AN ORDINANCE AMENDING CHAPTER 31,
"LICENSES, MISCELl ANEOUS LOUSINESS
REGULATIONS" OF THE CODE OF THE CITY OF
MIAMI, FLORIDA, AS AMENDED, BY ADDING A
NEW SECTION 31-42, ENTITLED "BOND
REQUIREMENT", THERETO TO PROVIDE FOR THE
POSTING OF A BOND AS A CONDITION
PRECEDENT To THE ISSUANCE OF AN
OCCUPATIONAL LICENSE TO PERSONS ENGAGED
IN THE BUSINESS OF FORWARDING FOOD,
MEDICINES, OR CASH PO INDIVIDUALS
RESIDING IN CUBA, OR TO PERSONS ENGAGED
IN THE BUSINESS OF ASSISTING IN THE
EXECUTION OF DOCUMENTS BY RESIDENTS OF
CUBA WHICH COCUMENTS ARE REQUIRED IN
ORDER TO MIGRATE FROM CUBA; FURTHER
REQUIRING THAT PERSONS SO ENGAGED FURNISH
A STATEMENT AT THE: 'TIME OF APPLYING FOR
SUCH LICENSE WHICH STATEMENT SHALL
FURNISH A DESCRIPTION OF THE NATURE AND
EXTENT OF THE SERVICES OFFERED BY SAID
PERSON TOGETHER WITH THE PROPOSED MANNER
SUCH SERVICES ARE ADVERTISED; FURTHER
REQUESTING THAT THERE BF FULL COMPLIANCE
WITH ALL COUNTY, STATE AND FEDERAL LAWS
BEFORE SUCH LICENSE IS ISSUED; CONTAINING
A REPEALER PROVISION AND A SEVERABILITY
CLAUSE.
WHEREAS, there is an increasing number of complaints of
fraud from residents with friends and relatives living in
Cuba; and
WHEREAS, the complaints, which are supported by press
and radio investigative accounts, are that local residents
are being defrauded by local companies who guarantee delivery
of goods, cash and even travel documents to friends and
relatives living in Cuba in exchange for the payment of
charges made by these companies; and
WHEREAS, the majority of these complaints involve the
failure to deliver goods, cash and travel documents in Cuba;
and
WHEREAS, there is no refund of charges and no return of
goods or monies by the local "forwarding companies" who do
not perform many of whom discontinue business operations
leaving their customers without redress for the recovery of
hundreds of thousands of dollars;

N0W, THEREFORE, BE IT ORDAINED BY THE COMMISSION OF THE,
CITY OF' MIAMI, FLORIDA:
Section 1. Chapter 31, "LICENSES, MISCELLANEOUS
BUSINESS REGULATIONS" of the Code of the City of Miami,
Florida, as amended, is hereby further amended by adding a
new Section 31-42, entitled "i3ond requirement", thereto to
read as follows:
"Sec. 31-42. Bond requirement.
a.(1) A bond in the amount of $500,000
shall be deposited with the finance
department as a condition precedent
to the issuance of an occupational
license under this Chapter to any
person seeking to enga(3e in or
operate in the city the business of
forwarding food, medicines, or cash
to individuals residing in Cuba, or
to persons engaged in the business of
assisting in the execution of
documents by residents of Cuba which
documents are required in order to
migrate from Cuba..
(2) The herein bond may be from a surety
company; a cashier's check payable
to the City of Miami, or cash.
(3) The bond shall remain on deposit with
the City of Miami and shall expire
after a period of two (2) years from
the date of deposit or one ( 1 ) year
from the date of expiration of any
occupational license which is not
renewed at the end of the year for
which said license has been granted.

(4) Before the return of the bond or
return of the balance of bond monies
to the person posting the same, there
must be a final judgment or
disposition of any lawsuits filed
against said person by anyone who has
paid charges or fees to said person
provided said lawsuits have been
filed within the period set forth in
paragraph (3) of this subsection.
b. As a condition precedent to the issuance of
an occupational license under this Chapter
to any person' seeking to engage or operate
in the city in the business of forwarding
food, medicines, or cash to individuals
residing in Cuba, or in the business of
assisting in the execution of documents
required by residents of Cuba to migrate
from Cuba, said person shall furnish a
statement describing the nature and extent
of the services offered by said person in
the conduct of said business and setting
forth the manner in which such services are to be
offered or advertised to the public.
= C. No occupational licenses shall be issued to
persons engaged in the business of
forwarding food, medicines or cash to
individuals residing in Cuba, or in the
business of assisting in the execution of
documents required by residents of Cuba to
migrate from Cuba, unless said persons have
fully complied with all county, state and
federal laws.

d. The bond requirement Set forth in
subsection ( a ) hereof shall not be
applicable if the person so engaged shall.
have posted with a county, state or federal
agency a bond in like amount with similar
conditions.
Section 2. All ordinances or parts of ordinances in
conflict herewith, insofar as they are in conflict, are
hereby repealed.
Section 3. If any section, part of section, paragraph,
clause, phrase, or word of this ordinance is declared
invalid, the remaining provisions of this ordinance shall not
be affected.
