HomeMy WebLinkAboutR-83-0358rjw RESOLUTION NO. 35 A RESOLUTION RESCINDING RESOLUTION NO. 82-550; ACCEPTING THE REVISED PLAT EN- TITLED BAYFRONT PARK, A SUBDIVISION IN THE CITY OF MIAMI; ACCEPTING THE DEDICA- TIONS SHOWN ON SAID PLAT; AUTHORIZING AND DIRECTING THE CITY MANAGER AND CITY CLERK TO EXECUTE THE PLAT; AND PROVIDING FOR THE RECORDATION OF SAID PLAT IN THE PUBLIC RECORDS OF DADE COUNTY, FLORIDA. WHEREAS, Resolution No. 82-550 adopted June 17, 1982, accepted the plat of BAYFRONT PARK; and WHEREAS, revisions have been made in the plat previously accepted, necessitating the preparation of a new plat; and WHEREAS, the City Zoning Board and the Department of Public Works have recommended the acceptance of the attached plat: NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE CITY OF MIAMI, FLORIDA: Section 1. Resolution No. 82-550 adopted June 17, 1982, accepting the plat of BAYFRONT PARK, is hereby rescinded. Section 2. The plat entitled BAYFRONT PARK, a sLb division of the "JAMES HAGAN DONATION" a/k/a Section 37, Township 54 South, Range 42 East, City of Miami, Dade County, Florida, which plat by reference is made a part hereof as if fully incorporated herein, is hereby accepted. Section 3. The dedications shown thereon together with the dedications to the perpetual use of the public of all existing and future planting, trees, and shrubbery on said pro- perty, are also hereby accepted and confirmed by the City of Miami, Florida. Section 4. The City Manager and City Clerk are hereby authorized and directed to execute the plat and cause the same to be recorded in the Public Records of Dade County, Florida. Ca her Di c r u o ks April 7, 1983 "BAYFRONT PARK" Resolution Accepting Proposed Record Plat Located on Biscayne Boulevard between N.E. 6th & S.E. 2nd Streets (For Commission Meeting of April 28, 1983) The Departrent of Public Works recommends the approval of the Plat by the City Commission of Miami, Florida, and certifies its correctness as to form. The proposed record plat entitled "BAYFRONT PARK" is a subdivision of Section 37, Township 54 South, Range 42 East. It will consist of three tracts, having a total area of 61.3+ acres. It is zoned P-R. This plat is being forwarded to your office for City Commission action. This plat was previously adopted by Resolution #82-550 on June 17, 1982. Revisions to the area to be deeded to the U.S. Corps of Engineers are the only changes that differ from the original configuration approved. This area has been reduced from 5.17+ to 3.29+ acres more or less. Also attached are the following itemized papers necessary to present the plat to the City Commission of Miami: 1. Resolution accepting the plat. 2. Print of proposed record plat. 3. Opinion of Title. 4. Memorandun from the Ifiami-Dade Water & Sewer Authority pertaining to water mains and appurtenances. 5. Portion of City Zoning Sheet No. 36 showing property platted colored in red. It is in correct form for submission to the City Commission and is forwarded with a recommendation that it be approved. PERTINENT INFORMATION REGARDING THE PLAT: 1. The property platted is a subdivision of a portion of the JAMES HAGAN DONATION (Section 37), Township 54 South, Range 42 East. It will consist of three tracts, having a total area of 61.3t acres. It is zoned P-R. 2. The location of the streets and the widths conform with the standards of the Department of Public Works of the City of Miami, Florida. 3. As certified to by Walter K. Brown, Registered Land Surveyor, this plat complies with the plat filing laws of the State of Florida. 4. By authority of Resolution No. 55-83, adopted April 11, 1983, the plat was recommended for acceptance by the City Zoning Board of Miami, Florida. This is the second approval of this plat. 5. The attached Certificate of Title Examination dated 1983, signed by Joel Maxwell, Attorney, indicates that the fee simple title to the property platted is correctly vested in the City of Miami and the plat has been correctly executed. 6. The location of the property is shown colored in red on the accompanying copy of a portion of City of Miami, Florida Zoning Sheet No. 36. 7.
