A RESOLUTION GRANTING A VARIANCE FROM
ORDINANCE NO. 6871, ARTICLE VI, SECTION 3 (3)
(a) TO PERMIT AN EXISTING FLORIDA ROOM
ADDITION TO THE EXISTING DUPLEX ON THE NORTH
63.35 FEET OF LOT 6 AND THE NORTH 63.35 FEET
OF THE WEST 40 FEET OF LOT 5, BLOCK 4,
MILDRED PARK (16-68); LOCATED AT 441-4411/2
SOUTHWEST 35TH AVENUE, AS PER PLANS ON FILE,
WITH AN EXISTING REAR YARD BETWEEN 10.20 FEET
AND 10.29 FEET IN DEPTH (20 FEET REQUIRED);
ZONED R-2 (TWO-FAMILY DWELLING), SUBJECT TO
DELIVERY TO THE CITY OF MIAMI OF A RECORDABLE
COVENANT IN FORM APPROVED BY THE CITY
ATTORNEY PROHIBITING FURTHER CONSTRUCTION ON
THE PREMISES AND SUBJECT TO OWNER OBTAINING
ALL REQUIRED PERMITS FROM THE CITY OF MIAMI
DEPARTMENT OF FIRE, RESCUE AND INSPECTION
SERVICES.
WHEREAS, the Miami Zoning Board at its meeting of November
1, 1982, Item No. 2, following an advertised hearing, adopted
Resolution No. ZB-195-82, DENYING VARIANCE as hereinafter set
forth; and
WHEREAS, objectors have taken an appeal to the City
Commission of said denial; and
WHEREAS, the City Commission notwithstanding the denial of
the Zoning Board, and after careful consideration of this matter,
finds that due to peculiar circumstances affecting this parcel of
land, practical difficulties and unnecessary hardship would
impair the owner's right to the reasonable use of the property
without the variance granted as hereinafter set forth;
NOW, THEREFORE, BE IT RESOLVED HY THE COMMISSION OF 'rHE CITY
OF MIAMI, FLORIDA:
Section 1. The request for variance as per Ordinance No.
6871, Article VI, Section 3 (3) (a) to permit an existing Florida

room addition to the existing duplex on the North 63.35 feet of

Lot 6 and the north 63.65 feet of the west 40 feet of Lot 5,
Block 41 MILDRED PARK ( 16-68) ; located at 441-4411/2 Southwest _'
35th Avenue, as per plans on file, with an existing rear yard
between 10.20 feet and 10.29 feet in depth (20 feet required);
zoned R-2 (Two -Family Dwelling) is granted subject to the 'i
delivery to the City of Miami of a recordable covenant in form

approved by the City Attorney prohibiting further construction on
the premises and subject to applicant ohtaining all required
permits from the City of Miami nepartment of Fire, Rescue and
Inspection Services.

The Zoning Board, at its meeting of November 1, 1982, Item 2, following an
advertised hearing, adopted Resolution No. ZB 195-82, denying a variance by
a vote of six to zero for the above petition. The subject property zoned
R-2 (Two -Family Dwelling) is also described as the N 63.35' of Lot 6 and
the N 63.33' of the W 40' of Lot 5, Block 4, Mildred Park (16-68).
Nine proponents present at•the meeting; three responses in favor received in
the mail.
Backup information is included for your review.
A RESOLUTION to provide for the above has been prepared by the City Attorney's
Office and submitted for consideration of the City Commission.

REQUEST Variance to permit an existing florida room addition
to the existing duplex on above site, as per plans
on file, with an existing rear yard between 10.20'
and 10.29' in depth (20' required).
RECOMMENDATIONS
PLANNING DEPT. DENIAL. There is no justification to for granting
a variance to illegal structures when other property
owners adhere to the official established process. _
There is no hardship involved in this case - the _
structure could have been designed to meet rear yard
requirements - the Planning Department therefore
recommends that the variance not be granted. (It
is essential that Zoning Board establish a policy
to judge illegal structures, so that the process ed
which they represent can be respected and enforced). A-

ENCLOSURES.
Mr. Miguel Lemos & Mr. Luis Serrono, ocaners of
_ the property at the above referenced address were
given the option of having the reinforcement in
their addition x-rayed by a Testing Laboratory,
or exposing the steel at non -critical areas --
they chose the latter.
I reinspected the monolithic footing/slab, tie beam
and column at the northeast corner of the building
where it was exposed and found it complies to the
South Florida Building Code.

I inspected the partially completed structure (Florida
Room) at the above mentioned address with the owners,
Miguel Lemos and Luis Serrono and the Engineer, Cabri.:l
E. Romarch and found that the structure appears to comply
with the South Florida Building Code.
With the recorunendations of the City of 1•iiami Conuni_ssioners
and ;•tayor, the above o%..ners will submit "as built" sealed
plans for approval and upon approval of all sections, will
complete the construction with a Building Permit.
