WHEREAS, the Leqislature of the State of Florida passed a
special act prohibiting the construction of all new structures in
Bayfr_ont nark, which became effective on May 14, 1951, and was
known as Chapter 27717, Senate Bill 568; and
WHEREAS, the Constitution and general laws of Florida have
granted home rule powers to municipalities; and
WHEREAS, such home rule powers found in Chapter 166, Florida
Statutes, conflict with the provisions of the aforementioned
special act of the legislature; and
WHEREAS, Chapter 166.021(5) provides that special acts
existing at the time of the passage of Chapter 166, Florida
Statutes become ordinances of the City subject to amendment and
repeal as other City Ordinances if they pertain exclusively to
the power and jurisdiction of the municipality; and
WHEREAS, Chapter 27717 is such a special act and may be
amended by the City of Miami as all other City ordinances;
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COMMISSION OF THE
CITY OF MIAMI:
Section 1. Chapter 27717, Senate Bill Tqo. 568, a special
act of the legislature of the State of Florida, effective May 14,
1951, which prohibited construction of structures in Bayfront
Park in the City of Miami, is hereby amended in the following
particulars:l

Underscored words and/or figures shall be added. The remaining
provisions are now in effect and r_omain unchanged.
"Section 1.. That from and after the effective date
of this Act, it shall he unlawful for any ft..irther
buil6ings or structures to be built, constructed or
moved into Bayi:ront Park,, or other inroads which
inroads shall include Par_kinq Dots in said mark,
located in the City of Miami, a municipal. corporation
of the State of Florida, except that the following
shall be permited:
1. The construction of new structures as set
forth in the City of Miami's Bayfront Park
Redevelopment Project as approved by the City
Commission in Resolution No. 82-380 dated
March 11, 1982, and
2. The construction of new structures as set
forth in the City of Miami's proposed Bayside
Specialty Center Project."
Section 2. All ordinances or parts of ordinances in
conflict herewith, insofar as they are in conflict, are hereby
repealed.
Section 3. If any section, part of section, paragraph,
clause, phrase, or word of this ordinance is declared invalid,
the remaining provisions of this ordinance shall not be affected.

Resolution No. 82-380 dated
March 11, 1982
Amending Ordinance
It is recommended that the City Commission
approve the attached Ordinance amending a
Special Act of the Florida Legislature,
Chapter 27717, Senate Bill 568, May 14, 1951,
which prohibited construction of structures
in Bayfront Park, in the City of Miami, to
permit the construction of new structures as
set forth in the City of Miami's Bayfront
Park Redevelopment Project, as approved by
the City Commission in Resolution No. 62-380,
dated March 11, 1982, and the City of Miami's
proposed Bayside Specialty Center Project.
The Legislature of the State of Florida passed a special act
prohibiting the construction of all new structures in Bayfront
Park which became effective on May 14, 1951, known as Chapter
27717, Senate Bill 568.
Chapter 166.021(5) of the Florida Statutes provides that
special acts existing at the time of the passage of Chapter 166
granting home rule powers to municipalities become ordinances of
the municipalities subject to amendment and repeal if they
pertain exclusively to the power and jurisdiction of the munici-
pality.
It is in the best interest of the City of Miami to amend by
ordinance this special act prohibiting construction in Bayfront
Park in order to move forward with both the Bayfront Park
Redevelopment Project and the Bayside Speciality Center at
Miamarina. The specialty center plans include a portion of
Bayfront Park land area.
