S 3—y)f% A RESOLUTION ESTABLISHING JULY 14, 1983 AS THE DATE FOR h PUBLIC HEARING CONCERNING ISSUANCE OF A DEVELOPMENT ORDER FOR THE; S.E. 8TH STREET AND ERICKELL AVENUE PROJECT, A DEVELOPMENT OF REGIONAL IMPACT TO Cif; LOCATED AT 801-999 I3RICKh LL AVENUE, AND DIRECTING THE CITY CLERK TO NOTIFY APPROPRIATE AGENCIES. WHEREAS, Chapter 380.06 Florida Statutes, "Florida Land and water Environmental Management Act", requires local government to establish a date certain, and give public notice, for a local public hearing on an i\pplication for Development Approval for a Development of Regional Impact prior to issuing a Development Order; and WHEREAS, by letter, the Sout4i Florida Regional Planning Council has noti.f-ied the City of 6iiami that the Application for Development Approval contains sufficient information for their review and that a local public hearing Soule be scheduled for the S.E. 8th Street and Brickell Avenue project, a Development of Regional Impact, to be located at 801-999 Brickell Avenue; and WHEREAS, Chapter 380.06 Florida Statutes requires local government to set a Nul:,lie hearing date at its next scheduled meeting after the receipt of such a letter and to give at least sixty (60) clays notice of the hearing; NOW, THEREFORE, RE IT RESOLVED BY THE COMMISSION OF THE CITY COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. A public hearing shall be held at 2:U0 PM, July 14, 1983 or at a reconvened meeting, in City Commission Chambers, 3500 Pan American Drive, Miami, Florida 33133, con- cerning issuance of a Development Order for the S.E. Sth Street and Brickell Avenue project, a Development of Regional Impact, to be located at 801-999 Brickell Avenue. Per Chapter 380.06 F.S., local government is required to set a date certain and to give public notice 60 days in advance of a required public hearing on an Application for Development Approval for a Development of Regional Impact, prior to issuing a Develop- ment Order. By letter (attached) the South Florida Regional Planning Council stated that the SE 8th Street and Brickell Avenue Application for Development Approval contained sufficient information for their review and would be tentatively scheduled on the Council agenda of June 6, 1983. Further, the letter stated that the Development of. Regional Impact public hearing must be set at the next scheduled meeting of the Commission and advertised at least 60 days in advance of the hearing, per Chapter 380.06 F.S. It is requested that the Commission consider the setting of the hearing date at their meeting of April 28, 1983, and establish July 14, 1983 as the Development of Regional Impact public hearing date for the SE 8th Street and Brickell Avenue project, which would allow for the required 60 day public notice. Box 330708 Miami, Florida 33133 Dear Mayor Ferre: This letter is to given written notice that the Tishman-Speyer/Equitable Application for Development Approval contains sufficient information for regional impact review. A Development of Regional Impact public hearing as required by Chapter 380.06(10), Florida Statutes, must be set at your next scheduled meeting and advertised at least sixty (60) days in advance of the hearing. The hearing notice must specify that the information and reports on the Development of Regional Impact Application may be reviewed at the Council and/or City of Miami offices. The law also requires that the notice of public hearing be transmitted to the Division of Local Resource Management, Florida Department of Community Affairs, and the South Florida Regional Planning Council. Receipt of that notice will officially commence our fifty day review period. At this time, the South Florida Regional Planning Council staff report and recommendations are tentatively scheduled to be presented for official action at the regular Council meeting on June 6, 1983.
