RESOLUTION NO. 35
A RESOLUTION RESCINDING RESOLUTION NO.
82-550; ACCEPTING THE REVISED PLAT EN-
TITLED BAYFRONT PARK, A SUBDIVISION IN
THE CITY OF MIAMI; ACCEPTING THE DEDICA-
TIONS SHOWN ON SAID PLAT; AUTHORIZING AND
DIRECTING THE CITY MANAGER AND CITY CLERK
TO EXECUTE THE PLAT; AND PROVIDING FOR
THE RECORDATION OF SAID PLAT IN THE PUBLIC
RECORDS OF DADE COUNTY, FLORIDA.
WHEREAS, Resolution No. 82-550 adopted June 17, 1982,
accepted the plat of BAYFRONT PARK; and
WHEREAS, revisions have been made in the plat previously
accepted, necessitating the preparation of a new plat; and
WHEREAS, the City Zoning Board and the Department of
Public Works have recommended the acceptance of the attached plat:
NOW, THEREFORE, BE IT RESOLVED BY THE COMMISSION OF THE
CITY OF MIAMI, FLORIDA:
Section 1. Resolution No. 82-550 adopted June 17, 1982,
accepting the plat of BAYFRONT PARK, is hereby rescinded.
Section 2. The plat entitled BAYFRONT PARK, a sLb division
of the "JAMES HAGAN DONATION" a/k/a Section 37, Township 54 South,
Range 42 East, City of Miami, Dade County, Florida, which plat by
reference is made a part hereof as if fully incorporated herein,
is hereby accepted.
Section 3. The dedications shown thereon together
with the dedications to the perpetual use of the public of all
existing and future planting, trees, and shrubbery on said pro-
perty, are also hereby accepted and confirmed by the City of Miami,
Florida.
Section 4. The City Manager and City Clerk are hereby
authorized and directed to execute the plat and cause the same to
be recorded in the Public Records of Dade County, Florida.

Boulevard between N.E. 6th
& S.E. 2nd Streets
(For Commission Meeting
of April 28, 1983)
The Departrent of Public Works recommends
the approval of the Plat by the City
Commission of Miami, Florida, and certifies
its correctness as to form.
The proposed record plat entitled "BAYFRONT PARK" is a subdivision
of Section 37, Township 54 South, Range 42 East. It will consist
of three tracts, having a total area of 61.3+ acres. It is zoned
P-R.
This plat is being forwarded to your office for City Commission
action.
This plat was previously adopted by Resolution #82-550 on June 17,
1982. Revisions to the area to be deeded to the U.S. Corps of
Engineers are the only changes that differ from the original
configuration approved. This area has been reduced from 5.17+ to
3.29+ acres more or less.
Also attached are the following itemized papers necessary to present
the plat to the City Commission of Miami:
1. Resolution accepting the plat.
2. Print of proposed record plat.
3. Opinion of Title.
4. Memorandun from the Ifiami-Dade Water & Sewer
Authority pertaining to water mains and appurtenances.
5. Portion of City Zoning Sheet No. 36 showing property
platted colored in red.

The accompanying plat entitled "BAYFRONT PARK" was prepared by
Department of Public Works. It is in correct form for submission
to the City Commission and is forwarded with a recommendation that
it be approved.
PERTINENT INFORMATION REGARDING THE PLAT:
1. The property platted is a subdivision of a portion
of the JAMES HAGAN DONATION (Section 37), Township
54 South, Range 42 East. It will consist of three
tracts, having a total area of 61.3t acres. It is
zoned P-R.
2. The location of the streets and the widths conform
with the standards of the Department of Public Works
of the City of Miami, Florida.
3. As certified to by Walter K. Brown, Registered Land
Surveyor, this plat complies with the plat filing
laws of the State of Florida.
4. By authority of Resolution No. 55-83, adopted April 11,
1983, the plat was recommended for acceptance by the
City Zoning Board of Miami, Florida. This is the
second approval of this plat.
5. The attached Certificate of Title Examination dated
1983, signed by Joel Maxwell, Attorney, indicates that
the fee simple title to the property platted is correctly
vested in the City of Miami and the plat has been
correctly executed.
6. The location of the property is shown colored in red on
the accompanying copy of a portion of City of Miami,
Florida Zoning Sheet No. 36.
7. The attached resolution has been prepared for the acceptance
of the plat by the City Commission of Miami, Florida.

With the understanding that this Opinion of Title is
furnished tothe City of Miami, Department of Public Works for
the purpose of recording a plat covering the real property here-
inafter described. It is hereby certified that I have examined
the complete Abstract of Title CRT #49265, prepared by Common-
wealth Land Title Insurance Company, covering the period from
BEGINNING to May 18, 1982; a supplemental abstract of title No.
561,785 prepared by Associated Abstractors covering the period
from May 18, 1982, to August 18, 1982; and a supplemental
abstract of Title No. 563, 145, prepared by Associated Abstract-
ors covering the period from August 16, 1982, to October 4, 1982,
of the real property known as "BAYFRONT PARK", more particularly
described as:
All that strip or parcel of upland and
submerged land bounded as follows: On the
North by the South boundary line of that
Street of the City of Miami formerly known as
Eight Street, and now known as Northeast
Fourth Street, if said boundary line were
extended Eastward to the Channel of Biscayne
Bay; on the East by the channel of Biscayne
Bay; on the South by the North boundary line
of that Street of the City of Miami formerly
known as Twelfth Street; now known as Flagler
Street, if extended Eastward to the channel
of Biscayne Bay; and on the vest by the East
boundary line of that Street of the City of
Miami formerly known as the Boulevard and
also formerly known as North Bay Shore Drive
and now known as Biscayne Boulevard.
Also all that strip or parcel of upland

of that Street of the City of Miami, formerly
known as Eight Street, now known as Northeast
Fourth Street, if extended eastward to the
channel of Biscayne Bay; on the West by the
East boundary line of that Street of the City
of Miami, formerly known as the Boulevard and

That piece of parcel of land lying and
being in the County of Dade, and the State of
Florida, and more particularly described as
follows:
Commencina at a stake on the West shore
of Biscayne Bay, which stake is 3985 feet
South of the North line of Section 37,
Township 53 South, Range 42 East; thence
South 89 degrees, 18 minutes West to the west
boundary line of Biscayne Drive; then
Northerly along the hest boundary line of
Biscayne Drive 35 feet more or less to a
point where the North boundary line of
Twelfth Street of the City of Miami would
intersect the said West boundary line of
Biscayne Drive; thence East to the low water
mark on 'vest shore of Biscayne Bay; thence
Southerly meander the low water mark on said
Biscayne Bay 35 feet more or less to point of
Beginning; together with all common law and
statutory riparian rights belonging to or
appurtenant to above described property.
ALSO:
Commencing at a point on the East line
of Biscayne Drive (now known as Boulevard) in
the City of Miami, Florida, where the South
line of 12th Street, if extended East, would
intersect same, thence run Northerly along
the said East line of Biscayne Drive 35 feet,
to a point where the center line of said 12th
Street produced East, would intersect said
East line; thence run Easterly along said
center line of 12th Street produced to the
low water mark of Biscayne Bay, thence
meander the low water mark of Biscayne Bay in
a Southerly direction a distance of 35 feet,
if on a straight line, to the South line of
said 12th Street produced; thence Westerly
along said South line to the place of
beginning; together with all common law and
statutory riparian rights belonging to or
appurtenant to above described property.
The property herein and hereby described
is the property situated upon Biscayne Bay at
the Eastern Terminus of Flagler Street
formerly known as 12th Street, City of Miami,
Florida, and commonly and generally known as
the Elser Pier. Above description is made
with reference to a map of the City of Miami,
made by A. L. Knowlton, C. E., recorded in
Book "B" of Plats, Page 41, Dade County
records.

Based on said Abstract of Title and supplements, I certify
that as of the 4th day of October, 1982, title to the above -
described real property was vested in:
The CITY OF MIAMI, by Deed recorded in Deed
Book 266 at Page 320, filed July 11, 1921,
also in Deed Rook 266 at Page 322 filed July
11, 1961 and in Judgment recorded in Deed
Book 451 at Page 82, filed November 13,
1924.
Subject to the following encumbrances, liens, and other
exceptions:
GENERAL EXCEPTIONS
1. The abstract excepts taxes and municipal assessments.
Proof is required that any and all taxes, municipal
assessments, fees and liens have been paid and that
none are outstanding.
2. Rights of persons other than the above owners who are
in possession.
3. Facts that would be disclosed upon accurate survey.
4. Any unrecorded labor, mechanics' or materialmen's
liens.
5. Zoning and other restrictions imposed by governmental
authority.
SPECIAL EXCEPTIONS
1. A portion of this property is subject to an unrecorded
lease held by Restaurants Associates, Inc., governing
the period of November 25, 1970 through November 24,
1995.
2. This property is subject to easements for a "Sanitary
Force Main," a "storm sewer," and an undesignated
"proposed 20' easement," pursuant to June, 1982 Plat of
"BAYFRONT PARK" having a total area of 61.3 + acres,
prepared by the City of Miami Department of Public
