are not designed for such volume diminishes residents' quality of life; and WHEREAS, in addition to quality -of -life problems such as noise and general congestion, such cut -through traffic and speeding creates significant life -safety risks as residential streets are narrower than nearby arterial roadways, increasing the risk of vehicular accidents, including those involving pedestrians; and WHEREAS, those who cut -through residential neighborhoods during rush hour traffic tends to disobey posted speed limits and signage to gain an advantage over using arterial roadways meant for such traffic; and WHEREAS, in order to alleviate these issues, the City proposes to install twenty-three (23) traffic calming devices at several locations in the residential neighborhoods, as described in Exhibit "B" attached and incorporated, that experience significant cut -through traffic and speeding during morning and afternoon rush hour periods; and WHEREAS, Section 1.6 of the Miami -Dade County Traffic Flow Modification(s)/Street Closure(s) Procedure, as revised by the Miami -Dade County Public Works Department (TWD") Traffic Engineering Division in January 2009, attached and incorporated as Exhibit "A" ("County Procedure"), requires concurrence from the affected residents and/ or property owners; and City of Miami Page 1 of 4 File ID: 13981 (Revision:) Printed On: 6/13/2023 File ID: 13981 Enactment Number: R-23-0240 WHEREAS, Section 1.6 of the County Procedure further states: "Municipal Jurisdictions: In lieu of concurrence from the affected residents and/or property owners, a municipality may pass a resolution after a public hearing requesting PWD [now known as the Miami -Dade County Department of Transportation and Public Works ("DTPW )] to consider the proposed traffic flow modification(s)/street closure(s)"; and WHEREAS, in order to expeditiously address the aforementioned quality of life and life - safety issues, the City desires to install the twenty-three (23) traffic calming devices, as more particularly described in Exhibit "B," attached and incorporated, in designated residential neighborhoods of District 4 without delay by holding a public hearing in lieu of resident/property owner concurrence through balloting; and WHEREAS, although the City is adopting this Resolution after a public hearing in lieu of concurrence, it is the intent of the City, to the best of its ability, to seek concurrence from the residential properties whose frontage directly abuts the proposed traffic calming devices, as are more particularly described in Exhibit "B," attached and incorporated; and WHEREAS, in lieu of concurrence from the affected residents and/or property owners, the City Commission finds it in the best interest of the City and its residents to pass a resolution after a public hearing requesting PWD/DTPW to consider the proposed traffic flow modification(s)/street closure(s) as described in Exhibit "B," attached and incorporated; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OFMIAMI, FLORIDA: Section 1. The recitals and findings contained in the Preamble to this Resolution are adopted by reference and incorporated as fully set forth in this Section. Section 2. The City Commission, after a duly noticed public hearing, authorizes' and directs the City Manager to take all actions necessary to expeditiously request that DTPW consider the proposed traffic flow modifications at the following twenty-three (23) locations within District 4, as more particularly described in Exhibit "B", attached and incorporated, in order to expeditiously proceed with design and construction of the traffic calming devices: 1. Tamiami Boulevard from Southwest Sixth Street and to Southwest Fourth Street 2. Southwest Fifty -Fifth Avenue Road from Southwest Second Street to Southwest Fifty-fifth Avenue 3. Southwest Sixth Street from Southwest Thirty-ninth Avenue to Southwest Thirty-ninth Court 4. Southwest Fourth Street from Southwest Forty-seventh Avenue to Southwest Forty-eighth Avenue The herein authorization is further subject to compliance with all legal requirements that may be imposed, including but not limited to those prescribed by applicable City Charter and City Code provisions. Southwest Sixty-third Avenue from Southwest Sixth Street to Southwest Eighth Street 18. Northwest Thirty-fourth Avenue from Northwest Fourth Terrace to Northwest Fourth Street 19. Northwest Thirty-fourth Avenue form Northwest Fourth Street to Northwest Third Street 20. Northwest Thirty-fourth Avenue form Northwest Second Street to Northwest First Street 21. Southwest Thirty-fourth Avenue from Southwest Second Street to Southwest Third Street 22. Southwest Thirty-fourth Avenue from Southwest Fourth Street to Southwest Fifth Street 23. Southwest Thirty-fourth Avenue from Southwest Sixth Street to Southwest Seventh Street Section 3. The City Clerk is directed to send a certified copy of this Resolution to Eulois Cleckley, Director of Miami -Dade County's Department of Transportation and Public Works. Section 4. This Resolution shall become effective immediately upon its adoption.
