Dear Mr. Tritt:
City Manager Howard V. Gary asked that I inform you that your
request for a personal appearance before the City Commission
concerning the maintenance of a live-in watchman at Watson Is-
land has been tentatively scheduled for April 6, 1983.
After reviewing the appropriate City ordinance (ORD. 8043), it
has been concluded that we are unable to grant you administra-
tive relief and your request should be referred to the City Com-
mission for their consideration. We will withhold enforcement
pending the outcome of the Commission's action.

Dear Mr. Gary;
The purpose of this letter is to request a change in the appropriate ordinances,
to allow a condition that has existed unchallanged, in my business for the past seven
years, and which I consider an absolute necessity to the efficient operation and
security of said business.
-tor the past seven years, Mr. Don Hanson has been located in his motor home,
Parked directly to the right of the front door of my fueling facility. Although
::e has his own business, he runs my store on a regular basis from six to ten P.M.
Pri::c,; Caturdayt and Sunday, and is available to open in the event that someone
in wick, or when needed try some of our customers, which include, The Florida :;talc
Ecrine Patrol, The Coast Guard, The Coast Guard Auxillary, The Border Fatrol, and
nny citizen in trouble.
During my first year in business, approximately four years ago, I was broken
into eig t times on occasions when 1•Ir. Henson had to leLve. l:atson Island is a
dcr,olate place at night, and 1r Hanson acts as security for the boat slips cortraljcd
by Iliami EUrina as well as my store.
I would appreciate greatly any help you can give me in expediting this natter.

Dear Mr. Gary:
I have been informed that Don Hanson, storekeeper and security
officer, will no longer be able to reside at the Watson Island Phil-
lips 66 fuel dock. I am taking this opportunity to express our ap-
preciation for the numerous times Mr. Hanson has assisted the U.S.
Customs Patrol with fuel services when other facilities were closed
or not readily accessible.
In view of the above, I would like to respectfully request that
if there is any way arrangements could be made to keep Mr. Hanson in
his present position without compromising your work situation, the
Customs Patrol would be very appreciative.

ORDINANCE NO. 8043
AN ORDINANCE AMENDING THE MIAMI CITY CODE,
SECTION 38, ENTITLED "OPPEHSES--MI SC&LLANE0U3",
BY ADDING A M SECTION 38-54.1, iHTITLED
"VEHICLES--LIVINO OR SLEEPING THEREIN", PER-
TAINING TO THE PARKING OF VEHICLES ON PUBLIC
RIOHT-OP-MAY, PUBLIC PROPERTY OR PRIVATE
PARKING LOTS POR THE PURPOSES OF LIVING OR
SLEEPING THEREIN; PROVIDING A PENALTY REPEAL-
ING ALL LAWS IN CONPLICT HEREWITH; AND, PROVID-
ING FOR A SEVERABILITY CLAUSE HEREIN; DECLARING
THIS ORDINANCE TO BE AN EMERGENCY MEASURE AND
DISPENSING WITH THE REQUIREMENT OF READING THE
SAME ON TWO SEPARATE DAYS BY A VOTE OF NOT LESS
THAN FOUR -FIFTHS OF THE MEMBERS OF THE COMMISSION
BE IT ORDAINED BY THE COMMISSION OP THE CITY
OP MIAMI, FLORIDA:
Section 1. That the Miami City Code, Section 36,
entitled "Offenses --Miscellaneous", is hereby amended
by a new Section 38-54.I, entitled "Vehicles --Living
or Sleeping Therein", to read as follows&
Section 38-54.1 Vehicles --Living or Slespin% Therein.
It Shall be unlawful for any person within
the City to park any vehicle on public rights -of -
way, public properties, or private parking lots,
for the purposes of:
(a) Living; or
(b) Sleeping; or
(c) Cooking; or
(d) Bathing; or
(e) Housekeeping.
Section 2. Any person violating the provisions
or Section 1 of this Ordinance shall be fined and 1w
prisoned, or both fined and imprisoned, in accordance
with Sections 3(aa) and 59(b) of the Charter of the
City of Miami (Chapter 10847, Act& of Plorida, 1925,
as amended) and Section 1-6 of the Code of the City
or Miaai,Plorida.

Section 3. All ordinances, code sections or
parts thereof in conflict herewith, insofar as they
are in conflict, are hereby repealed.
Section 4. It is declared to be the legislative
Intent of this body that if any section, subsection,
sentence, phrase or provision of this Ordinance is
held invalid, the remainder of the Ordinance shokll not
be affected.
Section g. That this ordinance is hereby declared
to be an emergency measure on the.ground of urgent public
need for the preservation of peace, health, safety and
property in the City of Klmd .
Section 6. That the requirement of reading this
Ordinance on two separate days is hereby dispensed with
by a vote of not less than four -fifths or the members
of the Commission.
PASSED AND ADOPTED by title only this 16th day
of lurch, 1972.
