HomeMy WebLinkAboutR-83-0319J-83-272 RESOLUTION NO. 83-31S A RESOLUTION AUTHORIZING THE CITY MANAGER TO EXECUTE THE AMENDED AGREEMENT IN SUBSTAN- TIALLY THE FORM ATTACHED HERETO, TO PROVIDE ADDITIONAL PROFESSIONAL SERVICES, WITHIN THE ORIGINAL SCOPE OF SERVICES, BUT UNFORESEEN AT THE TIME OF THE ORIGINAL AGREEMENT, FOR THE FACADE RESTORATION OF THE FLAGLER (BUTLER) BUILDING, USING PARKS FOR PEOPLE BOND FUNDS PREVIOUSLY ALLOCATED FOR THIS PROJECT. WHEREAS, the City Commission by Resolution No. 80-555 adopted July 24, 1980, authorized the City Manager to enter into agreements as necessary to carry out the facade restoration of the Flagler (Butler) Building located in Fort Dallas Park; and WHEREAS, the project was halted in February 1981, after 80% completion, pending the development of final plans for Ft. Dallas Park and the Miami Riverwalk; and WHEREAS, the plans for Ft. Dallas Park are now complete and the Miami Riverwalk has been constructed; and WHEREAS, the PRINCIPAL has been requested to complete the PROJECT and to carry out additional design work within the original scope of services for unforeseen at the time of the original agreement; and WHEREAS, it is in the CITY'S best interest to proceed to complete this element in the Miami Riverwalk/Ft. Dallas Park Project; NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. The City Manager is hereby authorized to execute Amendment #1, in substantially the form attached hereto, to the original Agreement dated July 29, 1980, with Beilinson-Tinney-Architects to provide additional professional services within the original scope of services, but unforeseen at the time of the original Agreement, for the facade restoration of the Flagler (Butler) Building, using Parks for People Bond -1- CITY CCi?:'_I aJLGI� A P R G 1985 RE`.OLuI1';:I I . 83-, V 00 Funds previously allocated for this project. Ferre M A Y O R 83-315 AMENDMENT =1 FLAGLER (BUTLER) BUILDING FACADE RESTORATIO?N CONSULTANT AGREEMENT This Supplemental Agreement made this day of. , 1983, by and between THE CITY OF MIAMI, a municipal corporation of the State of Florida, hereinafter called the "CITY", and Beilinson-Tinney-Architects, Planners, P.A., hereinafter called the "PRINCIPAL". WITNESSETH WHEREAS, the City Commission by Resolution No. 80-555 adopted July 24, 1980, authorized the City Manager to enter into agreement as necessary to carry out the facade restoration of the Flagler (Butler) Building located in Fort Dallas Park; and WHEREAS, the project was halted in February 1981, after 80% completion, pending the development of final plans for Ft. Dallas Park Project: NOW, THEREFORE, the CITY and PRINCIPAL, for the considerations hereinafter set forth, hereby amend the Agreement of July 29, 1980, as follows: D. The CITY agrees to pay and the PRINCIPAL agrees to accept this payment in full for all professional and technical services rendered as outlined in Section II - Professional Services - thereof, a fixed fee of Five Thousand One Hundred and Twenty Eight Dollars ($5,128.00) for Phases III and IV of this PROJECT. Paqe 1 of 3 83--31 5 U SECTION III PHASE III a) (at the end of this paragraph add:) These construction plans shall also include a ramp for exit by the handicapped, site work and paving east of the entrance to the structure. 1. Attend a weekly site meeting and make periodic visits to the site as necessary to familiarize himself with the progress and quality of the WORK, and to determine that the WORK is proceeding in accordance with the Contract Documents. Submit a site visit report to the PROJECT MANAGER within five (5) calendar days after each meeting or visit. SECTION V - COtlPENSATION FOR SERVICES 2. For Phase III - Contract Documents and Bidding, and Phase IV - Construction: The CITY agrees to pay and the PRINCIPAL agrees to accept as full payment for his services a lump sum fee of $6,372.00 hereinafter called the "BASIC FEE".... This payment will be made on a monthly basis in proportion to the services performed, so that the completion of each remaining Phase shall equal the following percentages of the total BASIC FEE. Payment TOTAL Phase III $ 4,713.80 $ 4,713.80 74% Phase IV 1,656.20 6,372.00 100% SECTION VI - SCHEDULE OF WORK C - Phase III: Construction Documents and Bidding. 1. The Construction Documents shall be delivered to the PROJECT MANAGER within twenty (20) days. Work on this Phase shall commence after having received written authorization to proceed from the PROJECT MANAGER. It is further understood that all other conditions outlined under the original agreement remain in full force and effect without modification. Consultant Contract Amendment. w Er LFE 14C LS "It is recommended that the City Manager be authorized to execute the amended agreement in substantially the form attached hereto, to provide additional professional services, within the original scope of services, but unforeseen at the time of the original Agree- ment, for the facade restoration of the Flagler Building, using Parks for People Bond Funds previously allocated for this project." In order to construct the City of Miami/University of Miami James L. Knight International Center Parking Garage, the Flagler Building originally located at 134 S.E. 2nd Street, and used most recently by the Butler Insurance Company, was relocated to Ft. Dallas Park in May 1980. By Resolution No. 80-555 adopted July 24, 1980, the City Manager was authorized to enter into agreements as necessary to carry out the facade restoration on the Flagler Building, and as a result of selection procedures, the firm of Beilinson-Tinney- Architects-Planners, P.A. entered into a professional services agreement with the City on July 29, 1983, for the lump sum fee of $4,450. The project was halted in February 1981 after 80% of the work was complete, to allow for the development of final plans for Ft. Dallas Park and the Miami Riverwalk. With plans for the Park now complete and the Miami Riverwalk constructed, the final construction documents for the facade restoration need to be prepared enabling the project to proceed through bidding and construction. This amendment requires the consultant to carry out additional architectural work, within the original scope of services, but unforeseen at the time of the original agreement, which will include an access ramp, site work, paving, and additional construction administration. The additional fee will be $4,127.50 available through Parks for People Bond Funds already allocated for this project. 0 CK/JSA/cg 83-31S
